COUNCIL CHAMBERS
The regular meeting of the Mayor and Common Council of the
City of San Bernardino was called to order by Mayor Minor at 8:03
a.m., Monday, June 5, 1995, in the Council Chambers of City Hall,
300 North "D" Street, San Bernardino, California.
ROLL CALL
Roll call was taken by City Clerk Rachel Clark with the
following being present: Mayor Minor; Council Members Negrete,
Curlin, Hernandez, Oberhelman, Devlin, Miller; City Attorney
Penman; City Clerk Rachel Clark; City Administrator Shauna Clark.
Absent: Council Member Pope-Ludlam.

Deputy City Clerk Cordova read the titles of all the
resolutions and ordinances on the regular and supplemental agenda
of the Mayor and Common Council and Community Development
Commission/San Bernardino Joint Powers Financing Authority agendas
while the Council was in closed session.

introduced Claudia Erickson, Health Education Specialist, T.E.A.M.
Program, County of San Bernardino, Department of Public Health, 351
N. Mt. View Avenue, San Bernardino, CA. Ms. Erickson introduced
Christina Valdes, Student, Golden Valley Middle School, who
together with other team members reported on the T.E.A.M. Power
Youth Summit held on May 13, 1995, at California State University,
San Bernardino; and encouraged open lines of communication with
youth and government officials.
Event t-shirts were presented to the Mayor and Common Council.

ARROWHEAD - CALIFORNIA THEATER - MAY 18, 1995

J. Lorraine Velarde, Executive Assistant to the Mayor, read a
resolution commending Heather McCluskey for her role in writing the
music and co-authoring the lyrics for the musical comedy, Legend of
the Arrowhead, which premiered at the California Theater on May 18,
1995.
Ms. McCluskey accepted the commendation.

Council Member Miller expressed appreciation for the music
festival held at Court Street Square on June 2, 3 and 4, 1995,
sponsored by Main Street, Inc., Economic Development Agency.
ANNOUNCEMENT - CITY CLERK RACHEL CLARK

City Clerk Rachel Clark shared a story about an employee's
(Regina Elliott) daughter, Kristen Elliott, who willingly offered
to donate her bicycle for the silent police auction to raise money
for the construction of a police memorial to be placed in front of
the new police facility. Mrs. Clark encouraged the public to
donate items for the silent auction and funds for the construction
of the police memorial.

City Attorney Penman explained that pursuant to California
Government Code Section 54954.2.a, brief comments could be made in
response to public comments; however, a lengthy discussion is not
advised.
PUBLIC COMMENTS - RUBEN LOPEZ

Ruben Lopez, 631 W. 16th Street, San Bernardino, CA, expressed
concern regarding the manner in which the four minority council
members vote upon certain projects which come before the Mayor and
Council.
PUBLIC COMMENTS - JEFF WRIGHT

Jeff Wright, P. O. Box 2341, San Bernardino, CA, expressed
concern regarding the actions taken against him by the Mayor and
Council to prohibit his presence within City Hall and to restrict
his ability to speak at the various City meetings.

Mayor Minor and Council Member Pope-Ludlam presented Michael
Townsend with a street sign named in honor of his father, Art
Townsend.
Michael Townsend accepted the sign and expressed his
appreciation.

City Attorney Penman clarified concerns expressed by a member
of the council relative to refuse haulers.

payroll and authorization to issue warrants as listed on the
memorandum dated May 25, 1995, from the Director of Finance be

submitted a Staff Report dated May 15, 1995, concerning Phase IV of
the installation of the northwest intercepting sewer, from Medical
Center Drive and 16th Street to California and Porter Streets.
Council Member Oberhelman made a motion, seconded by Council
Member Devlin, and unanimously carried, that the transfer of
$497,000 from Account No. 245-365-5504-1526, "Phase I - Northwest
Intercepting Sewer," to Account No. 245-365-5504-1529, "Phase IV -
Northwest Intercepting Sewer, n be approved; that the plans for
installation of Phase IV of the northwest intercepting sewer, from
Medical Center Drive and 16th Street to California and Porter
Streets, in accordance with Plan No. 9195, be approved; and that
the Director of Public Works/City Engineer be authorized to

submitted a Staff Report dated May 16, 1995, concerning the
application of slurry seal on various City streets.
Director Hardgrave answered questions regarding the selection
of streets and the application of the slurry seal.
The Council requested that they be provided with a list of
streets in which the work is to be performed.

Member Oberhelman, and unanimously carried, that the plans for
application of slurry seal on various streets, in accordance with
Plan No. 9302 be approved; and that the Director of Public
Works/City Engineer be authorized to advertise for bids.
RES. 95-171 - RESOLUTION OF THE CITY OF SAN BERNARDINO
FINDING AND DETERMINING THAT THE PUBLIC CONVENIENCE AND
NECESSITY REQUIRE THE AMENDMENT OF BOUNDARIES OF
ASSESSMENT DISTRICT NO. 952 ZONE 3 BY EXPANDING THE
BOUNDARIES THEREOF TO INCLUDE ADDITIONAL TERRITORY IN THE

AWARDING A CONTRACT TO DE LA CRUZ CONSTRUCTION, INC. FOR
INSTALLATION OF STREET LIGHTS AT VARIOUS LOCATIONS. (25)
Council Member Oberhelman made a motion, seconded by Council
Member Hernandez, that the transfer of $8,621, from Account No.
257-601-5151, "Electric Charges," to Account No. 257-601-5706,
"Alterations & Renovations," be approved; that said resolution be
adopted; and that Change Order No. One to the contract with De La
Cruz Construction, Inc., for installation of street lights at
various locations, in accordance with Plan No. 9245, be approved;
that the contractor be directed to install an additional street
light on Mt. Vernon Avenue at the entrance to San Bernardino Valley
college.

Council Member Pope-Ludlam submitted a Staff Report dated May
23, 1995, requesting a review of the City's off-site sign policy.
Council Member Pope-Ludlam made a motion, seconded by Council
Member Hernandez, that the Mayor and Common Council direct staff
and the Legislative Review Committee to review the City's off-site
sign policy. (Note: There was no vote taken.)
Discussion ensued regarding the previous action taken to
review the City's off-site sign policy.
Al Boughey, Director of Planning & Building Services,
explained the actions taken by the Citizens Advisory Committee to
adopt the City's General Plan and the actions taken to review the
off-site sign policy.
Peggy Ducey, Assistant to the City Administrator, explained
that staff does not object to reviewing the off-site sign policy;
however, the Council had previously taken action to deny the review
of the policy. Therefore, without formal action from the Mayor and
Council to the contrary, it would be difficult to initiate a
review.
Jeff Wright, P. O. Box 2341, San Bernardino, CA, inquired
about the city-wide application of the policy.
Discussion continued regarding the need to review the City's
off-site sign policy.
Council Member Devlin made a substitute motion that the matter
be tabled.
The substitute motion failed for lack of a second.

relative to the Junior Police Academy at Lytle Creek Elementary
School.
It was noted that funds for the Junior Police Academy had
previously been allocated from the asset forfeiture fund; however,
the funds are no longer available.
A discussion was held regarding the allocation of funds.
