HomeMy WebLinkAbout06-28-1995 Minutes MINUTES MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO ADJOURNED REGULAR MEETING JUNE 28 & 29, 1995 COUNCIL CHAMBERS This is the time and place set for an adjourned regular meeting of the Mayor and Common Council of the City of San Bernardino from the adjourned regular meeting held at 9:05 a.m., Monday, June 26, 1995, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. The City Clerk has caused to be posted the order of adjournment of said meeting held on Monday, June 26, 1995, and has on file in the Office of the City Clerk an affidavit of posting together with a copy of said order which was posted at 9:00 a.m., Tuesday, June 27, 1995, on the door of the place at which said meeting was held. The adjourned regular meeting of the Mayor and Common Council of the City of San Bernardino was called to order by Mayor Minor at 9:09 a.m., in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. ROLL CALL Roll call was taken by City Clerk Rachel Clark with the following being present: Mayor Minor; Council Members Negrete, Hernandez, Oberhelman, Devlin, Miller; Senior Assistant City Attorney Barlow; City Clerk Rachel Clark; City Administrator Shauna Clark. Absent: Council Members Curlin, Pope-Ludlam. FISCAL YEAR 1995/96 BUDGET DELIBERATIONS - CONTINUED FROM JUNE 26, 1995 - DISCUSSED LATER IN THE MEETING - SEE PAGE 3 (l) RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING AND ADOPTING AN INTERIM BUDGET OF SAID CITY FOR THE FISCAL YEAR 1995-1996 PENDING ADOPTION OF THE 1995-1996 FINAL BUDGET. (Introduced on June 28, 1995.) (Discussed later in the meeting) (See Page 3) (1) City Clerk Rachel Clark read the title of the resolution. This is the time and place continued to review the proposed fiscal year (FY) 1995/96 budget. City Attorney Penman submitted a document outlining the 1993 settlements and judgments for the east San Bernardino cities. 1 6/28/95 Thomas Salas, San Bernardino Musical Theatre, 5185 Hallmark Parkway, Suite 110, San Bernardino, CA, submitted a letter dated June 27, 1995, concerning the operation of Sturges Auditorium. City Administrator Shauna Clark explained that because of the sale of City-owned property to the Water Department in the amount of $190,000, the budget deficit has been reduced to $3,257,200. Barbara Pachon, Director of Finance, answered questions regarding the anticipated revenue for fiscal year 1995/96 and submitted a document outlining the concerns expressed at the Mayor and Common Council meeting of June 26, 1995. Discussion ensued regarding the anticipated revenue for fiscal year 1995/96. Mike Hays, Assistant Director of Planning & Building Services, answered questions regarding the anticipated fiscal year 1995/96 revenue for building permit fees. SENIOR ASSISTANT CITY ATTORNEY BARLOW EXCUSED At 9:39 a.m., Senior Assistant City Attorney Barlow left the Council meeting and was replaced by City Attorney Penman. A discussion was held concerning the funding of Sturges Auditorium. Council Member Miller made a motion, seconded by Council Member Negrete, that funding for Sturges Auditorium be referred to the Economic Development Agency and addressed at the Economic Development Agency hearings for the adoption of its FY 1995/96 budget. (Note: There was no vote taken.) It was noted that the previous action taken at the Mayor and Common Council meeting of June 26, 1995, was to continue the matter to July 10, 1995, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. Consequently, no further action was taken and the matter will be addressed on July 10, 1995. Jim Lorenz, 2737 Muscupiabe Drive, San Bernardino, CA, opposed the recommended budget cuts within the Animal Control Department and answered questions regarding the licensing of cats. A discussion was held regarding the proposed FY 1995/96 budget for the Animal Control Department and budget-balancing measures for FY 1995/96. COUNCIL MEMBER POPE-LUDLAM ARRIVED At 10:07 a.m., Council Member Pope-Ludlam arrived at the Council meeting and took her place at the council table. 2 6/28/95 Finance Director pachon answered questions concerning the funded liability reserve. A discussion ensued regarding the differences between the funded liability reserve versus an unappropriated reserve. It was noted that the City does not have an unappropriated reserve. Fred Wilson, Assistant City Administrator, eXplained the establishment and purpose of the "sinking fund." Discussion ensued regarding the refinancing of City Hall, liability revenues, workers compensation fund, whether or not the proposed furlough compensated through the General Fund. monies realized through the insurance fund, anticipated internal service funds and would affect employees not RECESS MEETING At 11:27 a.m., Mayor Minor declared a ten-minute recess. RECONVENE MEETING At 11:36 a.m., Mayor Minor reconvened the adjourned regular meeting of the Mayor and Common Council of the City of San Bernardino