A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO APPROVING THE PROPOSED SECTION
108 LOAN GUARANTEE APPLICATION FOR THE FOCUSED
NEIGHBORHOOD REVITALIZATION PROGRAM AND
AUTHORIZING AND APPROVING THE SUBMITTAL OF THE FINAL
APPLICATION TO THE U.S. DEPARTMENT OF HOUSING AND
URBAN DEVELOPMENT (HUD) AND FOR PUBLIC DISTRIBUTION

WHEREAS, the City of San Bernardino ("City") has determined that a high priority
exists to redevelop declining and blighted residential and commercial properties located within
9
10
certain geographic parts of the City ("Focused Neighborhood Revitalization Areas") (see
Exhibits "A" and "A-I") attached to the Staff Report of even date herewith) and that in order to
11
stimulate reinvestment in the Focused Neighborhood Revitalization Areas, it is necessary for the
12
City to implement certain activities to change the undesirable conditions existing within these
13
areas, such as acquisition of underutilized residential or commercial properties and the
14
redevelopment of such sites, demolition, removal or clearance of blighted structures; assistance
in the possible relocation of effected businesses or residents and the provision of public
15
16
improvements (the "Project"); and
17
WHEREAS, the proposed Project is included in the City's 2003/2004 Annual Action
Plan of the City's Consolidated Plan; and
WHEREAS, the implementation of the Project will assist the City in meeting two of the
18

national objectives: (I) benefiting low- and moderate-income persons and (2) addressing slums
21
or blight; and
WHEREAS, the Section 108 Loan Guarantee Program, implemented by the United
States Department of Housing and Urban Development ("HUD") is designed to provide funds
22

to assist with this type of Project; and

WHEREAS, under the Section 108 Loan Guarantee Program, the City can borrow up to
five years worth of its annual Community Development Block Grant (CDBG) allocation, and

can repay said borrowing within twenty years; and
4
WHEREAS, the City is requesting $10 million from Section 108 Loan Guarantee
Program (the "Loan") to assist with the implementation of the Project and will pledge its yearly
5
6
CDBG allocation from HUD to pay the principle and interest on said Loan for a period of
7
twenty (20) years;
and
8
WHEREAS, the Mayor of the City and the Executive Director of the Economic
9
Development Agency, the administrator of the CDBG Program, are authorized to submit the
10
$10 million Section 108 Loan Guarantee application, and any amendments thereto and all
11
understandings, assurances and guarantees contained therein, and to act in connection with the
application to provide such additional information as may be required by HUD,
12

NOW, THEREFORE, IT IS HEREBY RESOLVED, DETERMINED AND ORDERED
BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, AS
FOLLOWS:

Section 1.
The City hereby certifies and assures with respect to its application for a
16
Loan guarantee pursuant to Section 108 of the Housing and Community Development Act of
17
1974 (ACT), as amended, that it possesses the legal authority to make the pledge of CDBG
grants to repay said loan required under 24 CFR 570,705 (b)(2),

Section 2,
As prerequisites for submission of the application to HUD, the City
20
certifies that it has: (a) furnished citizens with information required by Section 570,704 (a) (2)
(i) of Title I of the ACT, as amended; (b) held at least one public hearing or meetings, February
19,2003, April 21, 2003, May 13,2003, and June 2, 2003, to obtain the views of citizens on

community development and housing needs; and (c) prepared its application in accordance
24
with Section 570,704 (a) (1 (iv) of Title I of the ACT, as amended, and made the application
25
available to the public,

Section 3,
The City has and will continue to follow a detailed citizen participation
2 plan that meets the requirements described in Section 570,704 (a) (2) of Title I of the ACT,

Section 4,
The City has and will continue to affirmatively further fair housing, and
4
the guaranteed loan funds will be administered in compliance with the Title VI of the Civil
5
Rights Act of 1964 (42 U,S,C, 2000d et. seq,) and the Fair Housing Act (42 U,S,C, 3601-3619)
6
and the City will expend in the aggregate, at least 70 percent of all CDBG funds, as defined in
Section 570.3 of the ACT during the term of the Consolidated Plan, specifically to insure the

