HomeMy WebLinkAbout2003-288RESOLUTION NO. 2003-288 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DESIGNA TING THE AREA BURNED BY THE OLD WATERMAN CANYON FIRE AS A DISASTER AREA UNDER SAN BERNARDINO MUNICIPAL CODE SECTION 15.04.080(B)(2). Be it resolved by the Mayor and Common Council of the City of San Bernardino as follows: WHEREAS, the Mayor on October 25, 2003, issued a Proclamation of the existence of a local emergency caused by the Old Waterman Canyon Fire; and: WHEREAS, the Common Council has ratified said Proclamation at an Emergency Meeting of the Common Council held on October 29, 2003; and WHEREAS, over 330 structures within the City of San Bernardino have been damaged or destroyed by the Old Waterman Canyon Fire; and WHEREAS, San Bernardino Municipal Code Section 15.04.080(B)(2) provides in part, that no fees shall be charged for permits issued to owners for demolition or first rebuilding of damaged or destroyed structures located in an area designated as a disaster area by resolution of the Mayor and Common Council; and WHEREAS, the Mayor and Common Council wish to assist property owners with the repair and rebuilding of their damaged or destroyed homes and structures; NOW THEREFORE be it resolved that the Mayor and Common Council hereby designate the area burned by the Old Waterman Canyon Fire as a disaster area under San Bernardino Municipal Code Section 15.04.080(B)(2), so that no fees shall be charged for permits issued to owners for demolition or first rebuilding of damaged or destroyed structures In accordance with the provisions of said Section. RESOUTlON NO. 2003-_ RESOLUTION OF THE CITY OF SAN BERNARDINO PROCLAIMING EXISTENCE OF A LOCAL EMERGENCY AND REQUESTING GOVERNOR TO (I) PROCLAIM A STATE OF EMERGENCY; AND (2) REQUEST A PRESIDENTIAL DECLARATION WHEREAS, Chapter 2.46 of the Municipal Code of the City of San Bernardino empowers the Mayor to proclaim the existence or threatened of a local emergency when said City is affected or likely to be affected by a public calamity; and WHEREAS, the Mayor does hereby find: that conditions of extreme peri] to the safety persons and property have arisen within the City of San Bemardino, caused by wild fire; and That the aforesaid conditions of extreme peril warrant and necessitate the proclamation of the existence of a local emergency; NOW, THEREFORE, IT IS HEREBY PROCLAIMED that a local emergency now exists throughout said City; and IT IS FURTHER PROCLAIMED AND ORDERED that during the existence of said local emergency the powers, functions, and duties of the Mayor and the emergency organization of the City shall be those prescribed by State law, by ordinance, and resolutions of this City approved by the Mayor. WHEREAS, it has now been found that local resources are unable to cope with the effects of said emergency; II II II II 1/ II II ". 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ", RESOLUTION OF THE CITY OF SAN BERNARDINO PROCLAIMING EXISTENCE OF A LOCAL EMERGENCY AND REQUESTING GOVERNOR TO (I) PROCLAIM A STATE OF EMERGENCY; AND (2) REQUEST A PRESIDENTIAL DECLARATION NOW THEREFORE, IT IS HEREBY PROCLAIMED AND ORDERED that a copy of this resolution be forwarded to the Govemor of California with the request that he proclaim the City of San Bernardino to be in a state of emergency; and further that the Governor request a Presidential Declaration. IT IS FURTHER ORDERED that a copy of this resolution be forwarded to the State Director of Office of the Emergency Services. Dated: October 25 2003 ATTESTED BY: ~ /;;. ot~ Rachel Clark, City Clerk 2 .' \ Resolution No. 2003- RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING EXISTENCE OF A LOCAL EMERGENCY WHEREAS, Chapter 2.46 of the Municipal Code of the City of San Bernardino empowers the Mayor to proclaim the existence or threatened existence of a local emergency when said City is affected or likely to be affected by a public calamity and the Common Council is not in session; and WHEREAS, the Mayor of the City of San Bernardino does hereby find: That conditions of extreme peril to the safety of persons and property have risen within said City, caused by wild fire.
