PROCLAMATION - SAN BERNARDINO HISTORY MONTH - SEPTEMBER 1997 - CHURCH OF JESUS CHRIST OF LATTER-DAY SAINTS (3) Ernest Wilson, Affirmative Action Officer, Mayor's Office, read a resolution proclaiming the month of September 1997 as San Bernardino History Month within the City of San Bernardino. George Stehmeier, Stake President, Church of Jesus Christ of Latter-Day Saints, accepted the proclamation. PROCLAMATION - GOOD NEIGHBOR DAY - SEPTEMBER 10, 1997 (3) Ernest Wilson, Affirmative ActioL Officer, Mayor's Office, read a resolution proclaiming September 10, 1997 as Good Neighbor Day within the City of San Bernardino. Debbie Cochran of Inland Flowers accepted the proclamation. INTRODUCTION - SAN BERNARDINO VALLEY COLLEGE PRESIDENT - DR. SHARON CABALLERO (3) Council Member Rita Arias introduced Dr. Sharon Caballero, President of San Bernardino Valley College. Dr. Caballero expressed her pleas'lre in serving the City of San Bernardino. ANNOUNCEMENT - COUNCIL MEMBER ANDERSON (4) Council Member Anderson announced that on September 27, 1997, at 8:00 a.m., a walkathon sponsored by various organizations would be held to raise funds for diabetes and other worthwhile causes. ANNOUNCEMENT - COUNCIL MEMBER OBERHELMAN (4) Council Member Oberhelman thanked the India Association for their 50th year celebration of India. The event was well attended and orchestrated. ANNOUNCEMENT - COUNCIL MEMBER ARIAS (4) Council Member Arias informed her constituents that on August 19, 1997, she received word from City Clerk Rachel Clark that the recall efforts against her had been suspended and thanked the individuals and businesses who did not participate in the recall effort. She reiterated her commitment to the community. 4 9/2/1997 ANNOUNCEMENT - COUNCIL MEMBER CURLIN (4) Council Member Curlin expressed his sadness about the death of Princess Diana of Great Britain and voiced concern about the council's lack of adherence to the rules of order for council meetings. ANNOUNCEMENT - CITY ATTORNEY PENMAN (4) City Attorney Penman stated meetings are not governed by the explained the protocol established tha~ the Mayor and Council Robert's rules of order and by the city. PUBLIC COMMENTS - FELIX D'AMICO (5) Felix D'Amico, 2348 N. Sterling Avenue #206, San Bernardino, CA, announced his candidacy for the Fourth Ward Council seat, outlined his qualifications and expressed concern regarding crime, blight and economics. PUBLIC COMMENTS - GARY KIRBY (5) Gary Kirby, 1505 Yardley Street, San Bernardino, CA, commented on the article which appeared in The Sun newspaper regarding the proposed charter amendment committee and expressed his views concerning the contemplated amendments. PUBLIC COMMENTS - RUBEN LOPEZ (5) Ruben Lopez, 631 W. 16th Street, San Bernardino, CA, voiced concern regarding the elimination of Charter Section 186 and cautioned the voters against supporting those candidates who are backed by political action committees. PUBLIC COMMENTS - ROBERT REGO (5) Robert Rego, 123 E. 11th Street, San Bernardino, CA, announced his candidacy for the Second Ward Council seat and stated that he had attended the meetings to amend the city charter and was concerned when three representatives of the committee had expressed concern that the information would be ,"elated to the public. 5 9/2/1997 PUBLIC COMMENTS - EVLYN WILCOX (5) Evlyn Wilcox, 3096 Parks ide Drive, San Bernardino, CA, stated that in her tenure as Mayor, she convened a charter amendment committee who worked for two years to no avail. She expressed concern regarding the amendments being proposed by the committee. PUBLIC COMMENTS - JUANITA SCOTT (5) Juanita Scott, 1734 W. Virginia Street, voiced concern relative to the formation of amendment committee because she felt that residents would not be represented. PUBLIC COMMENTS - RICHARD LEWIS (5) Richard Lewis, 5328 Park Lane, San Bernardino, CA, Secretary of the San Bernardino Professional Firefighters Association, expressed support for the city's current form of