The regular meeting of the Mayor and Common Council of the
City of San Bernardino was called to order by Mayor Minor at 8:05
a.m., Monday, December 20, 1993, in the Council Chambers of City
Hall, 300 North "D" Street, San Bernardino, California.

The invocation was given by Phil Arvizo, Executive Assistant

Council Member Curlin extended Christmas greetings, wished
everyone a Happy New Year and explained his position relative to
the proposed Council salary increase.

Council Member Hernandez stated that because sufficient
notice could not be given to conduct the Personnel Committee
meeting, an informal meeting was held to approve the six
paramedic positions which were continued from the Mayor and
Council meeting of December 6, 1993. He stated that he would be
giving the tape of the informal meeting to Mayor Minor, and
explained his position on the proposal for a city operated
emergency-medical transport service.

In a memorandum dated December 16, 1993, Mayor Minor
recommended that Armando J. Gonzales, 956 W. Congress Street, San
Bernardino, CA, be appointed to the Human Relations Commission,
as requested by Council Member Hernandez.
Council Member Oberhelman made a motion, seconded by Council
Member Hernandez, and unanimously carried, that the
recommendation to appoint Armando J. Gonzales to the Human
Relations Commission per Council Member Hernandez' request, be
approved.
SERVICE PIN AWARD CEREMONY

J. Lorraine Velarde, Executive Assistant to the Mayor, read
the names of each employee receiving service pin awards.
Each employee received a service pin from Mayor Minor in
gratitude of his/her many years of dedicated service to the city.

In a memorandum dated December 3, 1993, Annie Ramos,
Director of Parks, Recreation & Community Services, requested
funding to replace the intrusion alarm which is not operating
properly at the Delmann Heights Community Center.
Council Member Oberhelman made a motion, seconded by Council
Member Hernandez, and unanimously carried, that $886 from the
sixth Ward Park Extension Fund for the replacement of the
intrusion alarm at Delmann Heights Community center, be approved.
CHANGE ORDER #1 - MATICH CORPORATION - ADDITIONAL 3'
ROCK ASPHALT GRINDINGS & GEOGRID SUBGRADE

In a memorandum dated December 9, 1993, Roger Hardgrave,
Director of Public Works/City Engineer, stated that the
underlying soil was found to be unsuitable as a subgrade for
placement of the new asphalt concrete. Normal practice would be
to remove the unsuitable material and impact backfill soil which
meets the specifications. However, due to the shallowness of the
utilities, this method was not practical. Therefore, staff
requested that the Soils Engineer provide a recommendation to
stabilize the unsuitable material. The Soils Engineer
recommended that three-inch rock be spread over the unsuitable
material and that the material be compacted with a steel-wheel
vibratory roller. Asphalt chippings would then be applied to a
depth of three inches and a geogrid fabric would be placed over
the chippings. To avoid extensive delay claims by the
Contractor, the contractor was directed to proceed with the
extra work involved in stabilizing the unsuitable material.
Council Member Oberhelman made a motion, seconded by Council
Member Hernandez, and unanimously carried, that change Order No.
One to the contract with Matich Corporation for rehabilitation
of Arrowhead Avenue, from Mill Street to Third Street, be
approved; and authorize the contractor to place three-inch rock
additional asphalt grindings and geogrid, as recommended by the
Soils Engineer, to stabilize the subgrade between Cluster Avenue
and Valley Street, at an estimated increase to the contract price
of $15,500; from $626,413 to $641,913.

Council Member Oberhelman made a motion, seconded by Council
Member Hernandez, that said resolution be adopted; and that the
following addresses be deleted from Exhibit "A" of said
resolution: 1742 W. 28th Street and 1745 Lugo Avenue.
The motion carried and Resolution No. 93-456 was adopted by
the following vote: Ayes: Council Members Negrete, Hernandez,
Oberhelman, Devlin, Pope-Ludlam, Miller. Nays: None. Absent:

RES. 93-457 - RESOLUTION OF THE CITY OF SAN BERNARDINO
AUTHORIZING THE SUBMISSION OF AN APPLICATION TO THE

WAIVE FURTHER READING OF RESOLUTIONS & ORDINANCES (5)
COUNCIL MEMBER POPE-LUDLAM EXCUSED
At 10:02 a.m., Council Member Pope-Ludlam left the Council
meeting.
Jeff Wright, P. O. Box 2341, San Bernardino, CA, expressed
opposition to waiving the reading of the resolutions and
ordinances, and requested that item numbers be placed on the
voting board.
Council Member Hernandez made a motion, seconded by Council
Member Oberhelman, and unanimously carried, that further reading
of all resolutions and ordinances on the regular, supplemental
and Community Development Commission agendas, be waived.

