HomeMy WebLinkAbout2004-176ill RESOLUTION NO. 2004-176 2 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE 3 2004/2005 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 993, LANDSCAPING MAINTENANCE DISTRICT, CAJON BOULEVARD AND JUNE 4 STREET AREA. Ill WHEREAS, by Resolution No. 91-56, the Mayor and Common Council found that the public interest, convenience, and necessity required the formation of a landscaping maintenance district; and 8 9 WHEREAS, by said Resolution No. 91-56, the Mayor and Common Council formed 10 an assessment district known as Assessment District No. 993 for the purpose of providing 11 landscaping maintenance in the Cajon Boulevard and June Street area, pursuant to the provisions 12 of Chapter 12.90 of the San Bernardino Municipal Code; and 13 WHEREAS, by Resolution No. 90-337, the Mayor and Common Council declared that 14 all the land included within the boundaries of said district receive a special benefit by the 15 16 maintenance of said landscaping; and 17 WHEREAS, said Resolution No. 90-337 declared that an annual assessment shall be 18 levied on all land within the district to provide funding for said landscaping maintenance and the 1911 administration thereof; and 20 WHEREAS, an Assessment Roll has been prepared totaling $12,487.16, which sets 21 forth the individual assessments to be levied on each of the parcels of land within Assessment 22 District No. 993 for the fiscal year 2004/2005; and 23 241 WHEREAS, Article XIII D of the California Constitution requires that any and all 25� Assessment Districts existing on the effective date of said Article XIII D shall comply with the 26 procedural and approval process as set forth in Section 4 of said Article XIII D, except as set 28I I forth in Section 5 therein. 04/23/04 2004-176 71 111 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION CONFIRMING 2004/2005 ASSESSMENT ROLL NO. 993 (CAJON BOULEVARD AND JUNE STREET AREA LANDSCAPING MAINTENANCE) BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That the Mayor and Common Council do hereby find and determine that the assessments as set forth on said Assessment Roll No. 993 are hereby exempt from the procedural and approval requirements of Article XIII D of the California Constitution, as provided for under Section 5(b) of said Article XIII D, and that the assessment amounts as set forth on said Assessment Roll are equal to or less than any prior approved assessments. SECTION 2. That the Mayor and Common Council do hereby find and determine that the proportionate costs to be levied against the parcels of land within Assessment District No. 993 are correctly set forth on Assessment Roll No. 993, for the fiscal year 2004/2005, on file in the office of the City Clerk of the City of San Bernardino, and do hereby confirm said assessments. SECTION 3.
