ROLL CALL Roll call was taken by City Clerk Rachel Clark with the following being present: Mayor Minor; Council Members Negrete, Curlin, Hernandez, Oberhelman, Devlin, Miller; City Attorney Penman; City Clerk Rachel Clark; City Administrator Shauna Clark. Absent: Council Member Pope-Ludlam. RECESS MEETING - CLOSED SESSION At 8:03 a.m., the Mayor and Common session for the following: (1) Council recessed to closed 1. Also present: Assistant City Administrator Wilson, Senior Deputy City Attorney Simmons and Margaret Scroggin, Administrative Operations Supervisor, City Attorney's Office. READING OF RESOLUTIONS & ORDINANCES Deputy City Clerk Cordova read the titles of all the resolutions and ordinances on the regular and supplemental agenda of the Mayor and Common Council and Community Development Commission/San Bernardino Joint Powers Financing Authority agendas while the Council was in closed session. ADMINISTRATIVE OPERATIONS SUPERVISOR SCROGGIN EXCUSED At 8: 18 a. m, Margaret Scroggin, Administrative Operations Supervisor, City Attorney's Office, left the closed session. COUNCIL MEMBER POPE-LUDLAM ARRIVED At 8:19 a.m., Council Member Pope-Ludlam arrived at the closed session. ROLL CALL Roll call was taken by City Clerk Rachel Clark with the following being present: Mayor Minor; Council Members Negrete, Hernandez, Oberhelman, Devlin, Pope-Ludlam, Miller; City Attorney Penman; City Clerk Rachel Clark; City Administrator Shauna Clark. Absent: Council Member Curlin. INVOCATION The invocation was given by Dr. Kendall Clark Baker, First Congregational United Church. SUMMIT 1995 - MAY 13, 1995 - YOUTH REPORT - MIDDLE SCHOOL POWER YOUTH GOLDEN VALLEY (2) J. Lorraine Velarde, Executive Assistant to the Mayor, introduced Claudia Erickson, Health Education Specialist, T.E.A.M. Program, County of San Bernardino, Department of Public Health, 351 N. Mt. View Avenue, San Bernardino, CA. Ms. Erickson introduced Christina Valdes, Student, Golden Valley Middle School, who together with other team members reported on the T.E.A.M. Power Youth Summit held on May 13, 1995, at California State University, San Bernardino; and encouraged open lines of communication with youth and government officials. Event t-shirts were presented to the Mayor and Common Council. COMMENDATION HEATHER MC CLUSKEY LEGEND ARROWHEAD - CALIFORNIA THEATER - MAY 18, 1995 OF THE (2A) J. Lorraine Velarde, Executive Assistant to the Mayor, read a resolution commending Heather McCluskey for her role in writing the music and co-authoring the lyrics for the musical comedy, Legend of the Arrowhead, which premiered at the California Theater on May 18, 1995. Ms. McCluskey accepted the commendation. COUNCIL MEMBER CURLIN RETURNED At 9:11 a.m., Council Member Curlin meeting and took his place at the council returned to the Council table. ANNOUNCEMENT - COUNCIL MEMBER OBERHELMAN (3B) Council Member Oberhelman stated that through the businesses and cultural events made available within the City, it is evident that the Mayor and Council have taken great strides in providing a strong economic base. 3 6/5/95 ANNOUNCEMENT - COUNCIL MEMBER MILLER (3c) Council Member Miller expressed appreciation for the music festival held at Court Street Square on June 2, 3 and 4, 1995, sponsored by Main Street, Inc., Economic Development Agency. ANNOUNCEMENT - CITY CLERK RACHEL CLARK (3D) City Clerk Rachel Clark shared a story about an employee's (Regina Elliott) daughter, Kristen Elliott, who willingly offered to donate her bicycle for the silent police auction to raise money for the construction of a police memorial to be placed in front of the new police facility. Mrs. Clark encouraged the public to donate items for the silent auction and funds for the construction of the police memorial. ANNOUNCEMENT - CITY ATTORNEY PENMAN (3E) City Attorney Penman explained that pursuant to California Government Code Section 54954.2.a, brief comments could be made in response to