At 10:03 a.m., Council Member Curlin returned to the Council
meeting and took his place at the council table.
INITIATE - DEVELOPMENT CODE AMENDMENT - TIME EXTENSION
- CONDITIONAL USE PERMITS, DEVELOPMENT PERMITS &
VARIANCES (7)
In a memorandum dated December 8, 1993, Mayor Minor stated
that on September 13, 1993, the Governor of California approved
Senate Bill 428 which extends the expiration date of tentative
tract and parcel maps that had not expired on the effective date
of the legislation. Mayor Minor recommended that conditional use
permits and development permits also be extended, and that
consideration also be given to approved projects. Consequently,
it is recommended that Planning staff be directed to prepare an
amendment to the Development Code to allow an automatic one-time,
two-year extension of time on previously approved conditional use
permits, development permits and variances retroactive to
include those projects that were valid as of September 13, 1993.

City Administrator Shauna Clark explained that the two-year
extension of time only relates to approved projects.

council Member Negrete made a motion, seconded by Council
Member Devlin, and unanimously carried, that Planning staff be
directed to prepare a Development Code Amendment to grant an
automatic one-time, two-year extension of time for valid
conditional use permits, development permits and variances.
CHANGE ORDER #2 MENTONE TURF SUPPLY RENOVATE
DETERIORATED LANDSCAPE MATERIAL - SOUTHWEST CORNER OF
PINE AND BELMONT - LANDSCAPE MAINTENANCE - ASSESSMENT
DISTRICT NO. 976 - $7,400 INCREASE (9)
In a memorandum dated November 29, 1993, Roger Hardgrave,
Director of Public Works/City Engineer, stated that in 1986 one
of the conditions of approval for Tract No. 11844 was that the
parkways along pine and Belmont Avenues be landscaped. Due to
the remnant parcel created by the Bailey Creek Flood Control
Channel, additional landscaping was installed at the southwest
corner of pine and Belmont Avenues. Over the last seven years,
the condition of the installed ground cover has deteriorated, and
it was deemed necessary to replace about 8,000 square feet of
ground cover. The contractor quoted a price of $7,400, and staff
has determined that the price is fair and reasonable.

opposition to the costs associated with the renovation of the
deteriorated landscape material.
Council Member Devlin made a motion, seconded by Council
Member Miller, and unanimously carried, that Change Order No. Two
to the contract with Mentone Turf Supply for the maintenance of
landscaping in Assessment District No. 976, in accordance with
Plan No. 7034-B, be approved; and authorize the contractor to
renovate the deteriorated landscaping material located at the
southwest corner of pine and Belmont Avenues, at an increase in
the contract price of $7,400, from $48,619 to $56,019.

In a memorandum dated November 30, 1993, Roger Hardgrave,
Director of Public Works/City Engineer, stated that in order to
enhance the marketability of their properties, Block Brothers
installed landscaping and an automatic irrigation system within
the Kendall Drive parkway adjacent to their properties. A parcel
was subsequently sold to the developer of a senior citizen
apartment complex, and the site plans directed that a fence be
installed along the front property line to enhance security.
During excavation for the foundation for this fence, it was
discovered that the conduit for the automatic irrigation
controller wires had been installed beyond the street right-of-

way line. The conduit had to be relocated since it was in direct
conflict with the foundation for the fence. In order to avoid
work delays on the fence and loss of plant material, the
landscape maintenance contractor relocated about 600 feet of the
condui t wi thin the parkway area, which necessitated pulling in
approximately 3,100 feet of new control wire. The total cost for
the extra work is $5,831.24.
Roger Hardgrave, Director of Public Works/City Engineer,
answered questions regarding the placement of the conduit.
Discussion ensued regarding the possibility of recovering
the payment to Mentone Turf Supply if approval of said change
order is granted.
Council Member Curlin made a motion that the bill be
approved minus the amount which is still in dispute.
The motion failed for lack of a second.
COUNCIL MEMBER POPE-LUDLAM RETURNED
At 10:11 a.m., Council Member Pope-Ludlam returned to the
Council meeting and took her place at the council table.
A discussion was held relative to funding recovery
procedures and change order policies.
MAYOR MINOR EXCUSED
At 10:15 a.m., Mayor Minor declared a conflict of interest
because he lives within the assessment district and removed
himself from the council table. council Member Miller assumed
the duties of Mayor Pro Tempore.
CITY ATTORNEY PENMAN EXCUSED
At 10:16 a.m., city Attorney Penman left the Council meeting
and was replaced by Senior Assistant City Attorney Barlow.
Discussion continued regarding the possibility of recovering
the payment to Mentone Turf Supply.
Council Member Pope-Ludlam made a motion, seconded by
Council Member Negrete, that contract Change Order No. One to the
contract with Mentone Turf Supply for the maintenance of
landscaping in Assessment District No. 959, in accordance with
Plan No. 6363-B, be approved; and authorize the contractor to
relocate conduit and wiring on Kendall Drive, at an increase in
the contract price of $5,831.24, from $69,015 to $74,846.24.
(Note: The vote was taken after discussion.)

