COUNCIL CHAMBERS
The joint regular meeting of the Mayor and Common Council and Community
Development Commission of the City of San Bernardino was called to order by
Mayor/Chairman Valles at 8:12 a.m., Monday October 15, 2001, in the Council
Chambers of City Hall, 300 North "D" Street, San Bernardino, California.
Roll Call
Roll call was taken by City Clerk Clark with the following being present:

City Attorney Penman announced that the following additional cases would be
discussed in closed session:

States District Court Case No. CV 00-0304B.
In addition, Mr. Penman announced that a meeting would be held with the Chief
of Police designee on a matter specifically involving the Water Department
under Agenda Item No. IE.
Reading of Resolutions & Ordinances
Deputy City Clerk Sutherland read into the record the titles of all the resolutions and
ordinances on the regular agenda of the Mayor and Common Council and Community
Development Commission.

At 8: 15 a.m., Council Member/Commissioner Anderson arrived at the
Council/Commission meeting.
Council Members/Commissioners Schnetz & Suarez Arrived
At 8:20 a.m., Council Members/Commissioners Schnetz and Suarez arrived at the
Council/Commission meeting.

Invocation/Pledge of Allegiance
The invocation was given by Pastor Matthew Witter of San Bernardino Baptist Church,
followed by the pledge of allegiance, led by Janis Gericke, a fourth grade student at
Ramona Alessandro Elementary School.
Moment of Silence
Mayor/Chairman Valles requested that a moment of silence be observed in memory of
Anna Maria Arias, native of San Bernardino and daughter of former Third Ward
Councilwoman Rita Arias, who passed away on October 1, 2001.
2. Appointment - Linda Blacksher - Fine Arts Commission - Council
Member/Commissioner Suarez.
Council Member/Commissioner Anderson made a motion, seconded by Council
Member/Commissioner McGinnis, that the appointment of Linda Blacksher to
the Fine Arts Commission, as requested by Council Member/Commissioner
Suarez, be approved.
The motion carried by the following vote: Ayes: Council
Members/Commissioners Estrada, Lien, McGinnis, Schnetz, Suarez, Anderson,
McCammack. Nays: None. Absent: None.
3. Proclamations, Presentations, and Service Pin Awards
Sponsors of the freedom Festival were recognized by the Muscupiabe
Neighborhood Cluster Association and the Blair Park Neighborhood Cluster
Association. Loren Kennedy, President of the Muscupiabe Neighborhood
Association and Tracy Lynn Shorett, President of the Blair Park Neighborhood
Association presented awards to Los Padrinos, Code Compliance Director
Glenn Baude, Fire Chief Larry Pitzer, Councilman Joe Suarez, Mayor Valles,
the Muscupiabe Youth Association, the Blair Park Youth Association, Coco's
Restaurant, The Home Depot, the Inland Empire School of Performing Arts,
MAPCO Company, Sara's Flowers, Avila Construction Company, Pet
Emporium, and the Inland Empire Track Club.
A proclamation designating October 2001 as Firefighter Recognition Month was
accepted by George Schnarre, President of the Chamber of Commerce, Roland
Crawford, President of the County's Fire Chief Association, and Chief Larry
Pitzer.
A proclamation designating the week of October 21-27, 2001 as World
Population Awareness Week was accepted by Jean Frederickson and Allen
Mitchell.

A proclamation designating October 27, 2001 as Make a Difference Day was
accepted by Linda Ceballos, the City's Environmental Project Coordinator.
A proclamation designating the week of October 21-27, 2001 as National
Respiratory Week was accepted by Raquel Calderon.
The Neighborhood Pride Award was presented to Delia and Tommy Barrasa,
who reside in the Fifth Ward.
Dave Oldham, recently appointed General Manager of the Stampede Baseball
Team, introduced himself and announced that Krispy Kreme Donuts and
Starbuck's Coffee was now available for sale at the ballpark Monday through
Friday from 7 a.m. to 11 a.m. in order to attract more people to the ballpark
and develop corporate sponsorships to help make the Stampede a more vibrant
commodity in the City of San Bernardino.
Teri Rubi, Executive Assistant to the Mayor, read the names of the following
individuals who were presented a service pin award by Mayor Valles in
recognition of their many years of dedicated service to the City:

