JOINT REGULAR MEETING
FEBRUARY 7, 2000
COUNCIL CHAMBERS
The joint regular meeting of the Mayor and Common Council and
Community Development Commission of the City of San Bernardino was
called to order by Mayor Valles at 8:10 a.m., Monday, February 7,2000,
in the Council Chambers of City Hall, 300 North "D" Street, San
Bernardino, California.
ROLL CALL
Roll call was taken by City Clerk Clark with the following being
present: Mayor Valles: Council Members Estrada, Lien, McGinnis,
Schnetz, Suarez, Anderson, Miller; Senior Assistant City Attorney
Carlyle, City Clerk Clark, City Administrator Wilson. Absent: None.
RECESS MEETING - CLOSED SESSION (Discussed later in

CLOSED SESSION
At 8:10 a.m., Mayor Valles called the closed session to order in the
conference room of the Council Chambers of City Hall.
ROLL CALL
Roll call was taken by City Clerk Clark with the following being
present: Mayor Valles; Council Members Estrada, Lien, McGinnis,
Schnetz, Suarez, Anderson, Miller; Senior Assistant City Attorney
Carlyle, City Clerk Clark, City Administrator Wilson. Absent: None.
READING OF RESOLUTIONS & ORDINANCES
Deputy City Clerk Szendrodi read the titles of all the resolutions
and ordinances on the regular agenda of the Mayor and Common
Council and Community Development Commission, while the Mayor and
Common Council and Community Development Commission were in
closed session.
ADJOURN CLOSED SESSION
At 8:40 a.m., the closed session adjourned to the Council
Chambers of City Hall.
RECONVENE MEETING
At 9:01 a.m., Mayor Valles reconvened the joint regular meeting of
the Mayor and Common Council and Community Development
Commission of the City of San Bernardino.

Roll call was taken by City Clerk Clark with the following being
present: Mayor Valles; Council Members Estrada, Lien, McGinnis,

INVOCATION
The invocation was given by Pastor Greg Langley of Crestview
Baptist Church.

PLEDGE OF ALLEGIANCE
The pledge of allegiance was led by Danny Rin, Jessica Solorzano,
Portia Pasiaka and Crystal Hernandez, students from Bradley
Elementary School.
APPOINTMENTS - HUMAN RELATIONS COMMISSION _
ANIMAL ADVISORY COMMISSION - MAYOR VALLES (2)
Mayor Valles submitted a staff report dated February 2, 2000,
requesting the appointment of Charlie Seymour to the Human Relations
Commission and Joyce Martin to the Animal Advisory Commission.
Council Member Anderson made a motion, seconded by Council
Member Suarez, and unanimously carried, that the appointments of
Charlie Seymour and Joyce Martin, as recommended by Mayor Valles, be
approved.
PROCLAMATION
DAFFODIL DAYS
AMERICAN CANCER SOCIETY
(3)
Mayor Valles presented a proclamation to Barbara Meekins,
Delores Merk and Linda Riggs of the American Cancer Society,
designating the month of March as Daffodil Days Month in the City of
San Bernardino.
PROCLAMATION - HEALTHY SMART CITIES MONTH (3)
Mayor Valles presented a proclamation to John Kramer,
Superintendent of Parks, Recreation and Community Services
designating the month of February as Healthy Smart Cities Month in the
City of San Bernardino.
CERTIFICATES OF RECOGNITION - USED OIL PROGRAM

Mayor Valles presented Certificates of Recognition to students,
grades K-12, whose artwork is featured in the City of San Bernardino's
2000 calendar. The "You Could Use An Oil Change" program has been in
progress for six years and highlights the importance of recycling.
ANNOUNCEMENTS

Larry Quiel, President of the San Bernardino Area Chamber of
Commerce thanked everyone who attended the Chamber of Commerce
Installation Dinner. He discussed the City bid process seminar that is
scheduled for February 8, at the San Bernardino Area Chamber of

