BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That the Mayor and Common Council of the City of San Bernardino authorize the Purchasing Manager to execute an agreement between the City of San Bernardino and the County of San Bernardino, in an amount not to exceed $ 11,526.72, for equipment and user access, into the National Law Enforcement Telecommunication System (NLETS) and the California Law Enforcement Telecommunication System (CLETS), a copy of which is attached hereto marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length. SECTION 2. That the Mayor and Common Council of the City of San Bernardino authorize the Purchasing Manager to execute an agreement between the City of San Bernardino and the County of San Bernardino, in an amount not to exceed $18,492.00, for equipment and user access into the Sheriff's Central Name Index (CNI), a copy of which is attached hereto marked Exhibit "B" and incorporated herein by reference as fully as though set forth at length. SECTION 3. RECOMMENDATION: Approve First Amendment to Contract No. 02-746 with the City of San Bemardino for access to CLETS and maintenance of related equipment in the amount of $11,526.72 to update contract for costs for the period of July 1, 2003 through June 30, 2004. BACKGROUND INFORMATION: By State mandate, the Sheriff's Department oversees the local switching center that allows access by local law enforcement agencies to the California Law Enforcement Telecommunications System (CLETS), a state-wide criminal justice database. In turn the Department contracts with these agencies to spread the cost of the system among the agencies using the system. On July 16, 2002, the Board of Supervisors approved Contract No. 02-746 to provide CLETS access to the City of San Bernardino. The contract is amended annually to revise the fee schedule to ensure proper cost recovery to the County. The rates for CLETS service are established based upon the actual cost charged to the Sheriff's Department by third parties, either County ISD or outside vendors, for this service. One component of the rates is a fee for each transaction. The number of transactions used as a basis for the current rate is based upon the actual number of transactions for the prior fiscal year. This contract amendment, in the amount of $11 ,526.72, is for the period of July 1, 2003 through June 30, 2004. The 2003-04 cost of service represents an increase of $1,784.64, due to an increase in the number of transactions processed by the City. This contract amendment was received from the City on July 17, 2003 and July 22nd is the first available Board date for approval after completion of the review process. REVIEW BY OTHERS: This item has been reviewed and approved as to legal form by County Counsel (Kevin Norris, Deputy County Counsel) on April 25, 2003; and reviewed by the County Administrative Office (Mario Lara, Administrative Analyst) on July 18, 2003. FINANCIAL IMPACT: Revenue generated by this contract, in the amount of $11,526.72, fully offsets the cost of providing this service and is included in the Sheriff's Department Budget for 2003-04. No additional cost to the County. ISD will act as teleprocessing network service manager and the COUNTY will offer two types of network services to the CONTRACTOR as detailed on the Teleprocessing Network Services "Exhibit A" attached hereto and incorporated herein by reference. Paragraph 7, subsection b) is hereby amended to read as follows: Page 1 of 2 2003-148 b) Class B - COUNTY provides data circuit and modems, and specific data communication support devices of problem isolation and resolution from COUNTY's Central Computer or County Wide Area Network (WAN) to the last component of lSD-supplied equipment (usually the modem on the end of the circuit for non-WAN connections or router for WAN connections). The CONTRACTOR is responsible for the coordination of all problem isolation and resolution involving equipment and software not supplied by ISD. Charges for Class B services shall be two network units at the standard ISD network rate at each CONTRACTOR location. Teleprocessing equipment additions are subject to ISD review and approval as COUNTY Central Computer compatible devices. Each request to add equipment for teleprocessing services will be evaluated independently, depending upon specific circumstances of each CONTRACTOR location and ability of COUNTY to provide additional services. 3. Replace Schedule "A" attached thereto, referred to in Paragraph 8, with Schedule "A" attached hereto and incorporated herein by reference. Deputy Reviewed by Contract Compliance ~ Date S:-lJ..-o7 Date Page 2 of 2 2003-148 EXHIBIT "A" TELEPROCESSING NETWORK SERVICES SELECTION CITY OF SAN BERNARDINO CLASS "A" SERVICE - COUNTY EQUIPMENT The County's Information Services Department (ISO) will provide complete coordination 1 of data communication installation, problem isolation, and resolution from the County Central Computer to the Customer workstation. This does not include customer-owned printers of any type. ISO will coordinate a pre-installation site survey identifying all necessary pre-installation site requirements. In the case of county departments, this will also include the ordering of cabling, data circuits, modems, and electrical power. In the case of non-county customers, this service will be limited to the definition or pre-installation site requirements and the ordering of the data communications circuits and modems. CLASS "8" SERVICE - CUSTOMER EQUIPMENT The County's Information Service Department (ISO) will provide coordination2 for data communications problems including problem isolation and resolution from the County Central Computer or County Wide Area Network (WAN) to the last component of ISO-supplied equipment (usually the modem on the end of a data circuit for non-WAN connections or router for W AN connections). The customer is responsible for the coordination of the isolation and resolution of all problems involving hardware and software not supplied by ISO. Specifically excluded from ISO support are customer-supplied distribution processors, printers, display stations, PCs, Local Area Network (LAN) switches: all customer cabling such as terminal distribution cables (coax, twin- ax, twisted pair, etc.) modem interface cables; all customer supplied jacks, switches, and splitters; distributed software, including mini-based, micro-based, and PC desktop software; and, all consumables such as printer ribbons and paper. ISO will coordinate a pre-installation site survey identifying all necessary pre-installation site requirements. This service will be limited to the definition of those requirements and the ordering of the data communications or WAN circuits, modems, and WAN equipment (routers and etc). The customer will be responsible for making all site preparations prior to the installation of data communications or WAN service. 1 Complete coordination includes all involved hardware, software, (both host-based and distributed), all data circuits, modems, the reporting, tracking, diagnosing, and directing of all necessary vendors to restore full equipment operations and normal data communications in a timely manner. 2 Coordination includes working with all necessary vendors in an effort to restore normal data communications in a timely manner. BACKGROUND INFORMATION: The County provides teleprocessing services to various cities throughout the County in order to promote effective regional law enforcement through the cooperative use and maintenance of the County's computerized law enforcement data files. The rates for Central Name Index service are established based upon the actual cost charged to the Sheriff's Department by the County Information Services Department for this service. On July 16, 2002, the Board of Supervisors approved Contract No. 02-744 to provide access to the County's computerized law enforcement data files and maintenance of related equipment to the City of San Bernardino. This contract is amended annually to revise the fee schedule to ensure proper cost recovery to the County. This amendment, in the amount of $18,492, is for the period of July 1, 2003 through June 30, 2004, and results in a reduction of $7,932 compared to similar period for prior year due to County lSD's decrease in billing rate per hour combined with a significant decrease in the number of transactions processed by the City. This contract amendment was received from the City of San Bernardino on July 17, 2003 and July 29th is the first available Board date for approval after completion of the review process. REVIEW BY OTHERS: This item has been reviewed and approved as to form by County Counsel (Kevin L Norris, Deputy County Counsel) on June 27, 2003, and has been reviewed by the County Administrative Office (Mario Lara, Administrative Analyst) on July 18, 2003.
