The City Clerk has caused to be posted the order of adjournment of said meeting held on Monday, August 2, 1993, and has on file in the office of the City Clerk an affidavit of said posting together with a copy of said order which was posted at 3:30 p.m., Tuesday, August 3, 1993, on the door of the place at which said meeting was held. The joint adjourned regular meeting of the Mayor and Common Council and the Community Development Commission of the City of San Bernardino was called to order by Mayor Minor at 9:03 a.m., Monday, August 9, 1993, in the Economic Development Agency, Board Room, 201 North "E" Street, San Bernardino, California. ROLL CALL Roll call was taken by Deputy city Clerk Vale with the following being present: Mayor Minor; Council Members Negrete, curlin, Hernandez, Oberhelman, Pope-LUdlam; Deputy city Attorney Empeno, Deputy City Clerk Vale, City Administrator Shauna Clark. Absent: Council Member Miller. * Fifth Ward Office Vacant WORKSHOP DEVELOPMENT CODE REVISION PROGRAM- DISCUSSED LATER IN THE MEETING - SEE PAGE 4 (2) In a memorandum dated August 5, 1993, Al Boughey, Director of Planning and Building Services, stated that in December of 1992, staff was authorized to proceed with a phased revision program of the Development Code. Staff is working with Bruce Jacobson of Jacobson and Wack to prepare the revisions, and with Tom Dodson to complete the environmental review. This workshop has been scheduled to outline the proposed Development Code revision program, and highlight the specific changes recommended 1 8/9/93 in Phase One. Planning commission members, and representatives from the development community, have been invited to attend and participate. Al Boughey, Director of Planning and Building Services, explained that there are two documents that govern development in the city. The first is the General Plan which is a long-term policy document that deals with issues such as housing, historic preservation, land use, traffic circulation, and quality of life. He explained that the second document governing development in the City is the Development Code. The Development Code is a regulatory document that defines land uses and stipulates development requirements in conjunction with the state Uniform Building Code. The Development Code implements the policy issues outlined in the General Plan. The Development Code is easy to use, read and understand; contains all development standards in one document; and uses graphics and definitions to explain the development requirements. Director Boughey explained that the problems with the Development Code are: 1) its reliance on the Standard Industrial Classification Code (SIC) which does not work for permitting land uses; 2) there are too many Conditional Use Permits (CUP) required; 3) there is not sufficient differentiation between new development standards, and standards for the reuse of existing buildings; and 4) the sign standards are too restrictive. Standard Industrial Classification Code The Standard Industrial Classification Code (SIC) is the federal accounting system. SIC was not designed to be utilized for land use purposes, and has caused significant problems for staff since its inclusion in the Development Code. SIC will be replaced with a more traditional approach to land use definition. Conditional Use Permits - The Development Code frequently requires a Conditional Use Permit (CUP) which staff believes is an impediment to development. The requirements to obtain a CUP will be reviewed to determine if a CUP is appropriate or if a Development Permit would be a better and more efficient utilization of staff resources, and would expedite the development approval process. New Development vs. Existinq Development Reuse The Development Code does not differentiate between new development standards, and development standards for existing facilities that are being rehabilitated for reuse, thereby imposing an undue burden on developers by requiring the same development standards for new and existing facilities. Siqn Standards - The sign standards in the Development Code are too limiting and need to be more flexible and responsive to 2 8/9/93 the signage needs within the community. Mr. Boughey explained the three phases of the Development Code review program. Phase One - Includes: 1) a major overhaul of permitted land use tables relative to commercial and industrial land use designations/zones; 2) a review of the need for a Conditional Use Permit versus a Development Permit; and 3) includes miscellaneous changes and clarifications. Phase Two - Includes: 1) the elimination of unnecessary processing requirements with an emphasis on the reuse of existing structures; and 2) a review of the role of the Development Review committee (DRC). Phase Three - Includes: 1) a review of the sign standards; and 2) a review of any additional items that are identified as concerns during the first two phases of the revision program. Bruce Jacobson, Jacobson and Wack, P.O. Box 70511, Bakersfield, CA, expressed support for eliminating the Standardized Industrial Classification Code from the Development Code in Phase One. To replace SIC, staff will be developing a land use activity listing that will be user friendly, understandable, and allow for more land use activities that could potentially spur development. The revised land use listing would be more generic in nature with descriptive categories that would list allowable land use activities, and an appropriate example. Also, there will be a review of the Conditional Use Permit (CUP) versus Development Permit (DP) requirements. A CUP is an indicator that there is an issue of compatibility with location, and should be individually reviewed by staff. A DP presumes that the use on that location is appropriate, and the concern of staff would be to obtain the best design, layout, and most efficient use of the property. Mr. Jacobson and Mr. Boughey answered questions regarding the proposed Phase One revisions. Discussion ensued regarding the following issues: the notification procedures for projects that are adjacent to residential land uses, schools and churches; the inability to reuse older buildings due to stringent Development Code requirements; and the need to streamline the CUP process when necessary. Concern was expressed regarding the proliferation of outdoor displays that are a visual blight on the community, the need for more aggressive code enforcement, and the need to retain a Conditional Use Permit requirement for businesses that sell alcoholic beverages. Support was expressed for making the 3 8/9/93 Development Code more flexible to encourage the reuse of older buildings. Director Boughey stated that the concerns regarding visual blight, and the reuse of older buildings would be reviewed. A discussion was held regarding the proposed changes to the sign standards; and the need to demolish older buildings that cannot be rehabilitated and pose a threat to public safety due to their dilapidated condition. Absent: Council Member Miller. * Fifth Ward Office Vacant WORKSHOP DEVELOPMENT CODE REVISION PROGRAM- DISCUSSED EARLIER IN THE MEETING - SEE PAGE 1 (2) Gil Lara, 500 East Country Club Road, San Bernardino, CA, recommended that an incentive program be established to encourage the rehabilitation and development of older buildings. Sherry Gray, a commercial landlord of 245,000 square feet in the area bounded by Arrowhead Avenue, Waterman Avenue, Rialto Avenue, and Orange Show Road, expressed support for the proposed Development Code revisions. Ken Hynes, Architect, expressed support for the proposed Development Code revisions. Paul Toomey, Planning Consultant, 34636 County Line Road, Suite #31, Yucaipa, CA, urged caution in reducing the need for Conditional Use Permits, and allowing for Development Permits, to avoid any negative development impact. James wirth, 1980 North Sierra Way, San Bernardino, CA, urged that public hearings be conducted to allow pUblic comments to be heard on the proposed Development Code revisions. Support was expressed for allowing urban gardens within the city. A discussion was held regarding when the Development Code revision program would be completed. Mr. Boughey explained that the review process would include: 1) informal meetings; 2) meetings with City Departments impacted by development projects; 3) meetings with the development community; 4) Planning Commission review; and 5) workshops and public hearings with the Mayor and Common Council.
