RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINIO ADOPTING AMENDMENT NUMBER TWO AUTHORIZING THE CITY OF SAN BERNARDINO FIRE DEPARTMENT TO EXTEND THE AGREEMENT WITH THE COUNTY OF SAN BERNARDINO TO PROVIDE FIRE PROTECTION AND PARAMEDIC SERVICES TO COUNTY UNINCORPORATED AREAS WITHIN THE CITY OF SAN BERNARDINO'S SPHERE OF INFLUENCE FROM JULY 1, 2004, THROUGH JUNE 30, 2005. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That San Bernardino County Fire Department (County Fire) and the San Bernardino City Fire Department wish to renew their agreement for fire protection and paramedic services to County unincorporated areas; SECTION 2. The Mayor or her designee is hereby authorized and directed to execute said agreement, a copy of which is attached as Attachment A; SECTION 3. Said agreement will be for fire protection and paramedic services for the period of July 1, 2004, through June 30, 2005. Said services will be provided in the eight (8) San Bernardino County unincorporated areas, most commonly referred to as "county islands", located within the City of San Bernardino's sphere of influence; SECTION 4. Said agreement amount shall be for two hundred and fifty thousand dollars and no cents ($250,000). SECTION 5. HILLS, Fire Chief/Fire Warden San Bernardino County Consolidated Fire District SUBJECT: AMENDMENT NO. 2 TO AGREEMENT 01-738 BETWEEN COUNTY SERVICE AREA 38, IMPROVEMENT ZONE L, AND THE CITY OF SAN BERNARDINO RECOMMENDATION: Acting as the governing body of County Service Area 38, Improvement Zone L (Highland Paramedic), approve Amendment No. 2 to Agreement 01-738 with the City of San Bernardino extending the term for an additional one-year period, effective July 1, 2004 through June 30, 2005, which provides County Service Area 38, Improvement Zone L with fire protection, emergency medical services, and automatic aid, in the amount of $250,000. BACKGROUND INFORMATION: Originally, on July 10, 2001, the Board of Supervisors approved an Agreement with the City of San Bernardino to provide fire protection, emergency medical and automatic aid services to areas within CSA 38, Improvement Zone L, from July 1, 2001 through June 30, 2003, in the amount of $250,000 per year. The terms of the Fire Protection Services Agreement have a provision authorizing the parties to extend the Agreement for additional one-year periods on the same terms and conditions. An additional one-year period was approved by the Board on August 5, 2003 extending the agreement thru June 30, 2004. The San Bernardino County Fire Department and the City of San Bernardino have mutually agreed that the City will continue to provide fire protection and paramedic services to the County unincorporated areas ("county islands") located within the City of San Bernardino's sphere of influence that are currently under the jurisdiction of CSA 38, Zone L. On August 16, 2004. the City of San Bernardino approved the one-year period extension of service delivery, effective July 1, 2004 thru June 30, 2005, under the same terms and conditions of the existing contract that expired June 30, 2004. After the signed resolution was received from the City of San Bernardino, September 14, 2004 was the next available meeting date to seek Board approval. The retroactive coverage is necessary to continue these services for the entire one-year period. Originally, the annual service fee, in the amount of $250,000, was negotiated with the City of San Bernardino and was subject to being pro -rated if the City annexed portions of the district during the term of the Agreement. Prior to the last year's additional one year -period extension, three San Bernardino County unincorporated areas ("county islands') located within the City of San Bernardino's sphere of influence were annexed. These three island areas continue to have very low emergency call demand. However, the remaining eight county islands have continued to progressively increase in overall call demand over the term of the Agreement and offset the costs of serving the three annexed island areas. Consequently, it remains the County Fire Department's recommendation to maintain the current annual service fee amount of $250,000 during the additional one-year period extension. Approval of this recommendation will authorize Amendment No. 2 to Agreement 01-738 approving the effective dates of the Agreement to extend from July 1, 2004 through June 30, 2005. FINANCIAL IMPACT: Under the terms of the Agreement, the City of San Bernardino is paid an annual amount of $250,000 by CSA 38 and CSA 38, Improvement Zone L, collectively. The FY 04/05 cost of this Agreement is funded within the CSA 38 District budget (SGP 290 A78 2400), in the amount of $95,000 and funded within the CSA 38, Improvement Zone L District budget (SHV 290 290 2400), in the amount of $155,000. The annual service tee will remain the same during the one-year period extension. COST REDUCTION REVIEW: The County Administrative Office has reviewed this item and recommends approval of the one-year extension under the same terms and conditions. The City of San Bernardino continues to be the most cost effective and efficient provider of fire, rescue, and advanced life support (ALS/Paramedic) services for these island areas.