4. Announcements
Announcements were made by the Mayor and Common Council, elected
officials, and the Chamber of Commerce regarding various civic, community,
and Chamber events/activities. Mayor Valles provided an update on the City's
public works projects.
5. Waive Full Reading of Resolutions & Ordinances
Council Member/Commissioner Anderson made a motion, seconded by Council
Member/Commissioner Suarez, that full reading of the resolutions and
ordinances on the regular agenda of the Mayor and Common
Council/Community Development Commission, be waived.
The motion carried by the following vote: Ayes: Council
Members/Commissioners Estrada, Lien, McGinnis, Schnetz, Suarez, Anderson,
McCammack. Nays: None. Absent: None.
6. Council Minutes
Council Member/Commissioner Anderson made a motion, seconded by Council
Member/Commissioner Suarez, that the minutes of the June 18, 2001 meeting
of the Mayor and Common Council/Community Development Commission of
the City of San Bernardino, be approved as submitted in typewritten form.
The motion carried by the following vote: Ayes: Council
Members/Commissioners Estrada, Lien, McGinnis, Schnetz, Suarez, Anderson,
McCammack. Nays: None. Absent: None.
7. Claims & Payroll
Council Member/Commissioner Anderson made a motion, seconded by Council
Member/Commissioner Suarez, that the claims and payroll and the authorization
to issue warrants as listed on the memorandum dated October 9, 2001, from
Barbara Pachon, Director of Finance, be approved.
The motion carried by the following vote: Ayes: Council
Members/Commissioners Estrada, Lien, McGinnis, Schnetz, Suarez, Anderson,
McCammack. Nays: None. Absent: None.

8. Personnel Actions
Council Member/Commissioner Anderson made a motion, seconded by Council
Member/Commissioner Suarez, that the personnel actions as submitted by the
Chief Examiner dated October 10, 2001, in accordance with Civil Service rules
and Personnel policies adopted by the Mayor and Common Council of the City
of San Bernardino, be approved and ratified.
The motion carried by the following vote: Ayes: Council
Members/Commissioners Estrada, Lien, McGinnis, Schnetz, Suarez, Anderson,
McCammack. Nays: None. Absent: None
9. RES. 2001-318 - Resolution of the Mayor and Common Council authorizing
the submittal of the AQMD Triennial Employee Trip Reduction Plan.
Council Member/Commissioner Anderson made a motion, seconded by Council
Member/Commissioner Suarez, that said resolution be adopted.
Resolution No. 2001-318 was adopted by the following vote: Ayes: Council

10. Reject All Bids - Installation of Cross Gutter & Improvements at 13th &
"G" Streets
Council Member/Commissioner Anderson made a motion, seconded by Council
Member/Commissioner Suarez, that the Mayor and Common Council reject all
bids submitted for the installation of cross gutter and improvements at 13th Street
and "G" Street, revise plans and specifications, and re-advertise for bids.
The motion carried by the following vote: Ayes: Council
Members/Commissioners Estrada, Lien, McGinnis, Schnetz, Suarez, Anderson,
McCammack. Nays: None. Absent: None.
11. RES. 2001-319 - Resolution of the City of San Bernardino approving
Amendment No. 3 to Professional Services Agreement with Architect
Milford Wayne Donaldson, FAIA, Inc. for preparing final plans,
specifications, and estimate for renovation and retrofit of the San
Bernardino Santa Fe Depot.
Council Member/Commissioner Anderson made a motion, seconded by Council
Member/Commissioner Suarez, that said resolution be adopted.

12. RES. 2001-320 - Resolution of the Mayor and Common Council of the City
of San Bernardino awarding a contract to JP Striping for signing and
striping of bicycle lanes for Phase I and Phase II of City adopted Bicycle
Facilities Master Plan per Plan No. 10229.
Council Member/Commissioner Anderson made a motion, seconded by Council
Member/Commissioner Suarez, that said resolution be adopted.

