COUNCIL CHAMBERS
The joint regular meeting of the Mayor and Common Council and Community
Development Commission of the City of San Bernardino was called to order by
Mayor/Chairman Valles at 8:15 a.m., Monday, July 23,2001, in the Council Chambers
of City Hall, 300 North "D" Street, San Bernardino, California.

The invocation was given by Pastor Woody Hall of the Lutheran Church of Our Savior,
followed by the pledge of allegiance, led by Steven Garcia, a third grade student at
Ramona Alessandro Elementary School.

4. Annonncements
Announcements were made by the Mayor and Common Council and elected
officials regarding various civic and community events/activities.
5. Waive Full Reading of Resolutions & Ordinances
Council Member/Commissioner McGinnis made a motion, seconded by Council
Member/Commissioner Anderson, that full reading of the resolutions and
ordinances on the regular agenda of the Mayor and Common Council/Community
Development Commission, be waived.
The motion carried by the following vote: Ayes: Council
Members/Commissioners Lien, McGinnis, Schnetz, Suarez, Anderson,

6. Council Minutes
Council Member/Commissioner McGinnis made a motion, seconded by Council
Member/Commissioner Anderson, that the minutes of the July 3, 2001 meeting
of the Mayor and Common Council/Community Development Commission of the
City of San Bernardino, be approved as submitted in typewritten form.

7. Claims & Payroll
Council Member/Commissioner McGinnis made a motion, seconded by Council
Member/Commissioner Anderson, that the claims and payroll and the
authorization to issue warrants as listed on the memorandum dated July 18, 2001
from Barbara Pachon, Director of Finance, be approved.
The motion carried by the following vote: Ayes: Council
Members/Commissioners Lien, McGinnis. Schnetz, Suarez, Anderson,
McCammack. Nays: None. Absent: Council Member/Commissioner Estrada.
8. Personnel Actions
Council Member/Commissioner McGinnis made a motion, seconded by Council
Member/Commissioner Anderson, that the personnel actions as submitted by the
Chief Examiner dated July 16, 2001, in accordance with Civil Service rules and
Personnel policies adopted by the Mayor and Common Council of the City of San
Bernardino, be approved and ratified.
The motion carried by the following vote: Ayes: Council
Members/Commissioners Lien, McGinnis. Schnetz, Suarez, Anderson,
McCammack. Nays: None. Absent: Council Member/Commissioner Estrada.
9. RES. 2001-229 - Resolution of the Mayor and Common Council of the City
of San Bernardino authorizing an agreement with the City of San
Bernardino and Western Regional Little League Baseball for financial
assistance from the Civic and Promotion Fund for FY 2001102.
10. RES. 2001-230 - Resolution of the Mayor and Common Council of the City
of San Bernardino authorizing the execution of a professional services
agreement between Lewis, D' Amato, Brisbois & Bisgaard and the City of
San Bernardino to represent the City in the case of Jonathan Smith v. City of
San Bernardino, et at.
Council Member/Commissioner McGinnis made a motion, seconded by Council
Member/Commissioner Anderson, that said resolutions be adopted.

11. Agreement for Audit - Economic Development Agency's Acquisition
Rehabilitation & Resale & Mortgage Assistance Programs
RES. 2001-231 - Resolution of the Mayor and Common Council of the City
of San Bernardino authorizing the execution on behalf of said City of an
agreement for professional services between Harvey M. Rose Accountancy
Corporation, the City of San Bernardino, and the City of San Bernardino
Economic Development Agency to conduct an audit of certain segments of
the Economic Development Agency's Acquisition, Rehabilitation and Resale
and Mortgage Assistance Program. (lIA)
RES. CDC/2001-26 Resolution of the Community Development
Commission of the City of San Bernardino, California, authorizing the
execution on behalf of the City of San Bernardino Economic Development
Agency of an agreement for professional services between Harvey M. Rose

12. ORD. MC-lIOO - An ordinance of the City of San Bernardino amending
Sections 5.14.010, 5.14.020, 5.14.040 and 5.14.050 of Chapter 5.14 of the
San Bernardino Municipal Code relating to entertainment - dances and
adult entertainment. FINAL READING
Council Member/Commissioner McGinnis made a motion, seconded by Council
Member/Commissioner Anderson, that said ordinance be adopted.
Ordinance No. MC-II00 was adopted by the following vote: Ayes: Council
Members/Commissioners Lien, McGinnis, Schnetz, Suarez, Anderson,
McCammack. Nays: None. Absent: Council Member/Commissioner Estrada.

