COUNCIL CHAMBERS
The joint regular meeting of the Mayor and Common Council and
Community Development Commission of the City of San Bernardino was
called to order by Mayor Minor at 8:04 a.m., Monday, September 16,
1996, in the Council Chambers of City Hall, 300 North "D" Street,
San Bernardino, California.
ROLL CALL
Roll call was taken by Deputy City Clerk Medina with the
following being present: Mayor Minor; Council Members Negrete,
Curlin, Oberhelman, Devlin, Anderson, Miller; City Attorney Penman;
Deputy City Clerk Medina; Assistant City Administrator Wilson.
Absent: Council Member Arias.

Deputy City Clerk Cordova read the titles of all the
resolutions and ordinances on the regular and supplemental agendas
of the Mayor and Common Council and the regular and supplemental
agendas of the Community Development Commission/San Bernardino
Joint Powers Financing Authority/San Bernardino Park Acquisition
Joint Powers Financing Authority and Mayor and Common Council while
the Mayor and Common Council and Community Development Commission

more funds should be allocated to assist the youth.

Bill Casaga encouraged the public to volunteer for the
citizens patrol. If anyone is interested in supporting the Police
Department and making the city a better place to live, please call

Council Member Curlin made a motion, seconded by Council
Member Negrete, and unanimously carried, that full reading of the
resolutions and ordinances on the regular and supplemental agendas
of the Mayor and Common Council be waived.

Council Member Curlin made a motion, seconded by Council
Member Negrete, and unanimously carried, that the minutes of the
following meetings of the Mayor and Common Council of the City of
San Bernardino be approved as submitted in typewritten form: July
15, 1996; August 5, 1996; August 26, 1996.
RECEIVE & FILE - TRI-CENTENNIAL CELEBRATION REPORT (10)
Rachel Clark, city Clerk, submitted a Staff Report dated
August 28, 1996, concerning the receipt and filing of the minutes
of the Bicentennial Commission's meeting of July 2, 1996.
Council Member Curlin made a motion, seconded by Council
Member Negrete, and unanimously carried, that the Mayor and Common
Council receive and file the letter dated August 23, 1996, from
Thelma Press, former Bicentennial Executive Director for the City
of San Bernardino, providing minutes of the July 2, 1996, meeting
of members of the 1976 Bicentennial Commission who donated funds
for the Tri-Centennial Celebration.
AUTHORIZE APPLICATION & ADMINISTRATION $50,000 OF
EMERGENCY FOOD AND SHELTER PROGRAM FUNDS (FEMA XV)

Services, submitted a Staff Report dated September 5, 1996,
requesting authorization to apply for and administer $50,000 of
Emergency Food and Shelter Program funds (FEMA Xv) to service the
Westside Community Service Center.

Council Member Curlin made a motion, seconded by Council
Member Negrete, and unanimously carried, that the Director of
Parks, Recreation and Community Services Department be authorized
to apply for and administer $50,000 of emergency food and shelter
funds under the provision of the Emergency Food and Shelter
National Program (FEMA XV) .

A discussion was held concerning the current standards for
unreinforced masonry buildings and the proposed extension said
ordinance would grant for the rehabilitation of such.
Council Member Devlin made a motion, seconded by Council
Member Oberhelman, that said ordinance be adopted.

Discussion ensued regarding the need to aggressively pursue
the collection of funds prior to liening and whether or not there
is a cap placed on the amount of funds which can be expended. It
was noted that an excess of $150,000 in city funds has already been
spent.
Council Member Oberhelman made a motion, seconded by Council
Member Anderson, that said resolution be adopted; and that the City
Clerk be directed to administratively remove any properties from
Exhibit A which have been paid.

Barbara Dillon, Director of Personnel, submitted a Staff
Report dated August 28, 1996, requesting the establishment of a
Literacy Site Manager position for the Emmerton Healthy Start
Project located at Emmerton Elementary School.
Council Member Oberhelman made a motion, seconded by Council
Member Negrete, that one (1) Literacy Site Manager position, grant
funded at $9.00 per hour, be established; and that the Personnel
Department be directed to update Resolution No. 6413, Section 13,
to reflect this particular action. (Note: There was no vote
taken at this time.)
Concern was expressed regarding the need for the Literacy Site
Manager position and the necessary qualifications in comparison to
the compensation.
It was the consensus of the Mayor and Common Council that the
matter be discussed later in the meeting.

