HomeMy WebLinkAbout2002-204 , . 1 RESOLUTION NO. 2002-204 2 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE 3 2002/2003 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 1007, LANDSCAPING MAINTENANCE DISTRICT, PEPPER AVENUE AND RANDALL 4 A VENUE AREA, 5 6 7 8 9 10 11 12 WHEREAS, by Resolution No, 93-142, the Mayor and Common Council found that the public interest, convenience, and necessity required the formation of a landscaping maintenance district; and WHEREAS, by said Resolution No, 93-142, the Mayor and Common Council formed an assessment district known as Assessment District No. 1007 for the purpose of providing landscaping maintenance in the Pepper A venue and Randall A venue area, pursuant to the provisions of Chapter 12,90 of the San Bernardino Municipal Code; and 13 14 15 16 17 18 levied on all land within the district to provide funding for said landscaping maintenance and the 19 WHEREAS, by Resolution No, 93-99, the Mayor and Common Council declared that all the land included within the boundaries of said district receive a special benefit by the maintenance of said landscaping; and WHEREAS, said Resolution No, 93-99 declared that an annual assessment shall be administration thereof; and 20 21 22 23 24 25 26 27 28 WHEREAS, an Assessment Roll has been prepared totaling $2,855.92, which sets forth the individual assessments to be levied on each of the parcels ofland within Assessment District No. 1007 for the fiscal year 2002/2003; and WHEREAS, Article XIII D of the California Constitution requires that any and all Assessment Districts existing on the effective date of said Article XIII D shall comply with the procedural and approval process as set forth in Section 4 of said Article XIII D, except as set forth in Section 5 therein, 05/31/02 , 2002-204 RESOLUTION CONFIRMING 2002/2003 ASSESSMENT ROLL NO, 1007 (PEPPER AVENUE AND RANDALL A VENUE AREA LANDSCAPING MAINTENANCE) 1 2 3 4 5 6 the assessments as set forth on said Assessment Roll No. 1007 are hereby exempt from the 7 procedural and approval requirements of Article XIII D of the California Constitution, as 8 provided for under Section 5(b) of said Article XIII D, and that the assessment amounts as set 9 forth on said Assessment Roll are equal to or less than any prior approved assessments, 10 11 that the proportionate costs to be levied against the parcels of land within Assessment District 12 13 No. 1007 are correctly set forth on Assessment Roll No. 1007, for the fiscal year 2002/2003, on 14 15 assessments. 16 17 18 19 for collection together with all other property taxes. 20 21 I II 22 III 23 III BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION I, That the Mayor and Common Council do hereby find and determine that SECTION 2.
