The adjourned regular meeting of the Mayor and Common Council was called to order by Mayor Minor at 1:06 p.m., Monday, June 12, 1995, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. ROLL CALL Roll call was taken by City Clerk Rachel Clark with the following being present: Mayor Minor; Council Members Negrete, Curlin, Hernandez, Oberhelman, Devlin, Miller; Deputy City Attorney Empeno, City Clerk Rachel Clark, Planning and Building Services Director Boughey. Absent: Council Member Pope-Ludlam. APPEAL PLANNING INTERMODAL FACILITY 93-01 - DEVELOPMENT COMMISSION'S APPROVAL SANTA FE EXPANSION PROJECT - DEMOLITION NO. PERMIT II NO. 94-24 (1) This is the time and place set for a public hearing to consider an appeal of the Planning Commission's approval of Demolition No. 93-01, Development Permit II No. 94-24, for the proposed Santa Fe Intermodal Facility Expansion Project. Al Boughey, Director of Planning and Building Services, submitted a Staff Report dated May 31, 1995, and memoranda dated May 25, and June 9, 1995, respectively, relative to the proposed expansion of the Santa Fe Intermodal Facility, located on the property south of Fifth Street between Mount Vernon Avenue and the 1-215 Freeway. Mayor Minor opened the hearing. 1 6/12/95 Discussion ensued regarding the provisions 93-01 and Development Permit II No. 94-24 expansion of Santa Fe's Intermodal Facility. of Demolition No. for the proposed COUNCIL MEMBER At 1:13 p.m., Council meeting and POPE-LUDLAM ARRIVED Council Member Pope-Ludlam took her place at the council arrived table. at the Mark Ostoich, Gresham, Varner, Savage, Nolan and Tilden, 600 N. Arrowhead Ave., Suite #300, San Bernardino, CA, representing the Atchison, Topeka and Santa Fe Railway Company, 740 E. Carnegie Dr., San Bernardino, CA, answered questions relative to the proposed expansion of the intermodal facility. James Wirth, 1980 N. Sierra Way, San Bernardino, CA, voiced opposition to the proposed demolition of historical structures located on the Santa Fe property. Mr. Wirth submitted for the record audio and video tapes, and other documents supporting his position on this matter. Mayor Minor read for the record a letter, dated February 16, 1994, from James Wirth, Wirthwhile Developments, 1980 N. Sierra Way, San Bernardino, CA, expressing opposition to the proposed demolition of structures at Santa Fe's intermodal facility. Robert Brendza, Atchison, Topeka and Santa Fe Railway Company, 740 E. Carnegie Dr., San Bernardino, CA, answered questions relative to the proposed demolition and expansion of the intermodal facility. Mr. Brendza submitted a Re-Use Analysis dated April 1995 regarding the proposed expansion. Jeff Wright, P. O. Box 2341, San Bernardino, CA, voiced opposition to the proposed demolition of these structures. City Clerk Rachel Clark read for the record a letter, dated June 11, 1995, from Eleanor Starke, P. O. Box 648, Yuba City, CA, stating opposition to the proposed demolition of these structures. Discussion ensued regarding the proposed expansion, and how any potential negative impacts to the community would be mitigated. READING OF RESOLUTION Mayor Minor read the title of the resolution. RES. 95-187 - RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO CERTIFYING THE ENVIRONMENTAL IMPACT REPORT; ADOPTING THE FINDINGS AND STATEMENTS OF OVERRIDING CONSIDERATION; ADOPTING THE MITIGATION MONITORING/REPORTING PROGRAM; AND APPROVING THE SANTA FE INTERMODAL FACILITY EXPANSION PROJECT (DEVELOPMENT PERMIT II NO. 94-24/DEMOLITION NO. 93-01) (1) 2 6/12/95 Council Member Oberhelman made a motion, seconded by Council Member Devlin, and unanimously carried, that the hearing be closed. Tom Dodson, Dodson & Associates, Environmental Consultant, 444 N. Arrowhead Ave., Suite #203, San Bernardino, CA, explained the measures that would be utilized to mitigate any negative impacts to the community. Council Member Devlin made a mction, seconded by Council Member Negrete, that the appeal be denied; that further reading of said resolution be waived; that