This is the time and place set for an Adjourned
Regular Meeting of the Mayor and Common Council of the
City of San Bernardino at the Regular Meeting held at 9:07
a.m., Tuesday, January 3, 1989, in the Council Chambers of
City Hall, 300 North "D" Street, San Bernardino,
California.
The City Clerk has caused to be posted the Notice of
Adjournment of said meeting held on Tuesday, January 3,
1989, at 9: 07 a.m., and has on file in the Office of the
City Clerk an affidavit of said posting together with a
copy of said Notice which was posted at 3: 00 p.m.,
Wednesday, January 4, 1989, in the Council Chambers of
City Hall, 300 North "0" Street, San Bernardino,
California.

The Adjourned Regular Meeting of the Mayor and Common
Council of the City of San Bernardino was called to order
by Mayor Wilcox at 6:25 p.m., Thursday, January 12, 1989,
at the Mediterranean Restaurant, 1300 E. Highland Avenue,
San Bernardino, California.
ROLL CALL
Roll Call was taken by City Clerk Clark with the
following being present: Mayor Wilcox; Council Members
Reilly, Flores, Maudsley, Minor, Pope-Ludlam; Senior
Assistant City Attorney Barlow, City Clerk Clark, Acting
City Administrator Robbins. Absent: Council Members
Estrada, Miller.
Also present: Highland Council Members: Laurie
Tully, Dennis Johnson, Jody Scott, Jim Rismiller; Planning
Director of Highland, Steve Walker; City Clerk, Pam Lee;
City Manager, Sam Racadio; Administrative Assistant, Dan
Crane.
Staff present from San Bernardino: Planning
Director, Brad Kilger; Principal Planner, Vince Bautista;
Executive Assistant to Council, Phil Arvizo; Director of
Parks, Recreation & Community Services, Annie Ramos;
Deputy City Administrator/Development, Jim Richardson;

RESOLUTION OF THE CITY OF SAN BERNARDINO
AUTHORIZING THE EXECUTION OF AN AGREEMENT
WI'rH MICHAEL LOEHR TO PERFORM CONSULTING
SERVICES FOR THE PLANNING DEPARTMENT. (5)
City Clerk Clark read the title of the above
resolution.
Council Member Minor made a motion, seconded by
Council Member Reilly and unanimously carried, that
further reading of said resolution be waived.
Acting City Administrator Robbins answered questions
regarding the service time within the agreement.
Council Member Reilly made a motion, seconded by
Council Member Maudsley and unanimously carried, that the
matter be continued to Friday, January 13, 1989, at 8: 00
a.m., in the Council Chambers of City Hall, 300 North "D"
Street, San Bernardino, California. (See Page 6)

CLOSED SESSION - POLICE NEGOTIATIONS
Counc i 1 Member Re illy made a mot i on, seconded by
Council Member Maudsley and unanimously carried, that
Closed Session pursuant to Government Code Section 54957.6
to meet with its Designated Representatives regarding
labor relations, be continued to 8:00 a.m., Friday,
January 13, 1989, in the Council Chambers of City Hall,
300 North "D" Street, San Bernardino, California.

COUNCIL MEMBER MILLER ARRIVED
Council Member Miller arrived at the Council Meeting
and took her place at the Table.
GENERAL DISCUSSION RELATIVE TO PARKS
Sam Racadio, City Manager of Highland, stated that
the San Bernardino-Highland Sub-Committee has discussed
the possibility of a joint effort in a park for both
cities. Highland is in the process of applying for a
grant, and they used Sixth and Del Rosa as a site on the
application, but found that the site was not planned for a
San Bernardino park. (1)
Annie Ramos, Director of Parks, Recreation and
Community Services, answered questions regarding park
property near Ninth and Del Rosa which had at one time
been proposed for the Nu Tech development.

It was the general consensus that Highland did not
have the money at this time for a joint Highland-San
Bernardino park.
SAN BERNARDINO AND HIGHLAND GENERAL PLANS
Steve Walker, Highland Planning Director, gave a
report on the progress of Highland's General Plan, and
pointed out that their general plan consultants are
looking at San Bernardino-Highland boundary areas. The
Highland General Plan contains a design element and an
economic element which are optional. (2)
Brad Kilger, San Bernardino Planning Director, stated
that San Bernardino has twenty-two weeks to finish its
general plan process and offered to forward documents to
Highland for their information.
Vince Bautista, Principal Planner for the City of San
Bernardino, talked about the General Plan Open House which
will be held February 25, 1989.