public comments; however, a lengthy discussion is not advised. PUBLIC COMMENTS - RUBEN LOPEZ (4) Ruben Lopez, 631 W. 16th Street, San Bernardino, CA, expressed concern regarding the manner in which the four minority council members vote upon certain projects which come before the Mayor and Council. PUBLIC COMMENTS - JEFF WRIGHT (4A) Jeff Wright, P. O. Box 2341, San Bernardino, CA, expressed concern regarding the actions taken against him by the Mayor and Council to prohibit his presence within City Hall and to restrict his ability to speak at the various City meetings. PRESENTATION - ART TOWNSEND STREET SIGN (2B) Mayor Minor and Council Member Pope-Ludlam presented Michael Townsend with a street sign named in honor of his father, Art Townsend. Michael Townsend accepted the sign and expressed his appreciation. ANNOUNCEMENT - CITY ATTORNEY PENMAN (3F) City Attorney Penman clarified concerns expressed by a member of the council relative to refuse haulers. 4 6/5/95 CLAIMS AND PAYROLL (11) Council Member Oberhelman made a motion, seconded by Council Member Negrete, and unanimously carried, that the claims and payroll and authorization to issue warrants as listed on the memorandum dated May 25, 1995, from the Director of Finance be approved. COUNCIL MEMBERS HERNANDEZ & POPE-LUDLAM EXCUSED At 9:38 a.m., Council Members Hernandez and Pope-Ludlam left the Council meeting. WAIVE FULL READING OF RESOLUTIONS & ORDINANCES (5) Jeff Wright, P. O. Box 2341, San Bernardino, CA, expressed opposition to waiving the full reading of the resolutions and ordinances. RES. 95-167 - RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE STATE OF CALIFORNIA DEPARTMENT OF TRANSPORTATION FOR THE DISPOSAL OF ANIMAL CARCASSES FROM STATE HIGHWAYS IN THE SAN BERNARDINO AREA. RES. 95-170 - RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE MANAGEMENT AND TRAINING CORPORATION, INLAND EMPIRE JOB CORPS CENTER AND ITS CORPS MEMBERS RELATING TO TRAINING RELATED WORK EXPERIENCE FOR STUDENTS. (10) Council Member Oberhelman made a motion, seconded by Council Member Devlin, that said resolution be adopted. PERSONNEL ACTIONS (12) Council Member Oberhelman made a motion, seconded by Council Member Devlin, and unanimously carried, that the personnel actions submitted by the Chief Examiner dated May 18, 1995, in accordance with Civil Service Rules and Personnel Policies adopted by the Mayor and Common Council of the City of San Bernardino, be approved and ratified; except for Personnel Actions Item No. Five. 6 6/5/95 ORD. Council Member Oberhelman made a motion, seconded by Council Member Devlin, and unanimously carried, that the transfer of $497,000 from Account No. 245-365-5504-1526, "Phase I - Northwest Intercepting Sewer," to Account No. 245-365-5504-1529, "Phase IV - Northwest Intercepting Sewer, n be approved; that the plans for installation of Phase IV of the northwest intercepting sewer, from Medical Center Drive and 16th Street to California and Porter Streets, in accordance with Plan No. 9195, be approved; and that the Director of Public Works/City Engineer be authorized to advertise for bids. MODIFY TRAFFIC SIGNALS - "E" STREET, & 1 OTH STREETS APPROVE PLAN NO. ADVERTISEMENT FOR BIDS FROM 6TH, 7TH, 8TH 9285 AUTHORIZE (18) Roger Hardgrave, Director of submitted a Staff Report dated May modification of traffic signals on "E" and lOth Streets. Public Works/Engineering, 15, 1995, concerning the Street, from 6th, 7th, 8th Council Member Oberhelman made a motion, seconded by Council Member Hernandez, and unanimously carried, that the plans to modify traffic signals on "E" Street, at 6th, 7th, 8th and lOth Streets, in accordance with Plan No. 9285, be approved; and that the Director of Public Works/City Engineer be authorized to advertise for bids. APPLY SLURRY SEAL ON VARIOUS STREETS - APPROVE PLAN NO. 9302 - AUTHORIZE ADVERTISEMENT FOR BIDS (19) Roger Hardgrave, Director of Public Works/Engineering, submitted a Staff Report dated May 16, 1995, concerning the application of slurry seal on various City streets. Director Hardgrave answered questions regarding the selection of streets and the application of the slurry seal. The Council requested that they be provided with a list of streets in which the work is to be performed. 