said resolution that certifies the Environmental Impact Report be adopted; that the Findings and Statements of Overriding Consideration and Mitigation Monitoring/Reporting Program be adopted; and that Demolition No. 93-01 and Development Permit II No. 94-24, be approved. The motion carried, and Resolution No. 95-187 was adopted by the following vote: Ayes: Council Members Negrete, Curlin, Hernandez, Oberhelman, Devlin, Pope-Ludlam, Miller. Nays: None. Absent: None. PLANNING & BUILDING SERVICES DIRECTOR BOUGHEY EXCUSED At 1:57 p.m., Al Boughey, Director of Planning and Building Services, left the Council meeting and was replaced by City Administrator Shauna Clark. WAIVE FEES $2,200 NATIONAL ASSOCIATION FOR THE ADVANCEMENT OF COLORED PEOPLE (NAACP) FAMILY DAY - SECCOMBE LAKE PARK - JUNE 17, 1995 (51) Council Member Pope-Ludlam submitted a Staff Report dated June 7, 1995, requesting that fees in the amount of $2,200 be waived for the National Association for the Advancement of Colored People (NAACP) Family Day to be held at Seccombe Lake Park on June 17, 1995. Council Member Pope-Ludlam made a motion, seconded by Council Member Negrete, and unanimously carried, that the request for waiver of fees in the amount of $2,200 for the National Association for the Advancement of Colored People Family Day for use of Seccombe Lake Park on June 17, 1995, be approved. FIRE DEPARTMENT MANAGEMENT AUDIT REPORT - CONTINUED FROM MAY 15, 1995 (3) This is the time and place continued to for consideration of the Fire Department Management Audit Report. Mayor Minor announced that this matter would be discussed at a later date when the Fire Department's budget is presented. 3 6/12/95 FISCAL YEAR 1995/96 BUDGET REVIEW - DISCUSSED LATER IN THE MEETING (2) Shauna Clark, City Administrator, submitted the Proposed Budget Reduction document dated June 9, 1995; and memoranda dated June 9, 1995, relative to the City's revenue base and utility tax; and dated June 12, 1995, regarding the City's revenue source comparison. Barbara Pachon, Director of Finance, submitted Memoranda dated April 5, 1995, relative to furlough days costing; and dated June 12, 1995, regarding fund balance projections. John O'Sullivan, Municipal Resource Consultants (MRC) , 1381 Warner, Suite F, Tustin, CA, presented a synopsis of the past and existing economic conditions impacting cities that are causing cities to change their fiscal policies and how the day-to-day activities of the City are managed. DEPUTY CITY ATTORNEY EMPENO EXCUSED At 2:00 p.m., Deputy City Attorney Empeno left the Council meeting and was replaced by Senior Assistant City Attorney Barlow. Discussion ensued regarding the positive and negative issues impacting the financial condition and outlook for the City. RECESS MEETING At 2:59 p.m., Mayor Minor declared a ten-minute recess. RECONVENE MEETING At 3:15 p.m., Mayor Minor reconvened the adjourned regular meeting of the Mayor and Common Council of the City of San Bernardino in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. ROLL CALL Roll call was taken by City Clerk Rachel Clark with the following being present: Mayor Minor; Council Members Negrete, Hernandez, Oberhelman, Devlin, Pope-Ludlam, Miller; Senior Assistant City Attorney Barlow, City Clerk Rachel Clark, City Administrator Shauna Clark. Absent: Council Member Curlin. FISCAL YEAR 1995/96 BUDGET REVIEW - DISCUSSED EARLIER & LATER IN THE MEETING (2) Fred Wilson, Assistant City overview of the projected revenue Fiscal Year 1995/96. Box 2341, San Bernardino, CA, expressed concern regarding the video equipment that is proposed to be purchased by the Public Services Department. Presentation - Animal Control Department Debi Biggs, Director of Animal Cont rol, presented the proposed Fiscal Year 1995/96 budget for the Animal Control Department, including the recommendations for the proposed four percent (4%) budget reduction; and answered questions relative to the proposed budget. A discussion was held regarding the Animal Department's proposed Fiscal Year 