BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Bernardino 2004-378 JOINT SERVICES AGREEMENT Purpose: To coordinate service delivery to the contiguous surrounding neighborhoods serviced by the San Bernardino County Sheriffs Department and the San Bernardino Police Department, this agreement is intended to provide a consistent level of service delivery and eliminate jurisdiction confusion regardless of the agency having primary jurisdiction. Defined Area: The specific geography includes the County and City of San Bernardino residential neighborhoods that border the San Manuel Band of Mission Indians Casino and parking lots. Those locations are the communities found east of Arden, north of Highland Avenue, west of Indian Canyon and south of Piedmont/Foothill. The San Bernardino County Reporting Districts are S5043 and S5063. The City of San Bernardino Reporting Districts are S2320, S2330, S2340, S2350, S2450 and S2520. Call for Service Response: All crimes remain the responsibility of the agency having primary jurisdiction of the concerned reporting district. In -progress criminal activity in the affected area which comes to the attention of either the Sheriffs Department or Police Department will be dealt with or responded to by the agency first advised. Reporting: Each agency will retain crime statistic reporting responsibility for their respective jurisdictions. To ensure the safety of the citizens in the defined area, the department receiving the call for service on an in -progress call shall respond, stabilize the situation and notify the primary agency. If circumstances prohibit the primary agency from responding, the secondary agency can take appropriate law enforcement action as an "Assist Other Agency" report with approval through their respective Watch Commanders. All reports must be forwarded to the primary agency for crime statistic reporting responsibilities. Booking Fees: If the San Bernardino Police Department makes an arrest in the County jurisdiction requiring booking on a call for service or at the request of the San Bernardino County- Sheriffs Department, booking fees will not be applied. Officers making an arrest under these circumstances will write "SB 621" across the top of the booking application. They will also note the circumstances in the body of the booking application. Casino Related Calls for Service Defined: Any law enforcement call for service reported in the defined area that can be directly linked to activities from the San Manuel Casino, patrons or traffic. Response: In light of SB 621 funding and anticipating the relocation of the Casino into the City of San Bernardino jurisdiction, coordinating a response to Casino related calls for service will be a joint effort between the San Bernardino County Sheriffs Department and the San Bernardino Police Department. Since service delivery is 2004-378 intended to provide the residents with easy reporting and to coordinate problem solving of Casino related issues the following process for responding to calls for service is preferred. 1. Any Casino related call for service or reports, regardless of jurisdiction, the preliminary investigation can be handled by either agency. 2. Any Casino related calls for service or report will be identified as such and those reports will be exchanged between agencies for analysis and problem solving efforts. 3. The Watch Commanders of both agencies will be advised of a cross over to answer a Casino related call for service or report. General Law Enforcement Defined: Both agencies retain primary jurisdiction and crime statistic reporting responsibility in their respective reporting districts in the defined areas, particularly for Part 1 crimes. Both agencies agree to support the other by responding to calls for service, at the request of the primary agency and on a limited basis in the defined areas. The concerned Watch Commanders shall monitor these events. If an officer or deputy initiates law enforcement action in the defined area, that agency is responsible for completing all reports, normal processes and booking. Such actions include, but are not limited to, warrant arrests, traffic enforcement, F.I.'s, DUI's, etc. If the action reveals unreported crime the primary agency shall be advised to assume the investigation. Such instances include but are not limited to Part 1 crimes, traffic collisions and new information to a past crime. Coordination of Problem Identification and Resolution: To facilitate oversight, the SBPD and SBSD will work together in coordinating efforts in problem recognition and problem solving. Plans, strategies, initiatives and tactics to mitigate any negative effects of Casino operations in the defined area will be jointly developed to ensure a mutual understanding and provide a coordinated law enforcement effort to better serve the residents. SB 621 Staffin¢ and Beat Assi¢nments: Specific deployment remains the discretion of the individual agencies and will be based on an analysis of crime data and calls for service information. Officers and deputies assigned to these specific beats are available for other general law enforcement duties outside these defined beats and areas. San Bernardino Police Department The San Bernardino Police Department beat assignment for the area surrounding the San Manuel Casino is C-4. The beat boundaries are irregular but generally are Highland Ave on the south, Highway 330 on the east, San Bernardino National Forest on the north and Sterling Ave on the west. (See attached map) The San Bernardino Police Department Eastern District will deploy one (1) sergeant and an additional two (2) officers per day, seven days a week to the C-4 beat. This will be five (5) officers and one (1) sergeant total. 2004-378 The officers assigned will be deployed across the four shifts to ensure seven day a week coverage. The five (5) officers funded by SB 621 will be deployed so as to provide seven day a week coverage on shift 1 (0700-1700) and shift 4 (2200-0800). After conferring with the San Manuel Department of Public Safety, the sergeant has been assigned to work 1230-2230, Wednesday through Saturday ensuring the most exposure to all four shifts. San Bernardino County Sheriff's Department The San Bernardino County Sheriff's Department Central Station beat assignment for the area surrounding the casino is "Beat 3". The beat boundaries are generally Victoria on the east (including San Manuel Reservation land), Highland Ave. on the south, Del Rosa Ave on the west and the San Bernardino National Forest on the north. The San Bernardino County Sheriffs Department Central Station generally will deploy one (1) additional deputy a day with seven-day a week coverage. There will be two (2) deputies total. Shift coverage will vary dependent on crime data or special projects. Term of Agreement: This joint service agreement will remain in effect until either agency states in writing their intent to withdraw from the Joint Services Agreement. Garrett W.