\3. RES. 2001-236 - Resolution of the City of San Bernardino establishing a fair
market value and minimum sale price for a certain City owned parcel of real
property generally located on the northwest corner of Little League Drive
and the 1-215 Frontage Road and giving notice inviting competitive sealed
and oral bids for the sale of said property.
Council Member/Commissioner Anderson made a motion, seconded by Council
Member/Commissioner Suarez, that said resolution be adopted.
Resolution No. 2001-236 was adopted by the following vote: Ayes: Council
Members/Commissioners Lien, McGinnis, Schnetz, Suarez, Anderson,
McCammack. Nays: None. Absent: Council Member/Commissioner Estrada.
14. Resolution of the City of San Bernardino authorizing the execution of an
agreement with Site Management Services, Inc. relating to the installation of
mobile/wireless communications facilities on certain streetlight poles and
traffic signal poles owned or controlled by the City.
Council Member/Commissioner McCammack made a motion, seconded by
Council Member/Commissioner Anderson, that the matter be continued to the
Mayor and Common Council/Community Development Commission meeting of
August 6, 2001.
The motion carried by the following vote: Ayes: Council
Members/Commissioners Lien, McGinnis. Schnetz, Suarez, Anderson,
McCammack. Nays: None. Absent: Council Member/Commissioner Estrada.
15. RES. 2001-232 - Resolution of the Mayor and Common Council of the City
of San Bernardino awarding a contract to New West Signal Corporation for
traffic signal interconnect on 40th Street between Kendall Drive and
Sepulveda Avenue per Plan No. 10154.
Council Member/Commissioner McGinnis made a motion, seconded by Council
Member/Commissioner Anderson, that said resolution be adopted; and that the
Mayor and Common Council authorize the Director of Finance to amend the FY
2001102 budget and transfer $\3,000 from Account No. 250-370-5504-7076
(Various Traffic System Upgrades) to Account No. 250-370-5504-7208 (40th
Street Signal Interconnect).
The motion carried and Resolution No. 2001-232 was adopted by the following
vote: Ayes: Council Members/Commissioners Lien, McGinnis, Schnetz,
Suarez, Anderson, McCammack. Nays: None. Absent: Council

16. RES. 2001-233 - Resolution of the Mayor and Common Council of the City
of San Bernardino awarding a contract to DBX, Inc. for installation of
traffic signals at Rialto Avenue and Sierra Way per Plan No. 10158.
Council Member/Commissioner McGinnis made a motion, seconded by Council
Member/Commissioner Anderson, that said resolution be adopted.
Resolution No. 2001-233 was adopted by the following vote: Ayes: Council
Members/Commissioners Lien, McGinnis, Schnetz, Suarez, Anderson,
McCammack. Nays: None. Absent: Council Member/Commissioner Estrada.
17. RES. 2001-234 - Resolution of the Mayor and Common Council of the City
of San Bernardino awarding a contract to DBX, Inc. for installation of
traffic signals at 16'" Street and Medical Center Drive per Plan No. 10142.
Council Member/Commissioner McGinnis made a motion, seconded by Council
Member/Commissioner Anderson, that said resolution be adopted; and that the
Director of Finance be authorized to amend the FY 2001102 budget and transfer
$13,800 from Account No. 129-367-5504-7202 (Disabled Access Ramps -
various locations) to Account No. 250-370-5504-7209 (16'" Street and Medical
Center Drive Trafiic Signal) and also to amend revenue Account No. 250-000-
4650 (Federal Aid Street Construction) to include an additional $18,000.
The motion carried and Resolution No. 2001-234 was adopted by the following
vote: Ayes: Council Members/Commissioners Lien, McGinnis, Schnetz,
Suarez, Anderson, McCammack. Nays: None. Absent: Council
Member /Commissioner Estrada.
18. RES. 2001-237 - Resolution of the City of San Bernardino establishing and
setting fair market value and sales price of $17,400.00 and declaring the
intention of the City to sell property generally located northwesterly of
University Parkway, northeasterly of Kendall Drive in the City of San
Bernardino, University Commons, LLC and setting a public hearing to
consider said sale.
Council Member/Commissioner Anderson made a motion, seconded by Council
Member/Commissioner Suarez, that the Director of Development Services be
authorized to proceed with the sale of City property, being a portion of the
vacated portion of University Parkway, northeasterly of Kendall Drive; and that
said resolution be adopted.
The motion carried and Resolution No. 2001-237 was adopted by the following
vote: Ayes: Council Members/Commissioners Lien, McGinnis, Schnetz,
Suarez, Anderson, McCammack. Nays: None. Absent: Council
Member/Commissioner Estrada.