13. Authorize Utilization of Salary Savings to Fund the Development Services
Department's Public Counter Reconfiguration Project & Computer
Equipment Upgrades to Streamline Permit Processing
Council Member/Commissioner Anderson made a motion, seconded by Council
Member/Commissioner Suarez, that the Director of Finance be authorized to
amend the FY 2001/02 Development Services Department budget and transfer
$47,800 from salary savings into appropriate accounts to be used to fund the
Department's Public Counter Reconfiguration Project and computer equipment
upgrades to streamline permit processing.
The motion carried by the following vote: Ayes: Council
Members/Commissioners Estrada, Lien, McGinnis, Schnetz, Suarez, Anderson,
McCammack. Nays: None. Absent: None.
14. Set joint Mayor and Common Council & Planning Commission luncheon
workshop - November 5, 2001, at 12:00 p.m. in the EDA Boardroom -
Presentation of Economic Analysis Report related to the General Plan
update by David Wilcox of Economics Research Associates (ERA)
Council Member/Commissioner Anderson made a motion, seconded by Council
Member/Commissioner Suarez, that a joint Mayor and Common Council and
Planning Commission luncheon workshop be set for November 5, 2001 at 12:00
p.m. in the Economic Development Agency Boardroom for a presentation of the
Economic Analysis Report related to the General Plan update by David Wilcox,
of Economics Research Associates (ERA).

15. RES. 2001-325 - Resolution of the Mayor and Common Council of the City
of San Bernardino authorizing the Purchasing Manager to issue a purchase
order to Aether Systems Inc. in the amount of $119,467.75 for Fire Records
Management System (RMS) 5.0 software.
Council Member/Commissioner McGinnis made a motion, seconded by Council
Member/Commissioner Anderson, that the Director of Finance be authorized to
amend the FY 2001102 Information Services (I.S.) budget and appropriate
$60,700 from I.S. fund balance to Account No. 679-251-5702 for the purpose
of purchasing the Fire RMS 5.0 software from Aether Systems Inc.; and that
said resolution be adopted.
The motion carried and Resolution No. 2001-325 was adopted by the following
vote: Ayes: Council Members/Commissioners Estrada, Lien, McGinnis,
Schnetz, Suarez, Anderson. Nays: None. Absent: Council
Member/Commissioner McCammack.
16. RES. 2001-321 - A Resolution of the Mayor and Common Council of the
City of San Bernardino approving that certain 2001 loan agreement by and
among the City of San Bernardino, the San Bernardino Valley Municipal
Water District, and the San Bernardino Regional Water Resources
Authority, on the terms set forth in such agreement.
Council Member/Commissioner Anderson made a motion, seconded by Council
Member/Commissioner Suarez, that said resolution be adopted.

17. RES. 2001-326 - Resolution of the Mayor and Common Council of the City

Education or Environmental Education Program under the Safe
Neighborhood Parks, Clean Water, Clean Air, and Coastal Protection Bond
Act of 2000 for renovation of Santa Fe Depot.
Council Member/Commissioner McGinnis made a motion, seconded by Council
Member/Commissioner Estrada, that said resolution be adopted.

18. RES. 2001-327 - Resolution of the City of San Bernardino approving the
application for grant funds for Urban Recreational and Cultural Centers,
Museums, and Facilities for Wildlife Education or Environmental
Education Program under the Safe Neighborhood Parks, Clean Water,
Clean Air, and Coastal Protection Bond Act of 2000 for renovation of
Roosevelt Bowl.
Council Member/Commissioner McGinnis made a motion, seconded by Council
Member/Commissioner Estrada, that said resolution be adopted.

19. RES. 2001-322 - Resolution of the Mayor and Common Council of the City
of San Bernardino authorizing the Mayor of the City of San Bernardino or
her designee to execute a Memorandum of Understanding with the
Highland Senior Center, Highland District Council on Aging, Inc., relating
to a Nutrition for Seniors Program.
Council Member/Commissioner Anderson made a motion, seconded by Council
Member/Commissioner Suarez, that said resolution be adopted.
Resolution No. 2001-322 was adopted by the following vote: Ayes: Council
Members/Commissioners Estrada, Lien, McGinnis, Schuetz, Suarez, Anderson,

20. RES. 2001-323 - Resolution authorizing the Mayor of the City of San
Bernardino or her designee to apply for and administer a grant in the
amount of $32,290 per year from the California Department of Health
Services, California Nutrition Network for the administration and
promotion of healthy eating habits and physical activity intervention
through nutrition classes, food demonstrations, and enhancing the
community awareness of nutritional and physical activities benefits for the
two year period of October 1, 2001 through September 30,2003.
Council Member/Commissioner Anderson made a motion, seconded by Council
Member/Commissioner Suarez, that said resolution be adopted.

