The purpose for which this meeting was called was to discuss
and take action relative to the proposed ballot measure concerning
Mayor veto power on Community Development Commission items.
The special meeting of the Mayor and Common Council of the
City of San Bernardino was called to order by Mayor Minor at 9:01
a.m., Monday, July 29, 1996, in the Council Chambers of City Hall,
300 North "DR Street, San Bernardino, California.
ROLL CALL
Roll call was taken by City Clerk Rachel Clark with the
following being present: Mayor Minor; Council Members Negrete,
Curlin, Arias, Oberhelman, Devlin, Anderson, Miller; Senior
Assistant City Attorney Barlow; City Clerk Rachel Clark; Economic
Development Agency Administrator Steinhaus. Absent: None.
COMMUNITY DEVELOPMENT COMMISSION ADJOURNED REGULAR
MEETING
At 9:01 a.m., Chairman Minor called the adjourned regular
meeting of the Community Development Commission and Mayor and
Common Council to order.
NOTE: Community Development Commission items which require
action by the Mayor and Common Council are denoted by the letter
"R" and are reflected herein. Minutes of actions taken on
Community Development Commission items are distributed separately
by the Economic Development Agency.

RECESS MEETING
At 1:03 p.m., Mayor Minor declared a five-minute recess.
RECONVENE MEETING
At 1:09 p.m., Mayor Minor reconvened the special meeting of
the Mayor and Common Council of the City of San Bernardino.

Roll call was taken by City Clerk Rachel Clark with the
following being present: Mayor Minor; Council Members Negrete,
Curlin, Arias, Oberhelman, Devlin, Anderson, Miller; City Attorney
Penman; City Clerk Rachel Clark; City Administrator Shauna Clark.
Absent: None.

RESOLUTION OF THE CITY OF SAN BERNARDINO PROPOSING AN
AMENDMENT OF THE CHARTER OF THE CITY RELATING TO THE
POWER OF THE MAYOR TO VETO ORDERS AND RESOLUTIONS OF THE
COMMUNITY DEVELOPMENT COMMISSION. (Option One

RESOLUTION OF THE CITY OF SAN BERNARDINO SUBMITTING TO
THE ELECTORS A PROPOSED CHARTER AMENDMENT RELATING TO THE
POWER OF THE MAYOR TO VETO ORDERS AND RESOLUTIONS OF THE
COMMUNITY DEVELOPMENT COMMISSION. (lB)
RESOLUTION OF THE CITY OF SAN BERNARDINO PROPOSING AN
AMENDMENT OF THE CHARTER OF THE CITY RELATING TO THE
POWER OF THE MAYOR TO VETO ORDERS AND RESOLUTIONS OF THE
COMMUNITY DEVELOPMENT COMMISSION. (Option Two - Does not
make reference to the same power as Mayor of the City.

RESOLUTION OF THE CITY OF SAN BERNARDINO SUBMITTING TO
THE ELECTORS A PROPOSED CHARTER AMENDMENT RELATING TO THE
POWER OF THE MAYOR TO VETO ORDERS AND RESOLUTIONS OF THE
COMMUNITY DEVELOPMENT COMMISSION. (lB)
City Clerk Rachel Clark read the titles of the resolutions
into the record.
A discussion ensued concerning the prematurity of the proposed
ballot measure since the State has not taken action to change the
current law governing redevelopment issues.
Gary Kirby, 1505 Yardley, San Bernardino, CA, voiced
discontent that the City was willing to cancel the 4th of July
celebration in an effort to save money and is now contemplating the
calling of an election that is not required.
Council Member Curlin made a motion, seconded by Council
Member Anderson, that full reading of the resolutions (Option One,
Items lA & IB) be waived; that said resolutions be adopted as
amended; and that said resolution (Option One, Item IB), Page Two,

proposed ballot measure language, be amended to read, "Measure_
_ Approves a Charter Amendment which will allow the Mayor
power to veto, under the same checks and balances as on the Common
Council, any order or resolution of the City of San Bernardino's
Community Development Commission. This veto may be overridden by
a two-thirds vote of the Redevelopment Commission."
The motion carried by the following vote:
Members Negrete, Curlin, Arias, Anderson. Nays:
Oberhelman, Devlin, Miller. Absent: None.

At 1: 31 p. m., the special meet ing adj ourned. The next
regular meeting will be held at 8:00 a.m., Monday, August 5, 1996,
in the Council Chambers of City Hall, 300 North "D" Street, San
Bernardino, California.