Commerce, and the Mayor's Ball, scheduled for February 12, at the
Radisson Hotel. He indicated that the mural of Will Rogers on the west
elevation of the California Theatre is complete. He reminded everyone
that the State of the City Address is scheduled for 7:30 a.m., on Tuesday,
February 29.
ANNOUNCEMENTS - COUNCIL MEMBER MC GINNIS (4)
Council Member McGinnis commented on the Black History
Parade, indicating it was a great event for the City. Council Member
McGinnis also commented that he was pleased to see so many of the
entertainment venues offered in the City, bustling with activity during
the weekend. He indicated that the Blue Thunderball Football Game is
scheduled for February 19, starting at 2:15 p.m. at the Stampede
Stadium. Proceeds will go to the San Bernardino Youth Sports Program
and Lorna Linda Children's Hospital.
ANNOUNCEMENTS - COUNCIL MEMBER LIEN (4)
Council Member Lien stated that a Public Scoping Meeting
regarding the water project is scheduled for February 7, at 7:00 p.m., in
the City Council Chambers. Council Member Lien stated the Perris Hill
Neighborhood Association will be holding a tour of the demolition process
of the old county medical center on Gilbert Street, on February 19, at
3:00 p.m. Both Council Member Lien and Supervisor Eaves will be
present for the tour.
ANNOUNCEMENTS - COUNCIL MEMBER ESTRADA (4)
Council Member Estrada congratulated Pastor Oliver Lambert of
the Mission of Jesus Christ, for starting a neighborhood association in
the first ward. She stated that the restoration of the Santa Fe Depot is
one of the agenda items on the Planning Commission agenda, scheduled
for February 8.
ANNOUNCEMENTS - COUNCIL MEMBER ANDERSON (4)
Council Member Anderson stated that on Saturday, February 12,
the San Bernardino High School Association will be hosting a clean-up in
the Sixth Ward, at 16th Street and "G" Street, and will also accept trash
from other wards, as well. Ms. Anderson thanked Annie Ramos, Director
of Parks, Recreation & Community Services, for making available use of a
park for the Dodgers Clinic for Children. The children received used
gloves and backpacks from the Dodgers.

Council Member Suarez stated he is meeting with all association
group presidents in his ward and asked all the people who reside in that
ward to get in touch with the group presidents and tell them of their
concerns and issues.

Mayor Valles extended her sympathy to City Attorney Penman and
his family on the death of his mother, Juanita.
Mayor Valles congratulated Larry Quiel who was recently installed
as President of the San Bernardino Area Chamber of Commerce, as well
as JoAnn Roberts, who was installed as President of the Inland Empire
African American Chamber of Commerce.
Mayor Valles discussed the 13th Annual Mayor's Ball. Tickets are
still available. The Ball is scheduled for February 12, at the Radisson
Hotel. Proceeds will benefit the Art in Public Places Project of the More
Attractive Community Foundation (MAC).
Mayor Valles reminded all that today is the last day to register to
vote in the Presidential Primary Election and the Seventh Ward Council
Seat runoff.
ANNOUNCEMENTS - CITY ADMINISTRATOR WILSON (4)
City Administrator Wilson announced that a workshop is being
scheduled in the month of April to review the seven goals adopted by the
Council in 1998. There will be an update on where we stand on the
goals.

City Clerk Clark reminded everyone that today is the deadline to
register to vote in the March 7 election. She discussed absentee balloting
as a voting alternative.

Council Member Anderson made a motion, seconded by Council
Member Miller, and unanimously carried, that full reading of the

resolutions and ordinances on the regular agenda of the Mayor and
Common Council/Community Development Commission be waived.
CLAIMS AND PAYROLL

Council Member Anderson made a motion, seconded by Council
Member Miller, and unanimously carried, that the claims and payroll
and the authorization to issue warrants as listed on the memorandum
dated February 2, 2000, from Barbara Pachon, Director of Finance, be
approved.
PERSONNEL ACTIONS

Council Member Anderson made a motion, seconded by Council
Member Miller, and unanimously carried, that the personnel actions as
submitted by the Chief Examiner dated February 2, 2000, in accordance
with Civil Service rules and Personnel policies adopted by the Mayor and
Common Council of the City of San Bernardino, be approved and ratified.