21. Authorize Submittal of Grant Application - Mobile Source Air Pollution
Reduction Review Committee (MSRC) Funds - Construction of East Valley
LNG/LCNG Fueling Facility
Council Member/Commissioner Anderson made a motion, seconded by Council
Member/Commissioner Suarez, that the Mayor and Common Council approve
the submittal of a grant application for Mobile Source Air Pollution Reduction
Review Committee (MSRC); authorize the proposed East Valley Regional
LCNG Fueling Facility project; commit the City to the project implementation
schedule as submitted in the CMAQ grant application; and allocate AB 2766
Subvention Funds in the amount of no less than $35,500 (30% of local match)
and no more than $59,100 (50% of local match) towards this project.
The motion carried by the following vote: Ayes: Council
Members/Commissioners Estrada, Lien, McGinnis, Schnetz, Suarez, Anderson,
McCammack. Nays: None. Absent: None.
22. RES. 2001-324 - Resolution of the Mayor and Common Council of the City
of San Bernardino accepting a grant deed from Stephan C. Allan for
property located at 1396 Pico Avenue, San Bernardino, and dedicating the
property for Water Department use.
Council Member/Commissioner Anderson made a motion, seconded by Council
Member/Commissioner Suarez, that said resolution be adopted.

23. Request for Waiver of Fees - McDonald's Car Show & Cruise - November
10, 2001
RES. 2001-328 - Resolution of the Mayor and Common Council of the City
of San Bernardino authorizing an agreement with Juan Polio, Inc. and the
City of San Bernardino for reimbursement to City of waiver of fees granted
in connection with the 2001 McDonald's Car Show and Cruise.

Council Member/Commissioner Lien made a motion, seconded by Council
Member/Commissioner Estrada, that the request for a waiver of fees in the
amount of $4,385 for facility, personnel and equipment costs associated with the
McDonald's Car Show and Cruise and related activities on November 10,2001,
be approved, subsequent to certain conditions; and that said resolution be
adopted.
The motion carried and Resolution No. 2001-328 was adopted by the following
vote: Ayes: Council Members/Commissioners Estrada, Lien, McGinnis,
Schnetz, Suarez, Anderson, McCammack. Nays: None. Absent: None.
24. Request for Waiver of Fees - Red Ribbon Week Parade & Activities -
October 27, 2001
Council Member/Commissioner Anderson made a motion, seconded by Council
Member/Commissioner Estrada, that the request for a waiver of fees in the
amount of $7,251 for facility, personnel and equipment costs associated with the
Red Ribbon Week Parade and activities on October 27,2001, be approved.
The motion carried by the following vote: Ayes: Council
Members/Commissioners Estrada, Lien, McGinnis, Schnetz, Suarez, Anderson,
McCammack. Nays: None. Absent: None.
25. Public Hearing - Development Code Amendment No. 01-05 - To Expand
the Permitted Uses at the Carousel Mall
An Ordinance of the City of San Bernardino amending Section 19.06.020 of
the San Bernardino Municipal Code (Development Code) to add permitted
uses in the CR-l, Commercial Regiona]-Malls land use district. FIRST
READING
Correspondence was entered into the record from Salvatore Catalano, General
Manager of the Carousel Mall, dated Octoher 12, 2001, addressed to Valerie
Ross, Principal Planner, requesting that the matter be continued.
Council Member/Commissioner Suarez made a motion, seconded by Council
Member/Commissioner Anderson, that the matter be continued to the
Council/Commission meeting of November 19, 2001.
The motion carried by the following vote: Ayes: Council
Members/Commissioners Estrada, Lien, McGinnis, Schnetz, Suarez, Anderson,
McCammack. Nays: None. Absent: None.