Examiner dated September 5, 1996, in accordance with Civil Service

Council Member Anderson, and unanimously carried, that the
personnel actions submitted by the Chief Examiner dated September
5, 1996, in accordance with Civil Service rules and Personnel

Bernardino, be approved and ratified with the deletion of Item No.

submitted a letter dated September 16, 1996, concerning his
property located at 1239-1241 1/2 W. Rialto Avenue and 103-105 S.
Giovanola Street.
Mayor Minor opened the hearing.
Joseph Lease, Inspection Services Supervisor, Planning and
Building Services, provided a synopsis of the action taken relative
to the property located at 1239-1241 1/2 W. Rialto Avenue.
Paul Mastropaolo referred to California legislation relative
to housing and requested that the building be allowed to remain as
built since it was built in compliance with applicable state law.
Discussion ensued regarding the current building code
standards.
Joseph Mastropaolo, 1629 Magellan Lane, Huntington Beach, CA,
reiterated the statements made by Paul Mastropaolo.
Joseph Lease explained that the standards by which the city
mandates compliance are within the Uniform Housing Code which also
adheres to state law and is part of the Health and Safety Code.
Paul Mastropaolo answered questions regarding the improvements
made to the property.
Council Member Oberhelman made a motion, seconded by Council
Member Devlin, and unanimously carried, that the hearing be closed,
Council Member Devlin made a motion, seconded by Council
Member Anderson, and unanimously carried, that the Mayor and Common
Council uphold Order No. 3302 of the Board of Building
commissioners and deny the appeal.

RES. 96-289 - RESOLUTION OF THE CITY OF SAN BERNARDINO
AUTHORIZING THE DIRECTOR OF PARKS, RECREATION AND
COMMUNITY SERVICES DEPARTMENT TO EXECUTE A CONTRACT WITH
COUNTY OF SAN BERNARDINO TO PROVIDE THE YOUTH MENTORING
PROGRAM. (Continued from September 3, 1996) (35)
NOTE: Said resolution (96-276) was adopted at an adjourned
regular meeting of the Mayor and Common Council held on September
9, 1996.
John Kramer, Superintendent of Recreation, Parks, Recreation
and Community Services, explained that the County's attorney made
changes to Resolution No. 96-276; hence, the item is being brought
back for approval.
Council Member Anderson made a motion, seconded by Council
Member Oberhelman, that said resolution be adopted; and that
Resolution No. 96-276 be repealed.
The motion carried and Resolution No. 96-289 was adopted by
the following vote: Ayes: Council Members Negrete, Oberhelman,
Devlin, Anderson, Miller. Nays: None, Absent: Council Members
Curlin, Arias.
AN URGENCY ORDINANCE OF THE CITY OF SAN BERNARDINO
AMENDING CHAPTER 19.62 OF THE SAN BERNARDINO MUNICIPAL
CODE (DEVELOPMENT CODE) REGARDING NONCONFORMING USES AND
STRUCTURES AND DECLARING THE URGENCY THEREOF.

Council Member Negrete made a motion, seconded by Council
Member Miller, and unanimously carried, that said ordinance be
continued to the adjourned regular meeting of the Mayor and Common
Council on September 23, 1996.
RES. 96-290 - RESOLUTION OF THE CITY OF SAN BERNARDINO
AUTHORIZING THE CHIEF OF POLICE TO FILE A GRANT
APPLICATION WITH THE DEPARTMENT OF JUSTICE, OFFICE OF
COMMUNITY ORIENTED POLICING SERVICES (COPS) FOR
ADDITIONAL COMPUTER TECHNOLOGY PURSUANT TO THE COPS MORE
'96 GRANT PROGRAM. CONTINGENT UPON RECEIVING APPROVAL TO
EXPEND STATE FUNDING RECEIVED FROM THE CITIZENS FOR
PUBLIC SAFETY PROGRAM (COPS) SHOULD THE WAIVER OF THE
REQUIRED CITY MATCH NOT BE APPROVED. (S2)
Council Member Devlin made a motion, seconded by Council
Member Anderson, that said resolution be adopted.

RESOLUTION OF THE CITY OF SAN BERNARDINO INCREASING THE
TOTAL NUMBER OF AUTOMATED REFUSE AND RECYCLING CONTAINERS
TO BE PURCHASED FROM TOTER, INC., FROM EIGHTY-FOUR
THOUSAND (84,000) AUTOMATED REFUSE AND RECYCLING
COLLECTION CONTAINERS TO ONE-HUNDRED THOUSAND (100,000),
TO BE UTILIZED BY THE PUBLIC SERVICES DEPARTMENT.

Jim Howell, Director of Public Services, explained that a
budget transfer will be completed to transfer funds into the small
tools and equipment account.
Council Member Devlin made a motion, seconded by Council
Member Oberhelman, and unanimously carried, that said resolution be
continued to the meeting of the Mayor and Common Council on October
7, 1996.