The Planning Director for the City of San Bernardino,
explained the notification process. Each property owner
in San Bernardino will be mailed at least one notification
of the process. He also spoke of the ambitious schedule
of hearings for the CAC, the Planning Commission and the
Mayor and Council.
SANTA ANA WATER CONSERVATION JP~
Dennis Johnson, Highland Council Member, spoke re-
garding the importance of the Santa Ana Wash and the
dilemma facing Highland concerning mining operations in
the Wash. Highland is meeting with Redlands on the wash
issue and regarding water. He also spoke regarding the
need to talk to San Bernardino about water usage.

Steve Walker, Highland Planning Director, stated that
Tri City is moving their office to Redlands however, their
mining operations will stay in Highland.
Dennis Johnson explained the concept of a "haul" road
for moving materials to reduce impact on surface streets
and the freeway.

It was pointed out that CalTrans had not included
funds for landscaping the new 30/330 Freeway and it was
agreed that this is top priority for both cities.
Steve Walker stated that there is a possibility that
Central Avenue in Highland will be designated a major
arterial in Highland's General Plan.
RECESS MEETING
At 7: 45 p.m., the representatives from the City of
Highland left the Council Meeting. Mayor wilcox called a
five-minute recess.
RECONVENE MEETING
At 7:55 p.m., the Adjourned Regular Meeting of the
Mayor and Common Council reconvened in the Mediterranean
Restaurant, 1300 E. Highland Avenue, San Bernardino,
California.

Roll Call was taken by City Clerk Clark with the
following being present: Mayor Wilcox; Council Members
Reilly, Flores, Maudsley, Minor, Pope-Ludlam, Miller; Sr.
Assistant City Attorney Barlow, City Clerk Clark, Acting
City Administrator Robbins. Absent: Council Member
Estrada.
SAN BERNARDINO GENERAL PLAN NOTIFICATION
Brad Kilger, Planning Director for the City of San
Bernardino, explained how the owners of 60,000 to 70,000
parcels of property in San Bernardino will be notified for
the general plan and presented a revised hearing schedule.

Vince Bautista, Principal Planner, explained the
purpose of the open house which will enable the Planning
Department to field questions about the General Plan prior
to the hearings.
Dennis Barlow, Sr. Assistant City Attorney, spoke
regarding the compression problems caused when deadlines
are not met early in the schedule, cutting the Mayor and
Council's time short. If the Council makes any substan-
tive changes in the general plan it must go back to the
Planning Commission for consideration. Four general Plan
amendments will be permitted each calendar year.

Council Member Minor made a motion, seconded by
Council Member Maudsley and unanimously carried, that the
revised schedule (as follows) be adopted and the Planning
Department be authorized to proceed with the notifications
as proposed at an approximate cost of $13,000.

Vince Bautista suggested that the Council meeting
proposed for January 23, 1989, on the General Plan, be
postponed to January 30, 1989, to allow additional time
for Planning Staff to make changes set forth by the
Commission at their meeting of January 21, 1989.

Phil Arvizo, Executive Assistant to the Council,
advised the Council of a letter received from Gill Snyder,
President of the Chamber of Commerce, requesting contin-
uance of the Fundamental Land Use Issue document so the
Chamber could hire a consultant to review the document.
The Planning Director stated that on the 30th of
January the Council can only discuss the six areas of the
document that were specifically continued to a later date.
RECONSIDERATION OF AGREEMENT- CONSULTING SERVICES _
LABOR RELATIONS - RICHARDS, WATSON & GERSHON
Council Member Reilly made a motion, seconded by
Council Member Minor and unanimously carried, that recon-
sideration of, and possible action on, agreement with
Richards, Watson & Gershon for consulting services re-
lating to labor relations matters, be continued to Friday,
January 13, 1989, at 8:00 a.m., in the Council Chambers of
City Hall, 300 North "D" Street, San Bernardino,

DISCUSSION AND POSSIBLE ACTION _
CITY NEGOTIATING TEAM - LABOR RELATIONS-
AND AGREEMENTS WITH BARGAINING UNITS
Council Member Reilly made a motion, seconded by
Council Member Minor and unanimously carried, that discus-
sion and possible action on the composition of the City
negotiating team for labor relations and agreements with
the bargaining units, be continued to Friday, January 13,
1989, at 8:00 a.m., in the Council Chambers of City Hall,
300 North "D" Street, San Bernardino, California.