26. An Ordinance of the City of San Bernardino amending Section 10.16.120 of
the San Bernardino Municipal Code relating to parking of motor trucks in a
residential district. FIRST READING
City Attorney Penman stated that according to the California Vehicle Code, a
city could prohibit commercial vehicles (semi-trucks) exceeding a gross vehicle
weight of 10,000 pounds from parking in residential districts, and this
amendment would bring the Municipal Code in line with the Vehicle Code.
Council Member/Commissioner Schnetz was worried that the ordinance would
prohibit privately-owned recreational andlor business trucks weighing 10,000
pounds or more from parking on residential streets.
City Attorney Penman stated that according to the Vehicle Code, they could
exempt recreational vehicles. He indicated that complaints have only been
received relative to semi-trucks, and did not feel there would be a problem with
privately-owned vehicles. Mr. Penman advised that if a problem arises in the
future, the City might have to revisit the ordinance.
It was the consensus of the Council that the matter should go to the Legislative
Review Committee for more discussion.
Council Member/Commissioner McCammack made a motion, seconded by
Council Member/Commissioner Anderson, that said ordinance be laid over for
final adoption; and that the matter be referred back to the Legislative Review
Committee.

McCammack. Nays: None. Absent: None.
27. Luncheon workshop - 12:00 p.m. - Economic Development Agency
Boardroom - Presentation by Caltrans and SANBAG staff regarding the
proposed street closure alternatives relatiye to the construction of 1-215 -
Discuss proposed development of the Aesthetic/Landscape Master Plan
Consultants and representatives from SANBAG and Caltrans gave an overview
of the project covering topics such as the tentative project schedule, project
design issues, temporary street closures, the potentia] impact to businesses
located along the right of way, the cooperative freeway agreement process and
Memorandum of Understanding, and master plan landscaping issues.

It was the consensus of the Council that the arrowhead motif would be
incorporated into the Interchange for starters, with additional concepts to be
developed moving south on the 1-215. No action was taken on this item.
28. Public Comments
Teresa Lopez, 683 N. Ramona Avenue. San Bernardino, CA, Wests ide
Residents for Cleaner Air Now, read the results of tests performed by an
independent environmental testing company of the Omnitrans fueling station and
the surrounding area.
Roger Henderson, 2516 Valencia, San Bernardino, CA, indicated his support
of Measure I relative to the hiring of outside counsel.
Rich Dietz, 1398 N. "E" Street, San Bernardino, CA, on behalf of the Historic
McDonald's Museum, thanked the Council for their support of the parade to be
held on November 10, 2001.
Jim Pemnan, speaking as a citizen, 221 E. Marshall Blvd., San Bernardino,
CA, stated that Measure I was not about second legal opinions, it was about
whether the Mayor and Council could hire someone else to do all or part of the
work of the elected City Clerk, City Attorney, and City Treasurer.
Gordon McGinnis, speaking as a citizen, 2528 York Court, San Bernardino,
CA, stated that he felt there was nothing wrong with getting a second opinion on
City matters.
Wendy McCammack, speaking as a citizen, 634 Parkdale Drive, San
Bernardino, CA, asked if taxpayers wanted to allow the Mayor and Council to
continue to spend additional tax dollars on the hiring of outside lawyers without
the permission of the elected City Attorney.

Council Member/Commissioner Lien made a motion, seconded by Council

Council Member/Commissioner Lien stated that the Buddhist Society of San
Bernardino was notified by Lt. Mark Emoto that it would be necessary for them
to get a waiver of fees or they would be billed for police services. Ms. Lien
stated that she was not aware of the total amount needed for the event.
Council Member/Commissioner Lien indicated that the Police Department had
requested more time in which to meet with the Buddhist Temple to find out
exactly what the issues were, and if any action needed to be taken on a waiver
of fees, it could be done retroactively.
Mayor Valles suggested setting aside a special events budget in order to avoid
impacting specific departments.
No action was taken on this item.

The following documents were distributed to the Mayor and Common Council,
and Barbara Lindseth, Economic Development Agency Director of
Administrative Services, reviewed highlights of each: Redevelopment Project
Areas Last Date to Incur Debt; Economic Development Agency Tax Increment
Projections; Tax Allocation Refunding Bonds Series 1995A and 1995B; and Tax
Allocation Bonds Restructuring Program.
Discussion ensued regarding the pros and cons of the Tax Allocation Bonds
Restructuring Program.
No action was taken on this item.