INITIATE DEVELOPMENT CODE AMENDMENT
ESTABLISH SOCIAL SERVICE USES/FACILITIES
CONDITIONALLY PERMITTED USES - MULTI-FAMILY LAND
USE (IS)
Development Services Director Michael E. Hays submitted a staff
report dated February 2, 2000, wherein he requested the Mayor and
Council to direct the Planning Division to initiate an amendment to
establish social service uses/facilities as conditionally permitted uses in
multi-family land use districts. The Legislative Review Committee has
recommended that the Development Code amendment be initiated.

Council Member Suarez requested that the wording of the motion
include drug and alcohol treatment.
Council Member Estrada made a motion, seconded by Council
Member Miller, and unanimously carried, that the Mayor and Common
Council direct the Planning Division to initiate an amendment to the
Development Code to establish social service uses/facilities and drug and
alcohol treatment facilities, as conditionally permitted uses in multi-
family land use districts.
INITIATE DEVELOPMENT CODE AMENDMENT - REVISE
STANDARDS - CELLULAR ANTENNAS (16)
Development Services Director Michael E. Hays submitted a staff
report dated February 2, 2000, wherein he requested the Mayor and
Common Council to direct the Planning Division to initiate an
amendment to the Development Code to incorporate siting and design
standards for cellular antennas. It was recommended by the Legislative
Review Committee that the Development Code amendment be initiated.
Council Member Estrada made a motion, seconded by Council
Member Miller, and unanimously carried, that the Mayor and Common
Council direct the Planning Division to initiate an amendment to the
Development Code to incorporate siting and design standards for cellular
antennas.
RES. 2000-25 - RESOLUTION OF THE MAYOR AND
COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
AUTHORIZING THE MAYOR TO EXECUTE A SERVICE
AGREEMENT WITH BIG RED APPLE, REGARDING THE
MARKETING AND MANAGEMENT OF THE SAN
BERNARDINO STADIUM. (17)
City Administrator Wilson submitted a staff report dated January
29, 2000, wherein he requested approval of a one-year renewal with Big
Red Apple for marketing and management of the San Bernardino
Stadium.
Council Member Anderson made a motion, seconded by Council
Member Miller, that said resolution be adopted; and that the Director of
Finance be authorized to amend the FY 1999-2000 budget as indicated
on the attached staff report.
The motion carried and Resolution No. 2000-25 was adopted by
the following vote: Ayes: Council Members Estrada, Lien, McGinnis,
Schnetz, Suarez, Anderson, Miller. Nays: None. Absent: None.

RES. 2000-26 - RESOLUTION OF THE CITY OF SAN
BERNARDINO NOTICING A PUBLIC HEARING RELATIVE TO
THE FORMATION OF UNDERGROUND UTILITY DISTRICT
NO. 28, GENERALLY LOCATED ALONG PORTIONS OF BASE
LINE STREET, EAST OF CALIFORNIA STREET AND ALONG
PORTIONS OF PENNSYLVANIA AVENUE, NORTH OF 9TH

Development Services Director, Michael E. Hays submitted a staff
report dated January 20, 2000, wherein he requested Council to set a
public hearing for the proposed formation of Underground Utility District
No. 28, to include portions of Base Line Street, east of California Street
and portions of Pennsylvania Avenue, north of 9th Street.
Council Member Schnetz indicated that he has two projects on 40th
Street and he does not want them delayed.
Mr. Hays indicated that that it would only be a three-month delay.
Council Member Schnetz inquired about the status of the design
for Base Line versus the status of the design for 40th Street.
Mr. Hays indicated that the Base Line project is under design and
is 80 percent complete. The design on 40th Street is scheduled to be
completed by April or May.
Discussion followed on the timeline for the two projects.

