RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO ELECTING THE STATUTORY PASS-
THROUGH PURSUANT TO HEALTH AND SAFETY CODE SECTION
33607.7(b) FOR THE UPTOWN REDEVELOPMENT PROJECT AREA

WHEREAS, Redevelopment Agency of the City of San Bernardino ("Agency") has an
7
approved Redevelopment Plan for the Uptown Redevelopment Project (the "Plan"), which
8
provides for tax increment ("Tax Increment") financing pursuant to Section 33670 of the
9
California Community Redevelopment Law, Health and Safety Code Section 33000 et. seq.
10
("CRL"); and
11
WHEREAS, concurrently with the adoption ofthis Resolution the Mayor and Common
12
Council of the City of San Bernardino have introduced and given a first reading to an
13
ordinance entitled "An Ordinance of the City of San Bernardino Eliminating the Debt
14
Incurrence Deadline for the Redevelopment Plan for the Uptown Redevelopment Project
15
Area;" and
16
WHEREAS, the City of San Bernardino ("City") is the community which adopted the
17
Plan and by virtue of the passage of the ordinance referenced in the preceding paragraph, the
18
Mayor and Common Council is authorized to make election described in the Section
19
33607.7(b) of the CRL with respect to the Plan as amended by such ordinance; and
20
WHEREAS, the Mayor and Common Council hereby elect to be paid the amounts sets
21
forth in the Section 33607. 7(b) of the CRL as a statutory pass-through payment from the
22
Agency for each fiscal year the Agency collects Tax Increment pursuant to the Plan; and
23
WHEREAS, it the policy intent of the Mayor and Common Council that the arnount
24
received as a statutory pass-through payment each fiscal year by the City will be appropriated
25
for programs and activities that benefit the Uptown Redevelopment Project Area and support
the redevelopment program, as determined in the annual City budgeting process.

NOW, THEREFORE, IT IS HEREBY RESOLVED, DETERMINED AND ORDERED
2 BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, AS
3 FOLLOWS:

Section 1.
Subject to the ordinance referenced in the recitals of this Resolution
5 taking effect, the Mayor and Common Council hereby elect to be paid the statutory pass-
6 through payments from the Agency for each fiscal year the Agency collects the Tax Increment
7 pursuant to the Plan.

Section 2.
The Mayor and Common Council hereby authorize and direct the City
9 Administrator to transmit copies of this Resolution to the Agency and to take all other actions
10 required pursuant to Section 33607.7(b) to implement the election set forth in this Resolution.

Section 3.
This Resolution shall take effect upon its adoption and execution in the

manner as required by the City Charter.