government. PUBLIC COMMENTS - CARL CLEMMONS (5) Carl Clemmons, a resident of San Bernardino, voiced concern relative to the proposed charter amendments. PUBLIC COMMENTS - COUNCIL MEMBER CURLIN (5) Council Member Curlin, speaking from the podium, read letters acknowledging those individuals responsible for having the Jackie Robinson exhibit displayed within the City of San Bernardino. WAIVE FULL READING OF RESOLUTIONS & ORDINANCES (6) Council Member Devlin made a mo!:ion, seconded by Council Member Negrete, and unanimously carried, that full reading of the resolutions and ordinances on the regular, supplemental and addendum to the supplemental agendas of the Mayor and Common Council be waived. COUNCIL MINUTES (7) Council Member Devlin made a mction, seconded by Council Member Negrete, and unanimously carried, that the minutes of the following meetings of the Mayor and Common Council of the City of San Bernardino be approved as submitted in typewritten form: June 16, 1997; June 18, 1997; June 26, 1997. 6 9/2/1997 CLAIMS & PAYROLL (8) Council Member Devlin made a motion, seconded by Council Member Negrete, and unanimously carrLed, that the claims and payroll and the authorization to issue warrants as listed on the memorandum dated August 27, 1997, from the Director of Finance be approved. PERSONNEL ACTIONS (9) Council Member Devlin made a mo-::ion, seconded by Council Member Negrete, and unanimously carried, that the personnel actions as submitted by the Chief Examiner dated August 25, 1997, in accordance with Civil Service rules and Personnel policies adopted by the Mayor and Common Council of the City of San Bernardino be approved and ratified. AUTHORIZE ADDENDUM COOPERATION AGREEMENT UNITED STATES DEPARTMENT OF HOUSING & URBAN DEVELOPMENT (HUD) - ARROWHEAD NEIGHBORHOOD ASSOCIATION LOS PADRINOS WATERING LAWNS OF VACANT HOMES (10) Lori Sassoon, Senior Administrative Analyst, City Administrator's Office, submitted a Staff Report dated August 26, 1997, concerning an addendum to a cooperative agreement for the watering of lawns at vacant homes. Council Member Devlin made a motion, seconded by Council Member Negrete, and unanimously carried, that the Mayor be authorized to execute an addendum to the cooperation agreement. RES. 97-256 - RESOLUTION OF THE CITY OF SAN BERNARDINO ESTABLISHING THE APPROPRIATION LIMIT FOR THE FISCAL YEAR 1997-1998 FOR THE CITY OF SAN BERNARDINO IN ACCORDANCE WITH THE PROVISIONS OF DIVISION 9 OF TITLE 1 OF THE CALIFORNIA CODE AND REPEALING RESOLUTION 96-154. (11) RES. 97-257 - RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING THE DESTRUCTION OF CERTAIN RECORDS BY THE PURCHASING DIVISION OF THE FINANCE DEPARTMENT. (12) RES. 97-258 - RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN AGREEMENT FOR A YEAR- ROUND LUNCH PROGRAM AS AN EXTENSION OF THE SUMMER FOOD SERVICE PROGRAM WITH THE SAN BERNARDINO UNIFIED SCHOOL DISTRICT RELATING TO THE DELIVERY OF TYPE A LUNCHES AND SNACKS TO CITY'S YEAR-ROUND LUNCH SITES. APPROVE PLAN NO. 9693 - IMPROVE SEWER SYSTEMS LOCATIONS - AUTHORIZE ADVERTISEMENT FOR BIDS VARIOUS (18) Roger Hardgrave, Director of Public Works/City Engineer, submitted a Staff Report dated August 20, 1997, concerning the improvement of sewer systems at various locations throughout the city. Council Member Devlin made a mot ion, seconded by Council Member Negrete, and unanimously carried, that the plans for cross- connection of a 12-inch sewer to a 54-inch sewer, repair of sewer siphon under Mission-Zanja Creek and raising two manhole covers to grade, in accordance with Plan No. 9693, be approved; and that the Director of Public Works/City Engineer be authorized to advertise for bids. RES. 97-259 - RESOLUTION OF THE CITY OF SAN BERNARDINO AMENDING RESOLUTION 6413, SECTION THIRTEEN, TEMPORARY/PART-TIME EMPLOYEES, ENTITLED IN PART A "RESOLUTION. . . ESTABLISHING A BASIC COMPENSATION PLAN. . . " BY UPDATING INFORMATION CODIFYING PRIOR COUNCIL ACTIONS. (14) Council Member Negrete made a