RESOLUTION NO. 20C2-94
RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING AND
3 DIRECTING EXECUTION OF A GRANT OF EASEMENT DOCUMENT FOR
VERIZON CALIFORNIA, INC. ACROSS CITY-OWNED PROPERTY LOCATED AT
4 MOUNT VERNON AVENUE, NORTH OF 10TH STREET.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:
SECTION 1. That the Mayor and Common Council of the City of San Bernardino is
hereby authorized and directed to execute, on behalf of said City, a Grant of Easement document

to Verizon California, Inc., relating to certain City-owned real property located on the west side

of Mount Vernon Avenue, North of loth Street, a copy of which is attached hereto as Exhibit
"A".

GRANT OF EASEMENT
THE GRANTOR, CITY OF SAN BERNARDINO, a municipal corporation, hereby grants to VERIZON CALIFORNIA
INC., a corporation, hereinafter referred to as GRANTEE, its successors and assigns, a non-exclusive easement and
right-of-way for the purposes of constructing, using, maintaining, operating, altering, adding to, repairing, replacing,
reconstructing, inspecting andlor removing its facilities, consisting of but not limited to: cables, wires, amplifiers,
underground conduits, manholes, hand holes, pedestals, above and below ground vaults and enclosures, concrete
pads, markers and other appurtenances, fixtures and/or facilities (hereinafter sometimes coilectively cailed
"equipment") necessary or useful for the transmission of electric energy for communications, telecommunications,
interactive video, inteiligence by electrical means andlor other purposes on, over, in, under, across and along that
certain real property situated in the City of San Bernardino, County of San Bernardino, State of California, described as
foilows:
The Southerly 4.00 feet of Lot 3 in Frank C. Platts Mt. Vernon Subdivision Tract 1705, as per Map filed in Book 25,
Page 28, inclusive of Maps, in the Office of the County Recorder of said San Bernardino County.
This legal description was prepared by Verizon California Inc., pursuant to Section 8730(c) of the Business and
Professions Code.
THE GRANTEE, its successors and assigns and their respective agents and employees, shail have the right of ingress
to and egress from said easement and every part thereof, at ail times, for the purpose of exercising the rights herein
granted and shail have the right to remove such growth as may endanger or interfere with the use of said easement.
Such rights shall be reasonably exercised and the Grantee shail be liable for any and ail damages sustained, including
but not limited to, personal injury and real property damage, as a result of Grantee's actions to and on the above-
described property.