City carries out activities for the benefit of low and moderate income persons, as described in
9
Section 570,208 (a) ofthe ACT,
Section 5,
The City has and will continue to comply with the requirements
10

governing displacement, relocation, real property acquisition, and the replacement of low- and
moderate-income housing described in Section 570,606,
12
Section 6,
The City has and will continue to certifY regarding debarment,
13
suspension, and other responsibility in accordance with the provisions ofthe ACT,
14
Section 7,
The City has and will continue to comply with other provisions of the
15
ACT and with other applicable laws,
16
Section 8,
The City hereby assures and certifies with respect to its application for a
17
loan guarantee pursuant to Section 108 of the ACT, as amended, that it has made efforts to
obtaining financing for the Project described herein without the use of such guarantee, that it
will maintain documentation of such efforts for the term of the Loan guarantee, and that it
cannot complete such financing consistent with the timely execution of the Project plans

without such guarantee,

Section 9,
The City will continue to maintain a drug-free workplace as provided
23 under 24 CFR Part 24 (Appendix C) of the ACT,

Section 10, The City has and will continue to certify, to the best of its knowledge and
belief the following anti-lobbying statement required under 24 CFR Part 87 (Appendix A) that:
(a) No federal appropriated funds have been paid or will be paid by or on behalf of it, to any

person for influencing or attempting to influence an officer or employee of any agency, a
Member of Congress, an officer or employee of Congress, or any employee of any member of
5
6
Congress in connection with the awarding of any grant, loan or cooperative agreement, it will
7
complete and submit Standard Form LLL "Disclosure Form to Report Lobbying," in
accordance with its instructions; and (b) it will require that the language of this paragraph (a) of
8
9
this certification be included in the award documents for all subawards at all tiers (including
10
subcontracts, subgrants, and contracts under grants, loans and cooperative agreements) and that
11
all subrecipients shall certify and disclose accordingly,

Section II, The Mayor and Common Council hereby find and determine that the
facts and circumstances set forth in the Recitals hereof are true and correct in all respects, The
13

Mayor and Common Council acknowledge that the Staff report together with the accompanied
Focus Neighborhood Revitalization Map (Exhibits "A" and "A-I") depicting the target areas

and Exhibits "B" and "B-1" are correct and in accordance with the direction provided to Staff at
16
the Mayor and Common Council workshop of May \3,2003,
Section 12, The Mayor and Common Council hereby authorize the Mayor and the
17

Executive Director of the Economic Development Agency to submit the Section 108 Loan
Guarantee Application consistent with the actions of the Mayor and Common Council at this
public hearing of June 2, 2003, and to execute such documents as may be required in order to
submit and implement the application and issue debt obligations pursuant to the requirements

Section \3, This Resolution shall take effect upon its adoption and execution in the
24 manner as required by the City Charter.

SUBJECT: SECTION 108 LOAN APPLICATON FOR THE CITY OF SAN
BERNARDINO'S "FOCUSED NEIGHBORHOOD REVITALIZATION
PROGRAM ( THE "PROJECT")
1. Public Review Process:
The rules and regulations published by HUD provide that there be a public process prior to filing
a final application for HUD 108 guarantee assistance, This public review has been facilitated in
the following ways" First the proposed action to submit an application has been advertised as
described above and, the HUD Section 108 Loan guarantee was reviewed and discussed with the
Community Development Citizen Advisory Committee on February 19, 2003, and a Mayor and
Common Council public hearing held on April 21, 2003, a Mayor and Common Council public
workshop, held on May 13, 2003, and another public hearing was held on June 2, 2003 by the
Mayor and Common Council. Generally, there was a consensus from those present that the City
of San Bernardino should proceed to file a final application for the Section 108 Program in the
amount of$1O million for the proposed Project noted prior to June 30, 2003,
2. Authorization Procedure:
After the close of today's public hearing, the Mayor and Common council should consider any
comments and views received, and if appropriate, modify the proposed application, To file the
application, the City must certify that it possesses the legal authority to pledge its future CDBG
grant funds as required under section 570,705, (B)(2) Of Title 24, Standard certifications
regarding drug-free workplace, debarment and suspension of contractors, and an anti-lobbying
statement are also requirements of the application submittal. The City must certify that it
possesses the legal authority to submit the application and to use the funds, It must take action to
authorize an official representative of the City to submit the application and amendments thereto,
All of these matters are addressed in the Resolution attached to the Staff Report,
3. Proiect Name and Location:
The City of San Bernardino "Focused Neighborhood Revitalization Program" will be undertaken
in the following areas:
Area A: Old Towne - located between "E" Street to 1215, 6th to 9th Streets,
Area B: Meadowbrook -located between Sierra Way &Waterman Avenue, Rialto and
3 rd Street.
Area C: Secombe Lake - located between 6th & 4th Streets, Waterman Avenue to
Sierra Way,
Area D: North Lake -located between E Street to 1215, 9th Street to Baseline Rd,
Area E: Arden-Guthrie Soccer Complex - located between Sterling to Victoria
Avenue, Highland Ave, to Pacific St.

