RESOLUTION OF THE CITY OF SAN BERNARDINO ELECTING TO CEASE TO
BE SUBJECT TO THE PUBLIC EMPLOYEES' MEDICAL AND HOSPITAL CARE ACT
FOR THE CITY OF SAN BERNARDINO EMPLOYEES IN THE POLICE SAFETY UNIT

WHEREAS, Government Code Section 22853 provides that a contracting agency which
5
has elected to be subject to the Public Ernployees' Medical and Hospital Care Act (hereinafter
6
"Act") may cease to be so subject by proper application by the contracting agency; and
7
WHEREAS, the City of San Bernardino (hereinafter "Contracting Agency") is a
8
contracting agency under the Act for participation by members of the Police Safety Unit.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:

SECTION 1. That the Police Safety Unit members of the Contracting Agency elect, and

the Contracting Agency does hereby elect, to cease to be subject to the provisions of the Act.
13
SECTION 2. That coverage of the Act cease on December 31,2003.
14
SECTION 3. That Title 2, Section 599.515 (e), ofthe California Administrative Code
15
prohibits the Contracting Agency from filing with the Board of Administration of the Public
16
Employees' Retirement Systern a new resolution electing to be subject to the Act within two
17
years of termination date.