in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. ROLL CALL Roll call was taken by City Clerk Rachel Clark with the following being present: Mayor Minor; Council Members Negrete, Hernandez, Oberhelman, Devlin, Pope-Ludlam, Miller; City Attorney Penman; City Clerk Rachel Clark; City Administrator Shauna Clark. FISCAL YEAR 1995/96 BUDGET DELIBERATIONS - CONTINUED FROM JUNE 26, 1995 - DISCUSSED EARLIER IN THE MEETING - SEE PAGE 1 (1) RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING AND ADOPTING AN INTERIM BUDGET OF SAID CITY FOR THE FISCAL YEAR 1995-1996 PENDING ADOPTION OF THE 1995-1996 FINAL BUDGET. (Introduced on June 28, 1995.) (Discussed earlier in the meeting) (See Page 1) (1) This is the time and place continued from earlier in the meeting to review the proposed fiscal year (FY) 1995/96 budget. Discussion continued regarding the proposed fiscal year 1995/96 budget. Council Member Oberhelman made a motion, that full reading of the resolution be waived; that said resolution be adopted; and that the budget deliberations continue for fiscal year 1995/96. 3 6/28/95 The motion failed for lack of a second. A discussion was held regarding the feasibility of imposing a hiring freeze for all vacant positions except for those applicable to police, fire and dispatch. Council Member Oberhelman made a motion, seconded by Council Member Negrete, that full reading of the resolution be waived; that said resolution be adopted; and that a hiring freeze for all vacant positions except for those applicable to police, fire and dispatch be imposed until the adoption of a final budget for fiscal year 1995/96. (Note: There was no vote taken.) COUNCIL MEMBER HERNANDEZ EXCUSED At 11: 58 a. m., Council Member Hernandez left the Council meeting. A discussion was held concerning the proposed four percent (4%) budget-balancing measures. There was no further action taken at this time. RECESS MEETING - JUNE 28, 1995 At 12:06 p.m., it was the consensus of the Mayor and Common Council that the adjourned regular meeting of the Mayor and Common Council be recessed to 1:00 p.m., Thursday, June 29, 1995, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. RECONVENE MEETING - JUNE 29, 1995 At 1:05 p.m., Mayor Minor reconvened the recessed adjourned regular meeting of the Mayor and Common Council of the City of San Bernardino in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. Shauna Clark, City Administrator, submitted a memorandum dated June 28, 1995, concerning the progress of the budget discussions for the fiscal year 1995/96 budget. Fred memorandum reductions Wilson, Assistant City Administrator, submitted a dated June 29, 1995, concerning the proposed position to balance the fiscal year 1995/96 budget. City Attorney Penman submitted a memorandum dated June 29, 1995, concerning the liability fund. Barbara Dillon, Director of Personnel, submitted a memorandum dated June 29, 1995, concerning the savings realized through the downgrading of one Police Captain and three Sergeant positions and the establishment of four Police Officer positions. Timothy Sabo, Counsel for the Economic Development Agency, Sabo & Green, Attorneys at Law, 6320 Canoga Avenue, Suite 400, Woodland Hills, CA, provided a synopsis relative to the refinancing of City Hall. A discussion was held concerning the intent of the City Hall refinancing; workers compensation fund; liability reserve fund and the proposed fiscal year 1995/96 budget. RECESS MEETING At 1:51 p.m., Mayor Minor declared a five-minute recess. RECONVENE MEETING At 2:02 p.m., Mayor Minor reconvened the recessed adjourned regular meeting of the Mayor and Common Council of the City of San Bernardino in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. ROLL CALL Roll call was taken by City Clerk Rachel Clark with the following being present: Mayor Minor; Council Members Negrete, Hernandez, Oberhelman, Devlin, Pope-Ludlam, Miller; City Attorney Penman; City Clerk Rachel Clark; City Administrator Shauna Clark. Discussion continued regarding the proposed revenue and budget-balancing measures for fiscal year 1995/96. Council Member Negrete made a motion, that full reading of the resolution be waived; and that said resolution be adopted. The motion failed for lack of a second. Richard Lewis, 5328 Park Lane, San Bernardino, CA, expressed concern regarding the proposed reduction of personnel in order to meet the recommended four percent (4%) cutback. Discussion continued regarding the budget-balancing measures for the proposed fiscal year 1995/96 budget. Jim Howell, Acting Director of Public Services, answered questions regarding the funds allocated for the vehicle replacement program. Council Nays: It was the consensus of the Mayor and Council that a monthly report on the fiscal year 1995/96 budget be presented to the Ways & Means Committee. NOTE: Items two through eight (2-8) were addressed at the Mayor and Common Council meeting of June 26, 1995.