Council Member Oberhelman made a motion, seconded by Council
Member Hernandez, and unanimously carried, that the personnel
actions submitted by the Chief Examiner dated December 9, 1993,
and December 16, 1993, in accordance with civil Service Rules and
Regulations and Personnel Policies adopted by the Mayor and
Common Council of the City of San Bernardino, be approved and
ratified.

At 10:20 a.m., Mayor Minor returned to the Council meeting
and took his place at the council table.

Council Member Oberhelman made a motion that said
resolutions be continued to the next Council meeting in order to
review the other investment options that were explored by the
Deferred Compensation Committee that may be available to both
classes of employees.
The motion failed for lack of a second.
City Administrator Shauna Clark requested that said
resolutions be continued to later in the meeting in order to
obtain the answers to Council Member Oberhelman's inquiry. She
explained that the city is currently without a contract, and she
would like to see the matter resolved.
Council Member Hernandez made a motion, seconded by Council
Member Pope-Ludlam, and unanimously carried, that said
resolutions be continued to later in the meeting.

RESOLUTION OF THE CITY OF SAN BERNARDINO ESTABLISHING
FEES FOR PROCESSING APPLICATIONS FOR REAPPORTIONMENT OF
ASSESSMENTS RELATIVE TO ASSESSMENT DISTRICT BONDS
PURSUANT TO SECTION 8740 ET SEQ OF THE CALIFORNIA
STREETS AND HIGHWAYS CODE. (20)
Concern was expressed relative to the total estimated value
of the contract and whether or not a request for proposals should
be issued.
City Administrator Shauna Clark answered questions regarding
the current bond administrator.
Roger Hardgrave, Director of Public Works/City Engineer,
stated that it would be difficult to assess a total value because
the fees would only apply to those bonded assessment districts
which now equate to five or six within the city, and explained
that the value is also dependent upon development.
Council Member Curlin made a motion, seconded by Council
Member Negrete, and unanimously carried, that adoption of the
resolution be continued to the meeting of January 10, 1994, in
the Council Chambers of City Hall, 300 North "D" Street, San
Bernardino, California; and that a hearing be held on January
10, 1994 at 10:00 a.m. to consider the establishment of a fee for
processing applications for apportionment of assessments under
the provisions of the 1913-15 Act.

ownership of ambulance services, requested that approval of the
City's operation plan be rescinded and that Courtesy Ambulance
be approved as the sole-ambulance provider within the City. He
answered questions regarding the operation of private-ambUlance
services.
Peggy Ducey, Assistant to the City Administrator, responded
to the presentation made by Steve Rice of courtesy Ambulance, and
explained the events leading to the issue of double billing. Ms.
Ducey answered questions regarding the net revenue projections
proposed by the City and the proposed operating plan for a City-
operated paramedic service.

with Courtesy Ambulance, the city extended the option of having
Courtesy Ambulance operate as the sole transportation provider;
however, Courtesy refused the offer.

City Attorney Penman noted that he counted at least 22
individuals in the audience whom appeared to be in support of
Courtesy Ambulance. He stated that if they wish to speak before
the Mayor and Council, they have the opportunity to do so.
City Clerk Rachel Clark announced that the Council Office
has recorded a total of 94 telephone calls, 68 in support of a
City operated emergency-medical transport service and 26 in
support of Courtesy Ambulance.
Mr. Rice stated that he was not aware that the matter was
going to be another public hearing.
Mayor Minor explained that the item was not placed on the
agenda as a public hearing; however, he cannot deny the public
the right to speak.
Discussion ensued relative to the implementation of the
proposed City operated emergency-medical transport service.

This is the time and place set for a public hearing to
consider the creation of Underground utility District No. 22,
generally located along portions of 5th Street, 6th Street, 7th
street, "F" Street, "G" Street and "H" street.
In a memorandum dated November 24, 1993, Roger Hardgrave,
Director of Public Works/City Engineer, stated that at its
meeting of May 5, 1993, the Underground Utility District
Committee recommended the formation of Underground utility
District No. 22. certain utility companies are required by Rule
20 of the Public utilities commission to set aside a certain
portion of their revenue to finance the cost of undergrounding
overhead facilities within districts established by local
agencies. Agencies are allocated funds based upon the total
number of overhead services within the agency's boundaries. At
their own expense, property owners within the proposed district
would be required to complete the undergrounding from their
property lines to the service points.