motion, seconded by Council Member Oberhelman, that said resolution be adopted. Absent: None. 9 9/2/1997 RES. 97-267 - RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN AGREEMENT BETWEEN SAID CITY AND THE STATE OF CALIFORNIA, ACTING BY AND THROUGH ITS DEPARTMENT OF TRANSPORTATION, RELATING TO THE DELEGATION OF CERTAIN MAINTENANCE FUNCTIONS ON STATE HIGHWAYS IN THE CITY OF SAN BERNARDINO AND RESCINDING RESOLUTION NO. 84-58. (20) Council Member Oberhelman made a motion, seconded by Council Member Miller, that said resolution be adopted. Resolution No. 97-267 was Ayes: Council Members Negrete, Anderson, Miller. Nays: None. adopted by the following vote: Curlin, Arias, Oberhelman, Devlin, Absent: None. WAIVE REQUIREMENT - CONNECT SINGLE-FAMILY RESIDENCE WAIVER NO. 97-01 TO SEWER SYSTEM 6060 N. HIGHWAY - CONSTRUCT 18 SEWER (21) Roger Hardgrave, Director of Public Works/City Engineer, submitted a Staff Report dated August 20, 1997, concerning Sewer Waiver No. 97-01. Council Member Miller made a motion, seconded by Council Member Devlin, and unanimously carried, that Sewer Waiver Request No. 97-01, for construction of a single-family residence on an existing lot of record located at 6060 N. Highway 18 (APN 270-051- 38) requesting a waiver of requirement to connect to the sewer system, be approved. RES. 97-268 - RESOLUTION OF THE CITY OF SAN BERNARDINO TERMINATING CITYWIDE ASSESSMENT DISTRICT NO. 994 AND RELEASING OF LIENS. (22) Council Member Miller made a motion, seconded by Council Member Anderson, that said resolution be adopted. Resolution No. 97-268 was adopted by the following vote: Ayes: Council Members Negrete, Curlin, Arias, Oberhelman, Devlin, Anderson, Miller. Nays: None. Absent: None. RES. 97-269 - RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE SUBMISSION OF A PROJECT APPLICATION AND THE EXECUTION OF A CONTRACT BY AND BETWEEN SOUTH COAST AIR QUALITY MANAGEMENT DISTRICT AND SAID CITY FOR THE PURPOSE OF ACQUIRING A TWENTY PERCENT MATCH GRANT FOR ACQUISITION OF AN ELECTRIC VEHICLE FOR USE AS A CITY OF SAN BERNARDINO FLEET DIVISION POOc. CAR. (23) Council inquired about the allocation of funds and the intended use of the electric vehicle. 10 9/2/1997 City Administrator Wilson explained that the purchase of the vehicle would demonstrate the city's conmitment to the improvement of its air quality and answered questions regarding the number of vehicles to be acquired within the fiscal year 1997/98 budget. Council Member Anderson made a motion, seconded by Council Member Oberhelman, that the appropriation of $7,800 from Account No. 111-000-3405 (Transportation Fund Balance Account) to Account No. 111-241-5803 (Lease Payments), be approved; and that said resolution be adopted. The motion carried and Resolution No. 97-269 the following vote: Ayes: Council Members Negrete, Oberhelman, Devlin, Anderson, Miller. Nays: None. was adopted by Curlin, Arias, Absent: None. RES. 97-270 - RESOLUTION OF THE CITY OF SAN BERNARDINO, CALIFORNIA, SUPPORTING THE UNIVERSITY-CITY PACT TO DECREASE TOBACCO ACCESS TO MINORS. (24) Gwen Norton-Perry, California State University San Bernardino, 5500 University Parkway, San Bernardino, CA, stated that 14 cities will be involved in the University-City PACT. Funds are appropriated from Proposition 99. An analysis of the city's smoking ordinance will be conducted; focus groups will be convened and an aggressive educational campaign will be launched as part of PACT's efforts to reduce tobacco access to minors. Council inquired how the surveys would be conducted and was informed that the surveys could be handled by ward. Council Member Miller made a motion, seconded by Council Member Anderson, that said resolution be adopted. Resolution No. 97-270 was adopted by the following vote: Ayes: Council Members Negrete, Curlin, Arias, Oberhelman, Devlin, Anderson, Miller. Nays: None. Absent: None. WAIVE FEES COUNTY OF SAN - $4,878.47 RED RIBBON PARADE OCTOBER 25, 1997 BERNARDINO DEPARTMENT OF BEHAVIORAL HEALTH (25) Fred Wilson, City Administrator, submitted a Staff Report dated August 21, 1997, concerning a waiver of fees in connection with the Red Ribbon Parade to be held on October 25, 1997. Joan Committee, the waiver Harter / submitted of fees. Parade Chair, Red Ribbon Week Executive a letter dated August 27, 1997, in support of Mayor Minor explained that he had denied the request and that is why it was placed on the agenda for council consideration. 