MAYOR AND COMMON COUNCIL
OF THE CITY OF SAN BERNARDINO
SPECIAL MEETING
MARCH 15, 1995
ECONOMIC DEVELOPMENT AGENCY BOARD ROOM
NOTICE IS HEREBY GIVEN that the Mayor and Common Council of
the City of San Bernardino have called a special meeting of the
Mayor and Common Council for 3:00 p.m., Wednesday, March 15, 1995,
in the Economic Development Agency Board Room, 201 North "E"
Street, San Bernardino, California.
The purpose for which this meeting has been called is to
adjourn to closed session on existing litigation.
The special meeting of the Mayor and Common Council of the
City of San Bernardino was called to order by Mayor Minor at 3:05
p.m., Wednesday, March 15, 1995, in the Economic Development Agency
Board Room, 201 North "E" Street, San Bernardino, California.
ROLL CALL
Roll call was taken by City Clerk Rachel Clark with the
following being present: Mayor Minor; Council Members Negrete,
Curlin, Hernandez, Oberhelman, Devlin, Pope-Ludlam, Miller, City
Attorney Penman, City Clerk Rachel Clark, Assistant City
Administrator Fred Wilson. Absent: None.

There were no public comments during the public comments
section of this meeting.
RECESS MEETING - CLOSED SESSION (2)
At 3:06 p.m., the Mayor and Common Council recessed to closed
session for the following:
2. Conference with legal counsel - existing litigation pursuant
to Government Code Section 54956.9(a):
Stubblefield Construction Co., et al vs. City of San
Bernardino San Bernardino Superior Court Case Nos.
242998 & 252058 and Fourth District Court of Appeals No.
E009749 (Consolidated with E010088) .

Roll call was taken by City Clerk Rachel Clark with the
following being present: Mayor Minor, Council Members Negrete,
Curlin, Hernandez, Oberhelman, Devlin, Pope-Ludlam, Miller, City
Attorney Penman, City Clerk Rachel Clark, Assistant City
Administrator Fred Wilson. Absent: None.

ADJOURN CLOSED SESSION
At 3: 18 p. m., the closed session adj ourned to the
meeting of the Mayor and Common Council of the City

RECONVENE MEETING
At 3:20 p.m., Mayor Minor reconvened the special meeting of
the Mayor and Common Council of the City of San Bernardino in the
Economic Development Agency Board Room, 201 North "E" Street, San
Bernardino, California.

Roll call was taken by City Clerk Rachel Clark with the
following being present: Mayor Minor; Council Members Negrete,
Curlin, Hernandez, Oberhelman, Devlin, Pope-Ludlam, Miller, City
Attorney Penman, City Clerk Rachel Clark; Assistant City
Administrator Fred Wilson. Absent: None.
CLOSED SESSION ACTION

City Attorney Penman announced that in closed session in the
matter of Stubblefield Construction Company, et al vs. City of San
Bernardino, the Council voted to adopt the following resolution.
RES. 95-58 - RESOLUTION OF THE MAYOR AND COMMON COUNCIL
OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION
OF AN AGREEMENT FOR LEGAL SERVICES BETWEEN THE CITY OF
SAN BERNARDINO AND THE LAW FIRM OF NIELSEN, MERKSAMER,
PARRINELLO, MUELLER & NAYLOR.
City Clerk Rachel Clark read the title of the resolution.
Council Member Miller made a motion, seconded by Council
Member Devlin, that further reading of the resolution be waived and
that said resolution be adopted.
The motion carried and Resolution No. 95-58 was adopted by the
following vote: Ayes: Council Members Negrete, Curlin, Hernandez,
Oberhelman, Devlin, Miller. Nays: Council Member Pope-Ludlam.
Absent: None.
