2 RESOLUTION AUTHORIZING THE MAYOR OF THE CITY OF SAN
BERNARDINO OR HER DESIGNEE TO EXECUTE AN AGREEMENT WITH

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor of the City of San Bernardino or her designee is hereby
authorized and directed to execute on behalf of the City an agreement with UJIMA/CalWorks
relating to training related work sites for UJIMA/Cal Works participants, a copy of which is
hereto marked as Exhibit" A," and incorporated herein by reference as fully as though set forth
at length.
SECTION 2. The authorization granted hereunder shall expire and be void and of no
further effect if the agreement is not executed by both parties and returned to the Office of the City
Clerk within 60 days following the effective date of the Resolution.

COOPERATIVE WORKSITE AGREEMENT BETWEEN
UJIMA/Cal Works
AND
CITY OF SAN BERNARDINO PARKS, RECREATION & COMMUNITY SERVICES
I. PARTIES INVOLVED
This Agreement is between the City of San Bernardino Parks, Recreation and Community
Services Department and UJIMA/Cal Works.
It is agreed and understood by both parties that the City of San Bernardino Parks, Recreation and
Community Services Department will provide work sites for the participants in the UJIMA/Cal
Works Program.
The number of participants and work period will be determined by agreement of the Parks,
Recreation and Community Services Department and the UJIMA/Cal Works.
II. FURTHER AGREED
That the Parks, Recreation and Community Services Department will provide useful, work site
training experiences consistent with the participants' capabilities.
The Parks, Recreation and Community Services Department will provide supervisIOn and
direction to the participating youth.
There shall be no reimbursement or compensation on the part of the Parks, Recreation and
Community Services Department, either in wages or benefits of any kind. Workers
Compensation payments shall be the responsibility of the UJIMA/Cal Works through the State
Compensation Insurance Fund (SCIF). The City shall not assume any administrative cost of
program sponsorship except those incurred by itself in providing for planning, monitoring or
supervIsion.
III. PROGRAM COMPONENTS
Accurate time and attendance records will be kept in conjunction with the supervising staff
provided by the UJIMA/Cal Works. The work areas for each participant will be selected by the
Parks, Recreation and Community Services Department upon the contingent agreement of the
UJIMA/Cal Works.
Should a UJIMA/Cal Works participant display inappropriate behavior or fail to perform in a
satisfactory manner, the site supervisor or manager may excuse the participants from the
program. All participants must wear official recreation staff uniforms.

UJIMA/Cal Works agrees to be responsible for the financial reimbursement of the participants on
a BI-monthly basis included processing of time sheets and paychecks.
UJIMA/Cal Works agrees to respond as needed to emergencies or site meetings as requested by the
Parks, Recreation and Community Services Department.
IV. HOLD HARMLESS
UJIMA Cal/Works shall defend, indemnify and hold City, its officers, officials, attorneys, agents
and employees harmless from and against any and all liability, loss, expense (including reasonable
attorney fees) or claims for injury or damages arising out of the performance of this agreement but
only in proportion to and to the extent such liability, loss, expense, attorney's fees or claims for
injury or damages were caused by or resulted from the negligence or intentional acts or omissions
ofUJlMA/Cal Works, its officials, agents or employees. The costs, salary and expenses of the City
Attorney and members of his office in enforcing this Agreement on behalf of the City shall be
considered as "attorney's fees" for the purposes of this paragraph.
City shall defend, indemnify and hold UJIMA/Cal Works and its officers, agents and employees
harmless from and against any and all liability , loss expense (including reasonable attorney fees) or
claims for injury or damages arising out of the performance of this agreement but only in proportion
to and to the extent such liability, loss, expense, attorney's fees or claims for injury or damages
caused by or resulted from the negligence or intentional acts or omissions of City, its officers, agents
or employees.
V. INSURANCE
UJIMA/Cal Works shall take out and maintain during the life ofthis Agreement such public liability
insurance as shall insure City, its elective and appointive boards, commissions, officers, officials,
attorneys, agents and employees, performing acts covered by this Agreement from claims for
damages for personal injury which may arise from UJIMA/Cal Works' officials, agents or
employees' operations herelmder. The amount and conditions of such insurance shall be as follows:
(a) Public Liability Insurance. In an amount not less than $1,000,000 for injuries, including, but
not limited to, death, to anyone person, in an amount not less than $100,000 on account of anyone
occurrence. The City its elective and appointive boards, commissions, officers, officials, attorneys,
agents and employees shall be named as additional insured. The Certificate of Insurance furnished
to the City shall require the insurer to notify the City in writing 10 days in advance of any change
or termination in the policy.

VI. TERMINATION CONDITIONS
Whenever it shall be necessary for either party to give notice to the other, such notices shall be sent
to the Director of Parks, Recreation and Community Services Department at the following address:
547 North Sierra Way, San Bernardino, CA 92410, and to UJIMA/Cal Works at the following
address: P.O. Box 1434, San Bernardino, CA 92401, and such notices shall be deemed to be received
five (5) days after.
This Agreement may be terminated at any time by either party giving fifteen (15) days written notice
of such action to the other party.
VII. WITNESS WHEREOF, the said parties hereunto set their hands and seal this day and year.

The San Bemardino Jobs and Employment Services Department (JESD) refers prospective participants to our
office for placement in the Community Service program. UJIMA/Cal Work does not fingerprint clients, nor do
we conduct any federal or local legal screening, however JESD will pay for participant fingerprinting. It is up to
your agency to screen volunteers for an appropriate volunteer position according to your agency's policies. The
clients are referrals to your agency, as such, you have the option to of accepting or not accepting clients on a
client-by-c1ient basis. Clients must be supervised at all times. (Please initial that you have read this statement)

to read english.
JESD/UJIMA-Cal WORKS Community Service partIcIpants Worker's Compensation benefits are provided
through the California Department of Social Services under a contract with the State Compensation Insurance
Fund (SCIF). All benefits are administered and authorized through the SCIF. Please initial that you have read this
statement.
UJIMA/ Cal Works agrees to the following:
. Recruit, interview and refer potential participants in person or by telephone.
. Provide host agency with name, telephone and all other information released by potential participant.
. Monitor Participant and Training Site for Compliance with IESD expectations.
. Provide technical assistance to host site.
By signing this agreement with UJIMA/Cal WORKS CSC, your agency agrees to the following:
. Comply with all federal policies and regulations regarding non-discrimination and accessibility.
. Provide job supervision for Community Service Participants.
. Maintain on a daily basis Time and Attendance Sheets to be submitted on a Monthly basis.
. Meet with UlIMA case managers once a month for Participant Monitoring.
. Report any problems with Community Service Participants directly to UJIMA Case managers.
. Maintain a safe working environment for all Community Service Participants.
