HomeMy WebLinkAbout2003-345 ~ 1 RESOLUTION NO, 2003-345 2 RESOLUTION OF THE CITY OF SAN BERNARDINO ACCEPTING FAIR 3 MARKET VALUE FOR A PORTION OF CERTAIN REAL PROPERTY, LOCATED NORTHEASTERLY OF CAJON BOULEVARD AT UNIVERSITY PARKWAY, 4 KNOWN AS ASSESSOR'S PARCEL NUMBERS 0148-011-06 & 40 AND 0266-073-02, 04, 05 & 09, TO BE ACQUIRED BY SAN BERNARDINO ASSOCIATED GOVERNMENTS 5 OF SAN BERNARDINO COUNTY FOR THE CITY OF SAN BERNARDINO 6 RELATIVE TO A PROPOSED GRADE SEPARATION, 7 WHEREAS, the San Bernardino County Associated Governments of San Bernardino 8 County (SAN BAG) is proposing to acquire a portion of certain real property located at 9 northeasterly of Cajon Boulevard at University Parkway in the City of San Bernardino, known as 10 Assessor's Parcel Numbers 0148-011-06 & 40, 0266-073-02,04,05, & 09, for the City of San 11 Bernardino for the purpose of constructing a grade separation across the Burlington Northern 12 Santa Fe (BNSF) railroad tracks lying northerly of and parallel with said Cajon Boulevard; and 13 14 15 16 17 18 19 20 21 22 23 24 WHEREAS, said property is owned by Culligan Zelite Company, a Delaware corporation; and WHEREAS, the interest to be acquired by SAN BAG across said real property for the City of San Bernardino consists of street and highway easements and appurtenant slope easements, and WHEREAS, upon completion of the construction of said grade separation, said property and right of way improvements will be conveyed to the City of San Bernardino; and WHEREAS, upon completion of the construction of said grade separation and appurtenant improvement and acceptance by the City of San Bernardino, said City will assume all maintenance responsibilities of said property and improvements; and 25 26 SANBAG for the purpose of determining the fair market value of the property to be acquired, 27 WHEREAS, an appraisal was prepared by the County of San Bernardino for use by 28 12/03/2003 2003-345 ~ RESOLUTION OF THE CITY OF SAN BERNARDINO ACCEPTING FAIR MARKET VALUE FOR A PORTION OF CERTAIN REAL PROPERTY, LOCATED NORTHEASTERLY OF CAJON 2 BOULEVARD AT UNIVERSITY PARKWAY, KNOWN AS ASSESSOR'S PARCEL NUMBERS 0148-011- 06 & 40 AND 0266-073-02, 04, 05 & 09, TO BE ACQUIRED BY SAN BERNARDINO ASSOCIA TED GOVERNMENTS OF SAN BERNARDINO COUNTY FOR THE CITY OF SAN BERNARDINO 3 RELATIVE TO A PROPOSED GRADE SEPARATION. 4 5 6 7 1 dated June 25, 2003 and amended September 12,2003, a copy of which is on file in the office of the City Engineer of the City of San Bernardino. WHEREAS, the fair market value of said property to be acquired is set forth in the 8 amount of Three Hundred Ninety-seven Thousand Dollars ($397,000) in said appraisal; and 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, City stafT have reviewed the appraiser's determination of the fair market value of the land and his report thereon and concur with said determination; and WHEREAS, full description of the property to be acquired is set forth within said appraisal report. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1.
