RESOLUTION NO. 20C2-98
WHEREAS, the City of San Bernardino and the City of Highland desire to initiate
proceedings pursuant to the Cortese-Knox-Hertzberg Local Governrnent Reorganization Act of
2000 for a Sphere of Influence arnendrnent between the City of San Bernardino (reduction) and
the City of Highland (expansion); an Annexation to the City of San Bernardino and detachrnent
frorn the City of San Bernardino; and an Annexation to the City of Highland and detachrnent
frorn the City of Highland, generally located along a portion of 3'd Street, between Tippecanoe
Avenue and a point approxirnately 232 feet east of Shirley Avenue and the area north of 3rd
Street between Del Rosa Avenue, Del Rosa Drive and Court Street; and
WHEREAS, the proposed boundary adjustment, including both public and private
property, to be included in this application to the Local Agency Formation Cornrnission of the
County of San Bernardino (LAFCO) is legally inhabited and a rnap of the boundaries is set forth
in Exhibit "A" and fully described in Exhibit "B", both attached hereto and rnade a part hereof;

WHEREAS, the proposed reorganization will not conflict with any sphere of influence
and the proposed change includes amendrnents to the spheres of influence for the Cities of San
Bernardino and the City of Highland; and
WHEREAS, it is desired that the proposed reorganization be subject to the following
terrns and conditions:

]. Both the City Councils of the City of San Bernardino and the City of Highland
rnust approve the proposed Sphere of Influence and Annexation! Detachrnent
proceedings.
2, The City of Highland shall process an amendrnent to its General Plan and pre-
zone the territory it is annexing to "Business Park Land Use Designation" and
"Business Park (BP) Zone District respectively. The arnendrnent and pre-zone
shall be cornpleted within 60 days of an application being subrnitted to
LAFCO.
3, The City of San Bernardino shall accept (annex) frorn the City of Highland
(detachrnent) the southerly 41.25 feet frorn the centerline of )'d Street for
rnaintenance, access perrnits and other governrnental responsibilities
associated with public right-of-way.
4. The City of Highland shall accept (annex) frorn the City of San Bernardino
(detachment) the area north of 3'd Street between Del Rosa Avenue and Del
Rosa Drive and the portions of the public right-of-ways of Court Street, Del
Rosa Avenue, and Del Rosa Drive. The City of Highland shall assurne all land
use authority and rnaintenance, access permits and other governrnental
responsibilities associated with the public right-of-ways of Court Street, Del
Rosa Avenue, and Del Rosa Drive,
5. The City of Highland shall cause the application to be filed with LAFCO to
include all filing fees and exhibits that rnay be necessary to cornplete the
application.

6, The City Councils of the City of San Bernardino and the City of Highland
shall both accept all standard conditions as required by LAFCQ,
WHEREAS, the reasons for this proposed boundary adjustrnent between the City of San
Bernardino and the City of Highland are as follows:
1, Assist property owners and public m understanding the jurisdictional
boundaries between the City of San Bernardino and the City of Highland.
2. Irnprove essential services such as street rnaintenance and repair, public safety,
and fire protection, knowing that the centerline of 3rd Street will be the
boundary between the two Cities and that the public right-of-ways of Court
Street, Del Rosa Avenue, and Del Rosa Drive will be fully within the
corporate boundary of the City of Highland,
3, Coordinate property developrnent standards and essential services such as
streets, police and fire protection, and land use irnplernentation m a rnore
defined corporate boundary between the two Cities.
4. Perrnit the City of San Bernardino to properly address the developrnent of the
San Bernardino International Airport by adequately reviewing access to 3rd