11 9/2/1997 Council expressed concern regarding the calculation of fees associated with the event. A discussion ensued concerning the importance of the event, the precedent set and cause for denial of such waivers. CROSSING GUARD PROGRAM - SCHOOL SITES (29) Council Member Anderson submitted" Staff Report dated August 25, 1997, requesting that action be taken to ensure crossing guards at school sites. A petition of 183 signatures was presented In support of the crossing guard program. Council voiced discontent over the behavior exhibited by the school district in that they publicized that the city would not be funding the crossing guard program. The Council acknowledged that Mayor Minor acted in good faith and had notified the school district that for fiscal year 1997/98, the city would only be able to allocate half the funding. It was suggested that the County of San Bernardino's GAIN Division (Greater Avenues for Independence) be used to employ crossing guards within the city. Dr. Elsa Valdez, Mexican American Political Association, 748 W. Dover Drive, San Bernardino, CA, agreed with the council that it is the school board's responsibility to address the school safety issues. She stated that she attempted to have the matter placed on the school board's agenda; however, she received a letter from Larry Niegel, President of the Board of Education, stating that it was not the school district's responsibility and the matter should be directed to the city. Ms. Valdez voiced her displeasure of the school board's actions. The following individuals commended the Mayor and Council for their actions in providing safety to our children: Robert Rego, 123 E. 11th Street, San Bernardino, CA. Maria D. Gonzalez, 1273 N. Genevieve, San Bernardino, CA. A discussion was held relative to the safety of the students of San Bernardino. ~ Mayor Minor stated that when the school district decided to implement year-round attendance, the costs associated with the crossing-guard program increased. He explained the actions taken by the city to address the needs of the youth and expressed his support to fund crossing guards located beyond 1,000 feet of the schools. Council Nays: APPROVE ASSISTANCE PACKAGE $150,000 GARNER HOLT PRODUCTIONS, INC. - EMPLOYMENT LINKAGE PROGRAM AGREEMENT - $25,000 - OWNER PARTICIPATION AGREEMENT (RS3) Todd Hooks, Office of Business Development Manager, Economic Development Agency, submitted a Staff Report dated August 28, 1997, concerning an owner participation and employment linkage program agreement with Garner Holt Productions, Inc. Office of Business Development Manager Hooks provided a synopsis of the action taken to provide financial assistance in the amount of $150,000 for Garner Holt Productions, Inc., and an employment linkage package in the amount of $25,000. Council Member Arias made a motion, seconded by Council Member Negrete, and unanimously carried, that the Mayor and Common Council/Community Development Commission approve an assistance package not to exceed $150,000 and an Employment Linkage Program Agreement in an amount not to exceed $25,000 to Garner Holt Productions, Inc., in accordance with Lle terms and conditions set forth in the Staff Report dated August 28, 1997, from Todd Hooks, Office of Business Development Manager; further, recommend that the Agency Administrator be authorized to execute an Owner Participation Agreement with Garner Holt Productions, Inc., and all other implementing documentation; and finally, that the agency budget be increased accordingly.