Area G:
Westside -located between Highland Avenue to Baseline, Mt. Vernon to
West of Macy Street to the City boundary,
Area H:
40th St. Redevelopment Project Area - located between Waterman & Mt.
View Avenues, and 44th St. to Ralston Avenue,
Areas A through H are all located within the City of San Bernardino's boundaries,
4. Proiect Description:
The activities proposed to be undertaken in Target Area A through H include land acquisition,
site assemblage, disposition, relocation of any residential or businesses, demolition or clearance
of blighted and dilapidated structures, and the construction or provision of public improvements
such as streets, curbs, gutters, sidewalks, sewers, storm drains, etc, ("Project"), The Project will
specifically address the removal of blighted structures, the provision of decent and safe housing,
new or up-graded infrastructure, acquisition of underutilized and blighted properties which will
be used for development of either new housing or commerciallretail development. It is expected
that the Project will act as a stimulus, create synergism and promote new development resulting
in employment and homeowner opportunitities for City residents and private reinvestment.
Accordingly, the Section 108 Loan funds will be used for eligible activities noted in 24 CFR
subpart M, 570,703 ofHUD Regulations:
a, Acquisition of improved or unimproved real property, including acquisition for
economic development purposes;
b, Relocation Assistance to displaced businesses, families, individuals, or others
who must relocate permanently or temporarily as a result of an activity financed
with the Section 108 Loan funds;
c, Clearance, demolition and removal;
d, Site preparation, including construction, reconstruction or installation of public
and other site improvements,
5. Loan Request Amount:
The City of San Bernardino is requesting Section 108 financing in the amount of $1 0 million for
a term of 20 years, These funds will be used to fund the various activities noted under Project
Description and within the Locations noted in 3 above, The City will repay said loan amount by
pledging its annual Community Development Block Grant (CDBG) allocation and in accordance
with the attached amortization schedule,
6. Elll!:ible Activitv and National Obiectives:
The proposed Project meets two of the Community Development Block Grant (CDBG) national
objectives as stipulated in the CDBG regulations, 24 CFR 208, These activities aid in the
prevention or elimination of slums and blight; and benefit low- and moderate-income persons,
Many of the target areas are located within existing redevelopment project boundaries and by
State law the City has established by Ordinance that blight exist in the target areas, Much of the
target areas exhibit deteriorated buildings, deferred maintenance, old and obsolete structures and
public improvements, and show evidence of physical, economic and social blight. These
conditions hinder or impede progress for new development and act as an economic drain to the

City, Undertaking the activities under the Project Description will help alleviate or remediate
these blighting influences leading to improved economic and physical conditions,
7. Prol!ram Income:
The Project is not expected to produce a significant amount of Program Income, However, when
the City or Agency acquires real property and subsequently disposes of such property, it may
realize market value for the property, In such case, any sales proceeds generated from the
disposition of property will become program income and will be allocated to the HUD 108
repayment debt.
8. Loan Security (Collateral):
Under Section 570,705 (B)(2) the City will repay the Section 108 financing yearly from its
Community Development Block Grant (CDBG) Program, Additionally, the City will pledge
redevelopment funds from the Redevelopment Agency of the City of San Bernardino who will
act as a guarantor in the Section 108 Loan Application, Moreover, if and when the City or the
Agency acquires property using the Section 108 Loan Proceeds it will utilize the real estate
assets as collateral for the Section 108 Loan,