FACTORS OF CONSIDERA nON FOR
BOUNDARY ADJUSTMENT BETWEEN THE
CITIES OF HIGHLAND AND SAN BERNARDINO
Physical Factors in Favor of the Boundary Adjustment
The City of Highland presently surrounds the approximate three acres area of
developed property currently within the corporate boundaries of the City of San
Bernardino. The area is essentially an "island" surrounded by the City of
Highland and is developed with a variety of land uses of commercial, light
industrial and nonconforming residential units. The San Bernardino City land
use designation of the area is CG1 (Commercial General) which will not
significantly change if the area is annexed to the City of Highland.
With regards to 3rd Street, the majority of the public right-of-way is within the
corporate boundary of the City of Highland, The boundary adjustment between
the two Cities will also include the adjustment of the two Cities' boundary to be
the centerline of 3rd Street. The new boundary will permit each City to maintain
access control to property within its corporate boundary. In addition, half of Del
Rosa Avenue, Del Rosa Drive, and Court Street will be detached from the City
San Bernardino and annexed to the City of Highland.
Present and Planned Uses in the Area
The land uses of the area to be detached from the City of San Bernardino and
annexed to the City of Highland consists of a mix of commercial, light industrial,
and nonconforming residential uses, The City of Highland intends to pre-zone
the area to compliment the land use district Commercial General of the City of
San Bernardino encompassing the private andlor developable parcels.
The 3rd Street public right of way will remain as is, The City of San Bernardino
will install andlor construct improvements to accommodate the development of
industrial projects on the southerly side of 3rd Street as necessary,
Capacity/Adequacy of Public Facilities and Public Services
The area will not require the extension of any public facilities (i.e" water, sewer,
streets, etc,) to accommodate the existing land uses. If in the future the property
owners submit an application to improve/develop their property, the appropriate
analysis will be conducted to determine the adequacy of such facilities.
Water Service - Water service is presently provided by a East Valley Water
District (formally East San Bernardino County Water District). The service will
not change as a result of this boundary adjustment between the two Cities,

Sewaae Services - Sewage disposal services are currently being provided by
one of two ways. First, some of the lots are being served by public sewers, East
Valley Water District serves as the sewer purveyor and as property owners
request a connection to the public facility the District will determine the feasibility
and do the necessary work,
Secondly, many of the properties of the area are on private disposal systems
(Le., septic tank, leach line, etc,), If the property owner in the future request a
connection to the existing sewer line, the District will be directly involved with the
planning and installation of the connection. In either case, the City of Highland
does not foresee any additional public facility andlor service required as part of
this boundary adjustment between the two Cities.
Fire Service - Fire services are presently provided by the City of San Bernardino
Fire Department for the private land area and by the City of Highland's fire
service contractor, the California Department of Forestry, for incidents that may
occur on 3rd Street. However, both Cities have mutual aid agreements and
assist each other when the need arises, especially when the corporate boundary
is the area of the incident. A positive impact of the change in boundary is that
the service provider for the properties along the northerly side of 3rd Street will be
just the City of Highland and not two cities as presently exists,
Law Enforcement Services - Law enforcement services for the City of San
Bernardino and City of Highland are provided by the City of San Bernardino
Police Department and Highland's service contract provider, the San Bernardino
County Sheriff's Department, respectfully, The boundary adjustment between
the two Cities will change only slightly with each jurisdiction increasing and
decreasing service area, The continuity of services along the northerly boundary
will be of a benefit to the property owners in that one law enforcement service
will assume responsibility of the entire area. The factor can also be attributed to
the public right-of-way exchange between the two Cities.
Road Maintenance Service - Road maintenance services will change in that the
City of San Bernardino will incur costs for maintenance of the southerly half of 3rd
Street. This increased area to San Bernardino is offset by the City of Highland's
increased area of maintenance of half of Del Rosa Avenue, Del Rosa Drive and
Court Street. However such increased maintenance is minor and subordinate to
the enhanced benefit of service to each city and more particularly to the City of
San Bernardino to control the access to those properties that front 3rd Street.

Land Use Services - Land use services such as planning, building and code
enforcement will transfer to the City of Highland, Many of the properties are in a
state of disrepair and some of the land uses are nonconforming. The effort to
maintain health and safety conditions will be that of the City of Highland, A
significant benefit will be the consistency of land use regulations, codes, and
enforcement. Presently, the area has a mix of regulatory agencies overseeing
land use issues which may cause land uses and standards to be at odds.
Existing and Proposed Redevelopment Areas, Improvement Zones, and
Infrastructure Financing Districts
The proposed boundary adjustment will not impact any existing improvement
zone, redevelopment area, assessment district, or community facilities district.
The boundary adjustment will affect the tax increment financing incumbence the
property for the Inland Valley Development Agency. The transfer of the
financing mechanism from the City of San Bernardino to the City of Highland will
be required,

The Voter Location List is submitted in compliance with requirements for preparing notices to registered voters
and for filing proposals with the Local Agency Formation Commission, San Bernardino County. This information
will assist the Registrar of Voters in determining the number and location of voters residing within the area
proposed for change.
Information to be provided shall furnish the beginning and ending house numbers on those streets crossing the
exterior boundaries of the proposal. Do not list those streets wholly within the proposal area.
The County Land Use Services Department, Code Enforcement Division, can aid proponents in obtaining or
assigning house numbers to vacant lots or parcels in unincorporated areas. Please call (909) 387-4171 (parcel
numbers are required). For city house numbers, please contact the respective cities, If no numbering system is