At 8:20 p.m., Council Member Reilly made a motion,
seconded by Council Member Minor and unanimously carried,
that the Adjourned Regular Meeting of the Mayor and Common

Acting City Administrator Robbins answered questions
regarding the agreement and recommended an amendment on
line 4, Page 2 changing the words "56 days to 12 hours".

At 8:17 a.m., Council Member Estrada arrived at the
Council Meeting and took her place at the Table.
Council Member Miller made a motion, seconded by
Council Member Reilly and unanimously carried, that said
resolution be adopted.

At 10:00 a.m., the Adjourned Regular Meeting of the
Mayor and Common Council reconvened in the Council
Chambers of City Hall, 300 North "D" Street, San
Bernardino, California.

Roll Call was taken by City Clerk Clark with the

POLICE DEPARTMENT LABOR NEGOTIATIONS
Mayor Wilcox stated that the City's negotiators had
been given instructions in closed session concerning the
on-going Police Department labor negotiations process.

EMERGENCY PERSONNEL ITEM - POLICE DEPARTMENT
Mayor Wilcox requested that the Council take a vote
under Section 54954.2 of the Brown Act to allow the Mayor
and Council to go into a non-agendized personnel closed
session, due to a personnel matter in the Police
Department.
Council Member Estrada made a motion, seconded by
Council Member Miller, that a Police Department personnel
issue which arose subsequent to the posting deadline for
today's agenda, be heard as an emergency item.
COUNCIL MEMBER POPE-LUDLAM EXCUSED
Council Member Pope-Ludlam left the Council Meeting.
The motion carried by the following vote:
Council Members Estrada, Reilly, Flores, Maudsley,
Miller. Noes: None. Absent: Council

Council Member Minor made a motion, seconded by

LABOR RELATIONS NEGOTIATING TEAMS
CONTINUED FROM JANUARY 12, 1989
The Mayor and Council discussed the composition of
the City's negotiating team for labor relations.
(See Page 6) (S-2)
Acting City Administrator Robbins stated that the
City had contracted with the firm of Richards, Watson and
Gershon for labor relations assistance to the Personnel
Director, because the Personnel Director had too many
duties.
The Mayor pointed out that this was done at a time
when the Personnel Director was also in charge of Civil
Service and that is not the case today.

Council Member Minor made a motion, seconded by
Council Member Estrada and unanimously carried, that Item
S-l concerning the reconsideration of, and possible action
on, agreement with Richards, Watson & Gershon for
consulting services relating to labor relation matters, be
heard.

TERMINATION OF CONTRACT WITH LABOR RELATIONS
NEGOTIATORS - RICHARDS, WATSON & GERSHON
(COLEMAN WALSH) - CONTINUED FROM JANUARY 12, 1989
This is the time and place set for the Council to
discuss the agreement with Richards, Watson and Gershon
for consulting services relating to labor relations
matters. (See Page 5) (S-l)
Sr. Assistant City Attorney Barlow answered questions
regarding the terms of the agreement.

the Council regarding his capability and
handling labor negotiations.
Council Member Miller made a motion, seconded by
Council Member Reilly to terminate the contract with
Richards, Watson and Gershon for labor relations
consulting services.

Coleman Walsh, the City's negotiator from the firm
Richards, Watson and Gershon, stated that the point was
made that the negotiating team reached impasse with each
unit however, they did not reach impasse with the
Mid-Managers. The General Employees' unit was the first
they met with and it did come to impasse. He suggested
that since his style seems to be the problem that the City
use another person from his firm.
The motion carried by the following vote: Ayes:
Council Members Estrada, Reilly, Maudsley, Minor, Miller.
Noes: Council Member Flores. Absent: Council Member
Pope-Ludlam.
Council Member Minor made a motion, seconded by
Council Member Miller and unanimously carried, that the
Personnel Director be assigned on an interim basis to
continue to negoitiate with the Police Officers
Association.
Council Member Minor made a motion, seconded by
Council Member Miller and unanimously carried, that the
Personnel Director be directed to identify any local firms
that could provide labor relations services; to anlayze
the impact on the Personnel Department if the Director
were to continue as labor relations negotiator; and to
report this information to the Council Personnel Committee
for study.

ADJOURNMENT
At 11:00 a.m., Council Member Minor made a motion,
seconded by Council Member Miller and unanimously carried,
that the meeting be adjourned to 9: 00 a.m, Tuesday,
January 17, 1989, in the Council Chambers of City Hall,
