MAYOR AND COMMON COUNCIL AND
COMMUNITY DEVELOPMENT COMMISSION
OF THE CITY OF SAN BERNARDINO
JOINT ADJOURNED REGULAR MEETING
MA Y 13, 2002
COUNCIL CHAMBERS
This is the time and place set for a joint adjourned regular meeting of the Mayor and
Common Council and Community Development Commission of the City of San Bernardino
from the joint regular meeting held at 8:00 a.m., Monday May 6, 2002, in the Council
Chambers of City Hall, 300 North "D" Street, San Bernardino, California.
The City Clerk has caused to be posted the order of the adjournment of said meeting held on
Monday, May 6, 2002, and has on file in the Office of the City Clerk an affidavit of said
posting together with a copy of said order which was posted at 11:00 a.m., Tuesday, May
7, 2002, on or near the door of the place at which said meeting was held.
The joint adjourned regular meeting of the Mayor and Common Council and Community
Development Commission of the City of San Bernardino was called to order by
Mayor/Chairman Valles at 3:08 p.m., Monday, May 13, 2002, in the Council Chambers of
City Hall, 300 North "D" Street, San Bernardino, California.
Roll Call
Roll call was taken by City Clerk Clark with the following being present; Mayor/Chairman
Valles; Council Members/Commissioners Estrada, Lien, Derry Suarez, Anderson,
McCammack; City Attorney Penman, City Clerk Clark, City Administrator Wilson.
Absent: Council Member/Commissioner McGinnis.
1. Closed Session
Pursuant to Government Code Section(s):
A. Conference with legal counsel - existing litigation - pursuant to Government
Code Section 54956.9(a).
B. Conference with legal counsel - anticipated litigation - significant exposure
to litigation - pursuant to subdivision (b) (I), (2), (3) (A-F) of Government
Code Section 54956.9.
C. Conference with legal counsel - anticipated litigation - initiation of litigation
- pursuant to subdivision (c) of Government Code Section 54956.9.

D. Closed session - personnel - pursuant to Government Code Section 54957.
E. Closed session with Chief of Police on matters posing a threat to the security
of public buildings or threat to the public's right of access to public services
or public facilities - pursuant to Govermnent Code Section 54957.
F. Conference with labor negotiator - pursuant to Government Code Section
54957.6.
G. Conference with real property negotiator - pursuant to Government Code
Section 54956.8.
City Attorney Penman announced that the following additional cases would be
discussed in closed session:
Under lB, Conference with legal counsel, significant exposure to litigation
pursuant to subdivision (b) (1), (2), (3) (A-F) of Government Code Section
54956.9: claim of Ann Menefee (Hill);
Under IC, Conference with legal counsel, initiation of litigation pursuant to
subdivision (c) of Government Code Section 54956.9: State Department of
Corrections, Department of Parole.
2. RES. 2002-137 - Resolution of the City of San Bernardino authorizing the Chief
of Police to file a Going Home - Serious and Violent Offender Reentry Initiative
Grant application with the U.S. Departments of Justice, Labor, Health and
Human Services, Education and Housing and Urban Development. (Continued
from May 6, 2002)
Pastor Ray Turner, 3193 N. Mayfield Avenue, San Bernardino, CA, spoke in
support of the grant, stating that he considered it an opportunity to prepare parolees
for their return to their communities and families.
City Attorney Penman stated that there were some issues remammg with the
application, but that the deadline for submittal was May 15 and he did not want to
hold it up. He noted that if the City is awarded the grant, the Mayor and Common
Council would have to make a decision whether to accept it or not. Mr. Penman
stated that at that time the City would request a letter from the Department of
Corrections as a guarantee that they would not increase the number of parolees
coming to the City of San Bernardino.
Council Member/Commissioner McCammack made a motion, seconded by Council
Member/Commissioner Estrada, that said resolution be adopted.

Resolution No. 2002-137 was adopted by the following vote: Ayes: Council
Members/Commissioners Estrada, Lien, Derry, Suarez, Anderson, McCammack.
Nays: None. Absent: Council Member/Commissioner McGinnis.
3. Adjournment
The Council/Commission meeting adjourned at 4:08 p.m. The next joint regular
meeting of the Mayor and Common Council and Community Development
Commission is scheduled for 8:00 a.m., Monday, May 20, 2002, in the Council
Chambers of City Hall, 300 North "D" Street, San Bernardino, California.