ASSESSMENT DISTRICT NO. 1011 (24)
This is the time and place set for a public meeting relative
to the formation of the Quail Canyon Area Sewer Construction
Assessment District No. 1011.
In a memorandum dated December 7, 1993, Roger Hardgrave,
Director of Public Works/City Engineer, stated that a petition
was received from property owners requesting the formation of an
assessment district for the construction of a sewer main in the
Quail Canyon area. The assessment would include the construction
of sewers and appurtenant facilities, administrative costs and
the cost for the acquisition of easements. It is proposed that
the upfront construction costs be paid from the sewer
construction fund which would then be reimbursed through
assessments over a per iod of ten years. The total cost of
construction and incidental expenses is estimated at $130,584,

with each parcel assessed equally. The first year's assessment
is estimated to be $4,352.80 for each of the six parcels, which
includes interest on the unpaid balance. The assessments would
then decrease each year as the balance is reduced. On November
15, 1993, Resolution of Intention No. 93-417 was adopted and the
Engineer's report on file in the Office of the City Clerk was
accepted.
In a letter dated December 2, 1993, Robert Longmire, 1420
Quail Court, San Bernardino, California, protested against the
formation of Quail Canyon Area Sewer Construction District No.
1011, and requested that the public hearing be continued to
January 24, 1994.
In a letter dated December 1, 1993, Lois H. Bennett, 1394
Quail Hollow Road, San Bernardino, California, protested against
the formation of the proposed assessment district.
In a letter dated December 17, 1993, Nicholas & patricia

In a memorandum dated December 15, 1993, Mayor Minor stated
that in 1983, the County and City of San Bernardino entered into
a joint exercise of powers agreement to create the Authority for
a Greater San Bernardino. The authority was created to provide
an institutional structure separate from the County and City
which would involve public and private sector representatives in
the coordination of planning and development of the downtown
area to create a vital and pleasing environment for the growth of
the public and private community and the enjoyment and
convenience of residents and visitors. The agreement stipulates
that the commission would be called the "Greater San Bernardino
Commission" and establishes that three individuals be appointed
by the Common Council of the city of San Bernardino.

In a memorandum dated December 20, 1993, Mayor Minor stated
that the Inland Empire Symphony has requested financial
assistance, not-to-exceed $10,000, for its presentation of "Mark
0' Connor's Violin Concerto", on Saturday, January 29, 1994, at
8:00 p.m., at the California Theatre. Mr. O'Connor has won
countless grammy awards and has been the Country Music
Association's "Musician of the Year" for the past three years.
He has composed a concerto for violin and orchestra which would
receive its West Coast debut with the Inland Empire symphony.
The performance would be produced locally by Bob Harvey, a well-
known media personality, Country Connection, which is in over 80
markets across the country. Key markets include Nashville,

Miami, Philadelphia, Detroit, New Orleans, Las Vegas, Sacramento
and San Francisco. The program reaches an estimated 100 million
households, and is carried on most cable and variable-high
frequency stations. It is now entering its fourth year and is
growing rapidly into one of the most popular shows on the public
broadcasting service. For this production, the Inland Empire
Symphony would be called the "San Bernardino Symphony" (with the
intent that they would eventually make this a permanent name
change), and the city would be listed as a primary sponsor during
the program.

provided a synopsis of the events associated with the co-
sponsorship of the violin concerto, and explained that the
symphony would be identifying themselves as the San Bernardino
Symphony.

At 4:20 p.m., Chairman Minor called the regular meeting of
the Community Development Commission to order in the Council
Chambers of City Hall, 300 North "D" Street, San Bernardino,

In a memorandum dated December 17, 1993, Timothy Steinhaus,
Agency Administrator, Economic Development Agency, stated that
in a memorandum dated December 16, 1993, Council Member Hernandez
requested that the Mayor and Council direct the City Attorney's
Office to prepare an amendment to the Mobile Home Park Rent
Stabilization ordinance to require mobile home parks to inform
the Mobile Home Board within twenty-four (24) hours of any new
rental agreements signed by the park.
council Member Oberhelman made a motion, seconded by Council
Member Hernandez, and unanimously carried, that the Mayor and
Common Council direct the City Attorney's Office to prepare an
amendment to the Mobile Home Park Rent Stabilization ordinance
which requires mobile home parks to inform the Mobile Home Board
within twenty-four (24) hours of any new rental agreement signed
by the park; and that the matter be brought back to the meeting
of January 10, 1994, in the Council Chambers of city Hall, 300
North "D" Street, San Bernardino, California.
COUNCIL MEMBER MILLER EXCUSED
At 6:45 p.m., Council Member Miller left the Council
meeting.