8 6/5/95 Council Member Hernandez made a motion, seconded by Council Member Oberhelman, and unanimously carried, that the plans for application of slurry seal on various streets, in accordance with Plan No. 9302 be approved; and that the Director of Public Works/City Engineer be authorized to advertise for bids. RES. 95-171 - RESOLUTION OF THE CITY OF SAN BERNARDINO FINDING AND DETERMINING THAT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE AMENDMENT OF BOUNDARIES OF ASSESSMENT DISTRICT NO. 952 ZONE 3 BY EXPANDING THE BOUNDARIES THEREOF TO INCLUDE ADDITIONAL TERRITORY IN THE DISTRICT FOR THE MAINTENANCE OF LANDSCAPING ALONG PORTIONS OF NORTHPARK BOULEVARD; ORDERING THE AMENDMENT AND EXPANSION OF THE DISTRICT AND THAT THE SPECIAL ASSESSMENT, INVESTIGATION AND LIMITATION ACT OF 1931 SHALL NOT APPLY AND APPROVING AMENDED ASSESSMENT DISTRICT DIAGRAM MAP NO. 952. RES. 95-172 - RESOLUTION OF THE CITY OF SAN BERNARDINO AMENDING RESOLUTION NO. 655 ENTITLED, IN PART, "A RESOLUTION. .. DESIGNATING CERTAIN STREETS OR PORTIONS THEREOF AS THROUGH HIGHWAYS...;" AND PROVIDING THAT BENEDICT ROAD IS A THROUGH HIGHWAY AT ITS INTERSECTION WITH SUNNYSIDE AVENUE. ESTABLISHING PARKING TIME LIMITATIONS UPON CERTAIN DESIGNATED STREETS, ALLEYS, OR PORTIONS THEREOF. . . ; " AND AUTHORIZING THE IMPLEMENTATION OF A TWO- HOUR PARKING LIMITATION ON ORANGE SHOW LANE BETWEEN THREE-HUNDRED FEET EAST OF "E" STREET AND FOUR HUNDRED AND TWENTY-FIVE FEET EAST OF "E" STREET, APPLICABLE TO THE NORTH SIDE ONLY. ESTABLISHING PARKING TIME LIMITATIONS UPON CERTAIN DESIGNATED STREETS OR ALLEYS, OR PORTIONS THEREOF. . . ;" AND AUTHORIZING THE REMOVAL OF THE TWO-HOUR PARKING LIMITATION ON THE EAST SIDE OF "D" STREET BETWEEN TWO HUNDRED FEET SOUTH OF EIGHTEENTH STREET AND TWO HUNDRED FEET NORTH OF EIGHTEENTH STREET. RES. 95-175 - RESOLUTION OF THE CITY OF SAN BERNARDINO INITIATING PROCEEDINGS AND SETTING A PUBLIC HEARING FOR THE PROPOSED REORGANIZATION OF THE TERRITORY GENERALLY LOCATED SOUTHEAST OF DEVORE ROAD, SOUTHWEST OF THE 1-215 FREEWAY, TO INCLUDE ANNEXATION TO THE CITY OF SAN BERNARDINO, ANNEXATION OF PORTIONS THEREOF TO THE SAN BERNARDINO VALLEY MUNICIPAL WATER DISTRICT AND DETACHMENT OF CERTAIN PORTIONS THEREOF FROM CENTRAL VALLEY FIRE PROTECTION DISTRICT, DESIGNATED LAFCO 2781. (24) Council Member Oberhelman made a motion, seconded by Council Member Devlin, that said resolution be adopted. RES. 95-176 - RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A CONTRACT TO DE LA CRUZ CONSTRUCTION, INC. FOR INSTALLATION OF STREET LIGHTS AT VARIOUS LOCATIONS. (25) Council Member Oberhelman made a motion, seconded by Council Member Hernandez, that the transfer of $8,621, from Account No. 257-601-5151, "Electric Charges," to Account No. 257-601-5706, "Alterations & Renovations," be approved; that said resolution be adopted; and that Change Order No. One to the contract with De La Cruz Construction, Inc., for installation of street lights at various locations, in accordance with Plan No. 9245, be approved; that the contractor be directed to install an additional street light on Mt. RECONVENE MEETING At 10:04 a.m., Mayor Minor reconvened the regular meeting of the Mayor and Common Council of the City of San Bernardino in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. RES. 95-177 - RESOLUTION AUTHORIZING AND APPROVING THE BORROWING OF FUNDS FOR FISCAL YEAR 1995-1996; THE ISSUANCE AND SALE OF A 1995-1996 TAX AND REVENUE ANTICIPATION NOTE THEREFOR AND PARTICIPATION IN THE CALIFORNIA COMMUNITIES CASH FLOW FINANCING PROGRAM. (26) City Administrator Shauna Clark explained the Tax and Revenue Anticipation Note (TRAN).