R23, Public Hearing - Consider application for Section 108 Loan Guarantee -
Focused Neighborhood Revitalization Program
RES. 2003-121 - A Resolution of the Mayor and Common Council of the
City of San Bernardino approving the proposed Section 108 Loan
Guarantee application for the Focused Neighborhood Revitalization
Program and authorizing and approving the submittal of the final
application to the U.S. Department of Housing and Urban Development
(HUD) and for public distribution.
Mayor/Chairman Valles opened the hearing,
Executive Director Van Osdel noted that four additional areas had been added to
the original list of targeted neighborhood areas approved for use of Section 108
loan funds, and the Council now needed to approve the application,
Council Member/Commissioner McCammack stated that at a recent housing
meeting held by the Chamber of Commerce there had been discussion regarding
what the City and the Economic Development Agency are doing to stimulate
economic growth in the area, She stated that she and Council Member/
Commissioner Longville had explained the application of this $10 million and
the targeted areas that had been selected by the Council as a whole, Discussion
had ensued regarding the need to include the areas along the 215 Freeway as
targeted areas, Although she and Ms, Longville had explained that some of the
area along the 215 Freeway is already within certain redevelopment project
areas, several individuals expressed hope that the Council would not forget the
areas along the freeway, as some of these properties are key to turning around
some of the commercial areas, and she had agreed to relay this information
publicly to the other Council/Commission members,
Council Member/Commissioner Longville stated she was pleased to see Section
108 monies being used for and within neighborhoods as opposed to single
purpose projects used to turn neighborhoods around, She stated that so often a
wonderful new development is "planted" in a neighborhood, yet the blighted
surrounding area still exists, the investment doesn't necessarily occur, and the
blight doesn't get turned around quite as quickly,
City Attorney Penman stated it was a good thing that the Mayor and Council
had held a workshop on this matter, as several additional areas had been added,
increasing the areas in which the money can be spent, including the Arden
Guthrie soccer complex area, the Westside, the 40"' Street Redevelopment
Project Area, and the Uptown Area,

Council Member/Commissioner Estrada stated that she hoped staff would
approach the use of these funds very cautiously and in light of other projects
being proposed or contemplated for these areas, in order to combine projects, if
possible, and get more "bang for the buck, "
Council Member/Commissioner Anderson wanted to be sure that the order in
which the projects were listed in the document, was not the order in which the
projects would be addressed, She felt the money should be spent according to
need and did not believe the projects were currently listed by priority,
No public comments were received,
City Attorney Penman advised that Council Member/Commissioner
McCammack owns property in one of the several targeted areas-the Uptown
Area-and he and Special Counsel Sabo were trying to figure out how it could
be excised out and allow her to still vote on the majority of the areas, He stated
that since the only thing she has to abstain on is Area F (the Uptown Area), and
the resolution covers a lot more than that, it would be good if they could excise
it, but they could not figure out a convenient way to do so, Therefore, he
recommended that Ms, McCammack abstain from voting on this matter, even
though only a small part of the vote affects Uptown,
Discussion ensued regarding the best way to allow Ms, McCammack to vote on
all the other areas without voting on Area F, Special Counsel Sabo suggested a
supplemental Exhibit B, so there would be one exhibit with the Uptown Area
and another exhibit without the Uptown Area,
Following further discussion, City Clerk Clark asked Mr. Sabo if he was
suggesting that two separate votes be taken on the same resolution, or was he
suggesting a duplicate resolution,
Mr, Sabo recommended that the Council take two votes-one vote to approve
the resolution without the Uptown Area, and a second action to simply add as an
addendum to the resolution one additional area, which would be the Uptown
Area, This would result in two exhibits-Exhibit B (which would not include
Area F - Uptown) and Exhibit B-1 (which would include only Area F -
Uptown), Ms, McCammack could then participate in the first vote, but would
abstain when the second vote was taken,
Council Member/Commissioner Estrada made a motion, seconded by Council
Member/Commissioner Suarez, that the hearing be closed; and that said
resolution be adopted, with the exception of Area F,