Council Member Miller made a motion, seconded by Council
Member Anderson, that the Director of Development Services and the
City Clerk be authorized to proceed with the formation of Underground
Utility District No. 28, along portions of Base Line Street, east of
California Street, and portions of Pennsylvania Avenue, north of 9th
Street, pursuant to San Bernardino Municipal Code Section 13.36; and
that said resolution be adopted.
The motion carried and Resolution No. 2000-26 was adopted by
the following vote: Ayes: Council Members Estrada, McGinnis, Suarez,
Anderson, Miller. Nays: Council Members Lien, Schnetz. Absent:
None.

Mayor Valles indicated that staff is working with the property
owners on a new agreement for the existing location.

QUITCLAIM DEED - SALE OF CITY PROPERTY - EAST OF

RES. 2000-27 - RESOLUTION OF THE CITY OF SAN
BERNARDINO ORDERING THE VACATION OF A PORTION
OF THAT CERTAIN EAST/WEST ALLEY LOCATED EAST OF

Mayor Valles opened the hearing.
There were no public comments.
Council Member Estrada made a motion, seconded by Council
Member Miller, that the hearing be closed; that the Findings of Fact as
set forth in the Staff Report from the Director of Development Services,
as to why a portion of the east/west alley east of "F" Street, between 5th
and 6th Streets, is no longer necessary for public street purposes, be
adopted; that the hearing relative to the sale of a portion of City property

located east of "F" Street, between 5th and 6th Streets, be closed; and that
said resolutions be adopted.
The motion carried and Resolution Nos. 2000-27 and 2000-28
were adopted by the following vote: Ayes: Council Members Estrada,
Lien, McGinnis, Schnetz, Suarez, Anderson, Miller. Nays: None.
Absent: None.
RECESS MEETING
At 10:05 a.m., Mayor Valles recessed the meeting to 2:00 p.m., in
the Council Chambers of City Hall.

Commission, in the Council Chambers of City Hall.

Financing Authority and Mayor and Common Council.
ANNOUNCEMENTS - CITY CLERK CLARK

City Clerk Clark announced that the Registrar of Voters is in need
of inspectors, clerks, etc., for the March 7 election. Please call (909) 381-
2860 for further information on the training and the rate of pay.

Council Member Lien announced that the San Bernardino High
School Association will be sponsoring a cleanup event on Saturday
morning, starting at 8:00 a.m. - there will be free dumping - at Central
Christian Church, located at 1696 North "G" Street.

Gary Van Osdel, Executive Director of the Economic
Redevelopment Agency asked that this matter be tabled.
Council Member Estrada made a motion, seconded by Council
Member Anderson, and unanimously carried, that the matter be tabled.

GiI Navarro, President of the Mexican American Political
Association, San Bernardino Chapter, requested that Council have traffic
signs posted on Little Mountain Drive regarding speed and dangerous
curves. He also indicated that a flashing light is needed on both sides of
the Little Mountain Drive.
Jesus Segovia, 25313 East Fourth Street, San Bernardino,
California. Mr. Segovia is President of the Parent Teacher Association at
Monterey Elementary School and a member of the Mexican American
Policical Association and also President of the West Highland
Homeowners Association. He supports Mr. Navarro's request for a
flashing light and traffic signs on Little Mountain Drive.
Suzanne Negrete, 1574 West Kingman, San Bernardino, California,
indicated that she supports Mr. Navarro's request.
John Stevens, 4097 Pershing, San Bernardino, indicated that
Senator Barbara Boxer is holding a meeting at the Radisson Hotel on
February 22, from 11:00 a.m. to 12:00 p.m., and also from 7:00 p.m. to
9:00 p.m., to discuss the hauling of nuclear waste on San Bernardino
County freeways.

Mayor and Common Council and Community Development Commission
