HomeMy WebLinkAbout2002-170 1 2 3 4 5 6 7 8 RESOLUTION NO. 2002-170 RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING AMENDMENT NO.1 TO AGREEMENT FOR PROFESSIONAL SERVICES WITH DAVID EVANS AND ASSOCIATES, INC. FOR ADDITIONAL DESIGN SERVICES ASSOCIATED WITH THE DESIGN OF THE WIDENING OF DEL ROSA DRIVE AND THIRD STREET AT THE SAN BERNARDINO INTERNATIONAL AIRPORT. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The attached Proposal dated May 20, 2002, and marked Exhibit "B", submitted by DAVID EVANS & ASSOCIATES, INC. to perform extra work for a fixed 9 10 fee of $12,300.00, under the terms of an Agreement for Professional Services with said 11 Engineer authorized by Resolutiol1 No. 2002-52, is hereby approved. Such approval shall be 12 13 effective only upon Amendment No. 1 being fully executed by both parties. The Mayor is hereby authorized and directed to execute said Amendment No.1 on behalf of the City. A 14 15 copy of Amendment No.1 is attached as Exhibit "A" and incorporated herein by reference as 16 fully as though set forth at length. 17 18 19 SECTION 2. This Amendment shall not take effect until the Amendment is fully signed and executed by the parties, and no party shall be obligated hereunder until the time of 20 such full execution. No oral Contracts, amendments, modifications or waivers are intended or 21 authorized and shall not be implied from any act or course of conduct of any party. 22 SECTION 3. PENMAN, City Attorney '1 '. !j&V'h-- - 2 - ~- EXHIBIT" A" 2002-170 AMENDMENT NO.1 TO AGREEMENT FOR PROFESSIONAL SERVICES This AMENDMENT NO.1 is made and entered into this 17th of June 2002, by and between the CITY OF SAN BERNARDINO, California, a municipal corporation, hereinafter referred to as the "CITY" and David Evans & Associates, Inc., hereinafter referred to as "ENGINEER". WITNESSETH WHEREAS, the San Bernardino City Council, on February 19, 2002, adopted Resolution No. 2002-52 approving an Agreement for Professional Services with Engineer for preparation of plans, specifications, and estimates for the design of the widening of Del Rosa Drive and 3" Street at San Bernardino International Airport (hereinafter "Agreement"); and WHEREAS, City has requested the Engineer to perform additional design services described, in general, as design of landscaping and irrigation along the west side of Del Rosa Drive between Art Townsend Drive and 3'd Street; and WHEREAS, City has also requested the Engineer to perform additional design services described, in general, as design of a frontage road adjacent to the Loma Linda Clinic located along the south side of 3'd Street between Tippecanoe Avenue and Del Rosa Drive; and WHEREAS, Engineer has requested an amendment to the Agreement to cover the cost of the additional design services as described in a letter proposal from Engineer dated May 20, 2002, marked as Exhibit "B" attached hereto and made a part hereof; and WHEREAS, paragraph S.B. of the Agreement allows adjustment to the total cost of services when the Engineer and City agree in writing that there has been, or will be, a significant change in the scope, complexity or character of the services to be performed; and WHEREAS, City agrees that the requested revisions are not within the scope of services covered in the Agreement; and NOW, THEREFORE, it is mutually agreed, as follows: I. SCOPE OF SERVICES Engineer shall perform those additional services identified in Exhibit "B". 2. COMPENSATION Upon satisfactory completion of the additional services contained herein City shall pay to Engineer an additional fixed fee of $12,300.00. Since this time, the City has discussed this issue with the businesse,~ along 3'" Stroot and come up with a resolution to eliminate 3 driveways by placing a private drivewaylfmntage road along the south side of 3'" Street. Kirk Shimek of our office and Mike Grubbs met On May 17. 2002 to review the details of Ihis option and carne up with a fea.'lible solution:HowC\'er, this revision will require some addilionaldesign revisions to our street improvement plans 10 incorporate this additional frontage road. Thus wc are requesting a change order 10 our existing contract No. 2002-52 to incorporate the design of the frontage road into our existing ,treet improvement plans. In addition, we requested a change order on May I, 2002 to provide landscape architectural services. (DEA), we would like to thank you for the opportunity to provide you with a proposal for landscape architectural services for the 301 Street aad Del Rosa Drive Street Improvement Project. DBA landscape archileCt. have been involved in numerous streetscape projects for local municipalities and therefore feel ideally suitt,d to a project of this nature. We have had the opportunity to visit the site with our project engineers and recommend the following project approach. DBA landscape architects will utilize the existing base maps provided by our civil engineers to create 20 scale plans for Del Rosa Drive only. It is our professional opinion that improvements within the right-of-way along 3r' Street cou ld be handled with construction notes for clarification regarding the necessary modifications to any existing irrigation systems. Likewise, general nOles will provide the required information for planting areas where existing turf or planted areas need to be returned to "like new" conditions. There does not appear to be an opportunity to provide new plantings along 301 Street; allhough, should you like us to perform additional services within this corridor, we can jllovidc you with a revised proposal. The existing trees along Del Rosa Drive (including the palm trecs and heritoge Oak trees) shall he prOleeted in place during the construction elf the new curb & gutter. and the meandering sidewalk. DBA land.cape architect. shall provide planting and in'i~ation plans for the limits of new work including the west side of Del Rosa Drive from 3'd Street to Townsend Drive (approximately 800 linear feet). The existing irrigation system will be replaced and may necessitattr the placemenl of a new waler meter with backflow prevention, in addition to a new automatic controller. The plallling plan will indicalC lhe placement of all proposed plant material including the introduction of hardscape materials such as decorative rock cobble under the Oak trees. This application would be attmctive lIlld appropriate given the desire to Ii mil the use of exccssive water in and around the Oak tree.~. We would recommend the use of .~round covers and low / medium height sluubs - nO turf is anticipated at this time. Technical specifications, construction detoils, and cost estimates shall also be provided for bidding purposes. DEA shall include these drawings within lhe overall bid package.
