RESOLUTION NO,

WHEREAS, by Resolution No. 84-448, the Mayor and Common Council found that the
6 public interest, convenience, and necessity required the formation of a landscaping maintenance
7 district; and
8 WHEREAS, by said Resolution No. 84-448, the Mayor and Common Council formed
9 an assessment district known as Assessment District No. 959 for the purpose of providing
10
landscaping maintenance in the Shandin Hills area, pursuant to the provisions of Chapter 12.90
11

14 all the land included within the boundaries of said district receive a special benefit by the
15
of the San Bernardino Municipal Code; and
WHEREAS, by Resolution No. 84-335, the Mayor and Common Council declared that
maintenance of said landscaping; and
16
17 levied on all land within the district to provide funding for said landscaping maintenance and the
18
19
WHEREAS, said Resolution No. 84-335 declared that an annual assessment shall be
administration thereof; and
20
WHEREAS, an Assessment Roll has been prepared totaling $121,390,18, which sets
forth the individual assessments to be levied on each of the parcels of land within Assessment
21
22 District No. 959 for the fiscal year 2002/2003; and
23
WHEREAS, Article XIII D of the Califomia Constitution requires that any and all
24 Assessment Districts existing on the effective date of said Article XIII D shall comply with the
25
procedural and approval process as set forth in Section 4 of said Article XIII D, except as set
26

forth in Section 5 therein.

RESOLUTION CONFIRMING 2002/2003 ASSESSMENT ROLL NO. 959 (SHANDIN HILLS AREA
LANDSCAPING MAINTENANCE)
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:

6 the assessments as set forth on said Assessment Roll No. 959, are hereby exempt from the

SECTION 1. That the Mayor and Common Council do hereby find and determine that
procedural and approval requirements of Article XIII D of the California Constitution, as
provided for under Section 5(b) of said Article XlII D, and that the assessment amounts as set
9 forth on said Assessment Roll are equal to or less than any prior approved assessments.

No.959 are correctly set forth on Assessment Roll No. 959, for the fiscal year 2002/2003, on file
13
SECTION 2. That the Mayor and Common Council do hereby find and determine
that the proportionate costs to be levied against the parcels of land within Assessment District
in the office of the City Clerk of the City of San Bemardino, and do hereby confirm said
14
15 assessments.

SECTION 3. That the City Clerk is directed to cause a copy of this Resolution to be
transmitted to the Office of the Auditor-Controller for the County of San Bernardino with the
request that the individual assessments be placed on the subject 2002/2003 property tax bills
for collection together with all other property taxes.