1995/96 budget. Control There was no further action taken on this matter at this time. It was the consensus of the Mayor and Common Council that the review of the Fiscal Year 1995/96 budget be continued to June 13, 1995, in the Council Chambers of City Hall, 300 North nD" Street, San Bernardino, California. REQUEST TO RESTORE FUNDING - TWO INVESTIGATOR POSITIONS - CITY ATTORNEY'S OFFICE - FISCAL YEARS 1994/95 & 1995/96 - CONTINUED FROM MAY 22, 1995 (4) It was the consensus of the Mayor and Common Council that this matter be taken in conjunction with the City Attorney's Office proposed Fiscal Year 1995/96 budget. RECESS MEETING - JUNE 12, 1995 At 4: 45 p. m., it was the consensus of the Mayor and Common Council that the adjourned regular meeting of the Mayor and Common Council be recessed to 8:00 a.m., Tuesday, June 13, 1995, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. RECONVENE MEETING - JUNE 13, 1995 At 8:03 a.m., Mayor Minor reconvened the recessed adjourned regular meeting of the Mayor and Common Council of the City of San Bernardino in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. 5 6/12/95 ROLL CALL Roll call was taken by City Clerk Rachel Clark with the following being present: Mayor Minor; Council Members Negrete, Hernandez, Oberhelman, Devlin; Senior Assistant City Attorney Morillo, City Clerk Rachel Clark, City Administrator Shauna Clark. FISCAL YEAR 1995/96 BUDGET REVIEW - PREVIOUSLY DISCUSSED ON JUNE 12, 1995 - (2) Barbara pachon, Director of Finance, submitted a memorandum dated June 13, 1995, relative to the Fiscal Year 1994/95 expense budget. Presentation - Telecommunications Division Frank Keller, CATV Manager, Telecommunications Division, presented an overview of the proposed Telecommunications Division budget for Fiscal Year 1995/96, including the four percent (4%) departmental budget cuts; and answered questions relative to the recommendations. Discussion ensued regarding the proposed Telecommunications Division's proposed Fiscal Year 1995/96 budget. COUNCIL MEMBER MILLER ARRIVED At 8:11 a.m., Council Member Miller arrived at the Council meeting and took her place at the council table. Presentation - cemeterv Department Dan Ustation, Cemetery Superintendent, presented a summary of the Cemetery Department's proposed budget for Fiscal Year 1995/96, including the proposed four percent (4%) budget reductions, and a recommendation to increase burial fees to generate additional revenue. Discussion ensued regarding local cemetery rates and the feasibility of selling the cemetery. Presentation - City Administrator's Office Shauna Clark, City Administrator, presented an overview of the City Administrator's proposed budget for Fiscal Year 1995/96, including how to meet the four percent (4%) funding reductions; and answered questions regarding the proposed recommendations. SENIOR ASSISTANT CITY ATTORNEY MORILLO EXCUSED At 8:45 a.m., Senior Assistant City Attorney Morillo left the Council meeting and was replaced by City Attorney Penman. A discussion was held regarding the City Administrator's Office proposed Fiscal Year 1995/96 budget. 6 6/13/95 Presentation - City Attorney's Office City Attorney Penman submitted a memorandum dated May 30, 1995, presenting the proposed Fiscal Year 1995/96 budget for the City Attorney's Office. City Attorney Penman stated that although there was still a dispute with the Finance Department regarding the total budget allocation for the office; he anticipated returning to the Mayor and Common Council on Thursday, June 15, 1995, with a restructured budget, which would save a larger amount. Consequently, the City Attorney's Office budget was not presented at this time. RECESS MEETING At 9:00 a.m., Mayor Minor declared a five-minute recess. RECONVENE MEETING At 9:11 a.m., Mayor Minor reconvened the recessed adjourned regular meeting of the Mayor and Common Council of the City of San Bernardino in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. FISCAL YEAR 1995/96 BUDGET REVIEW - DISCUSSED EARLIER IN THE MEETING (2) Presentation - City Clerk's Office Rachel Clark, City Clerk, presented a 12, 1995, clarifying the proposed budget Office. memorandum dated June for the City Clerk's Rachel Clark, City Clerk, presented an overview of the proposed budget recommendations for Fiscal Year 1995/96, and the proposed four percent cuts, and stated that the City Clerk's Office performs duties that are mandated by either the City Charter, City Municipal Code, or State and Federal laws. COUNCIL MEMBER At 9:27 a.m., Council meeting and POPE-LUDLAM ARRIVED Council Member Pope-Ludlam took her place at the council arrived table. at the Discussion ensued regarding layoffs versus elimination of existing vacancies, employee furloughs, and the fact that cutting employees does equate to cutting services. It was noted that revenues are increasing, but so is inflation and the cost of dealing with major social problems. 7 6/13/95 SENIOR ASSISTANT CITY ATTORNEY MORILLO EXCUSED At 9:40 a.m., Senior Assistant City Attorney Morillo left the Council meeting and was replaced by City Attorney Penman. Discussion ensued regarding funded and unfunded liability and the City's existing reserve funds. RECESS MEETING At 10:30 a.m., Mayor Minor declared a five-minute recess. RECONVENE MEETING At 10:38 a.m., Mayor Minor reconvened the recessed adjourned regular meeting of the Mayor and Common Council of the City of San Bernardino in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. ROLL CALL Roll call was taken by City Clerk Rachel Clark with the following being present: Mayor Minor; Council Members Negrete, Hernandez, Oberhelman, Devlin, Pope-Ludlam, Miller; Senior Assistant City Attorney Morillo, City Clerk Rachel Clark, City Administrator Shauna Clark. Absent: Council Member Curlin. FISCAL YEAR 1995/96 BUDGET REVIEW - DISCUSSED EARLIER IN THE MEETING (2) Presentation - Civil Service Department Doug Chandler, Chief Examiner, Civil Service, presented the proposed Fiscal Year 1995/96 budget, including recommendations for how to reduce departmental expenditures by four percent (4%); and answered questions regarding the proposed recommendations. Presentation - Council Office Phil Arvizo, Executive Assistant to the Council, presented an overview of the proposed Council Office budget for Fiscal Year 1995/96; and stated that no cuts were being proposed. Discussion ensued regarding the need to replace the Council Office vehicle, as well as the need for more support personnel. It was the consensus of the Council that priority be given to replacing the Council Office vehicle and pursuing the establishment of an additional position within the Council Office. Presentation - Facilities Manaqement Division James Sharer, Facilities Manager, provided a synopsis of the Facilities Management proposed budget for Fiscal Year 1995/96, including steps to reduce overall departmental expenditures by four percent (4%); and answered questions regarding the proposed recommendations. 8 6/13/95 Presentation - Finance Department Barbara Pachon, Director of Finance, outlined the Finance Department's proposed budget recommendations for Fiscal Year 1995/96; to include a four percent (4%) funding reduction for the department. Louis Greco, 2504 Kern St., San Bernardino, CA, representing the Senior Council, requested that the Council consider the needs of the senior citizens as they make their budget decisions and recommendations. There was no action taken on this matter during this meeting. ANNOUNCEMENT - MAYOR MINOR Mayor Minor stated that he would be leaving to attend a Conference of Mayors' Seminar, and requested that the Common Council postpone making final budget decisions until his return. It was the consensus of the Mayor and Common Council that the review of the proposed Fiscal Year 1995/96 budget be continued to June 15, 1995, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. ADJOURNMENT (5) At 11:38 a.m., Mayor Minor adjourned the meeting to 8:00 a.m., Thursday, June 15, 1995, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California.