The motion carried and Resolution No, 2003-121 was adopted by the following
vote: Ayes: Council Members/Commissioners Estrada, Longville, McGinnis,
Derry, Suarez, Anderson, McCammack, Nays: None, Absent: None,
Council Member/Commissioner Estrada made a motion, seconded by Council
Member/Commissioner Anderson, that the Mayor and Common Council
approve Exhibit B-1 (Area F - Uptown), to be included as an addendum to
Resolution No, 2003-121,
Council Member/Commissioner McCammack left the room, stating that she
would abstain on this vote because she owns property in the Uptown Area,
The motion carried by the following vote: Ayes: Council Members/
Commissioners Estrada, Longville, McGinnis, Derry, Suarez, Anderson, Nays:
None, Abstentions: Council Member/Commissioner McCammack, Absent:

Note: The resolution also included Exhibit A, a map of the eight focused
neighborhood revitalization areas, The CouncillCommission specifically wished
to except Area F (Uptown) from the adoption of the resolution, Therefore, for
consistency with their intent, Exhibit A-I was created showing a map of the
Uptown Area only and Exhibit A was amended to depict the other seven areas,

exciting and enlightening, He also announced a Support the Troops rally to be

be used for development of either new housing or commercial/retail development. It is expected
that the Project will act as a stimulus, create synergism and promote new development resulting
in employment and homeowner opportunitities for City residents and private reinvestment.
Accordingly, the Section 108 Loan funds will be used for eligible activities noted in 24 CFR
subpart M, 570,703 ofHUD Regulations:
a, Acquisition of improved or unimproved real property, including acquisition for
economic development purposes;
b, Relocation Assistance to displaced businesses, families, individuals, or others
who must relocate permanently or temporarily as a result of an activity financed
with the Section 108 Loan funds;
c, Clearance, demolition and removal;
d, Site preparation, including construction, reconstruction or installation of public
and other site improvements,
s. Loan Request Amount:
The City of San Bernardino is requesting Section 108 financing in the amount of $1 0 million for
a term of 20 years, These funds will be used to fund the various activities noted under Project
Description and within the Locations noted in 3 above, The City will repay said loan amount by
pledging its annual Community Development Block Grant (CDBG) allocation,
6. Elil!ible Activitv and National Objectives:
The proposed Project meets two of the Community Development Block Grant (CDBG) national
objectives as stipulated in the CDBG regulations, 24 CFR 208, These activities aid in the
prevention or elimination of slums and blight; and benefit low- and moderate-income persons,
Many of the target areas are located within existing redevelopment project boundaries and by
State law the City has established by Ordinance that blight exist in the target areas, Much of the
target areas exhibit deteriorated buildings, deferred maintenance, old and obsolete structures and
public improvements, and show evidence of physical, economic and social blight. These
conditions hinder or impede progress for new development and act as an economic drain to the
City, Undertaking the activities under the Project Description will help alleviate or remediate
these blighting influences leading to improved economic and physical conditions,
7. Prol!ram Income:
The Project is not expected to produce a significant amount of Program Income, However, when
the City or Agency acquires real property and subsequently disposes of such property, it may
realize market value for the property, In such case, any sales proceeds generated from the
disposition of property will become program income and will be allocated to the HUD 108
repayment debt.
8. Loan Security (Collateral):
Under Section 570,705 (B)(2) the City will repay the Section 108 financing yearly in the amount
of $500,000 from the City's Community Development Block Grant (CDBG) Program,
Additionally, the City will pledge redevelopment funds from the Redevelopment Agency of the
City of San Bernardino who will act as a guarantor in the Section 108 Loan Application,

Moreover, if and when the City or the Agency acquires property using the Section 108 Loan
Proceeds it will utilize the real estate assets as collateral for the Section 108 Loan,