19. RES. 2001-235 - Resolution of the City of San Bernardino approving an
agreement with Liebert Cassidy Whitmore for labor relations training
services.
Council Member/Commissioner McGinnis made a motion, seconded by Council
Member/Commissioner Anderson, that said resolution be adopted.
Resolution No. 2001-235 was adopted by the following vote: Ayes: Council
Members/Commissioners Lien, McGinnis, Schnetz, Suarez, Anderson,
McCammack. Nays: None. Absent: Council Member/Commissioner Estrada.
20. Resolution of the City of San Bernardino authorizing the Mayor of San
Bernardino to execute a services agreement with the San Bernardino City
Unified School District for the operation of the School Crossing Guards
Program by the Police Department.
GiI Navarro, 1440 W. Sixth Street, San Bernardino, CA, representing the
Mexican-American Political Association (MAPA), suggested that there be an
intensive overall review of several City schools and felt there should be more
parent volunteers to ensure the safety of the children.
Council Member/Commissioner Anderson made a motion, seconded by Council
Member/Commissioner Suarez, that the matter be continued to the Mayor and
Common Council/Community Development Commission meeting of August 20,
2001.
The motion carried by the following vote: Ayes: Council
Members/Commissioners Lien, McGinnis. Schnetz, Suarez, Anderson,
McCammack. Nays: None. Absent: Council Member/Commissioner Estrada.
21. RES. 2001-238 - Resolution of the Mayor and Common Council of the City
of San Bernardino approving the Utility User's Tax Summer Rebate
Program and authorizing the execution of an agreement between the City of
San Bernardino and CBS Payroll for the provision of UUT rebate-check
processing services.
Council Member/Commissioner Suarez made a motion, seconded by Council
Member/Commissioner Anderson, that said resolution be adopted.

22. RES. 2001-239 - Resolution of the Mayor and Common Council of the City
of San Bernardino, California, authorizing enactment of a formula for the
reduction of the Utility User's Tax in the City of San Bernardino.

Council Member/Commissioner Schnetz, that said resolutions be adopted.

24. Discuss & Take Possible Action - Proposed Charter Amendment
RES. 2001-241 - Resolution of the City of San Bernardino proposing an
amendment to the Charter of said City relating to employment of legal
counsel. (24A)
RES. 2001-242 - Resolution of the City of San Bernardino submitting to the
electors a proposed Charter Amendment relating to employment of legal
counsel; transmission of the proposed Charter Amendment to the Office of
the City Attorney for purposes of preparation of an impartial analysis.

Gil Navarro, 1440 W. Sixth Street, San Bernardino, CA, representing the
Mexican-American Political Association (MAPA), spoke in opposition to this
matter.
Council Member/Commissioner Anderson made a motion, seconded by Council
Member/Commissioner McCammack, that said resolutions be adopted.
Resolution Nos. 2001-241 and 2001-242 were adopted by the following vote:
Ayes: Council Members/Commissioners Lien, Schnetz, Suarez, Anderson,

25. Request for Traffic Signal - Kendall Drive at Wagonwheel Road
An interoffice memorandum from Ray Casey, City Engineer, dated July 19,
2001, addressed to the Mayor and Common Council, was submitted into the
record. The memo provided a pro/con analysis regarding the proposal to install
the subject traffic signal, and included an interoffice memorandum from Anwar
Wagdy, Traffic Engineer, dated July 11, 2001, addressed to the Traffic Safety
Committee, which provided staff's evaluation.
James Funk, Director of Development Services, highlighted some of the pros and
cons of installing the traffic signal.
The following individuals spoke in favor of installing the traffic light: Chas
Kelly, 5066 Varsity, San Bernardino, CA; Pam Escamilla, 5575 Surrey Lane,
San Bernardino, CA; and Diana Olander, 5565 Surrey Lane, San Bernardino,
CA.
Council Member/Commissioner McCammack made a motion, seconded by
Council Member/Commissioner Schnetz, that the Mayor and Common Council
appropriate funds to install a traffic signal at Kendall Drive and Wagonwheel
Road; and that staff be directed to immediately take measures to mitigate the
safety concerns.
The motion carried by the following vote: Ayes: Council
Members/Commissioners Lien, McGinnis, Schnetz, Suarez, Anderson,
McCammack. Nays: None. Absent: Council Member/Commissioner Estrada.

26. RES. 2001-243 - A resolution of the Mayor and Common Council of the City
of San Bernardino approving a quitclaim deed transferring rights to enter to
San Bernardino International Airport Authority for property originally
owned by Ersul Water Company. (Continued from July 9, 2001)
Council Member/Commissioner Suarez made a motion, seconded by Council
Member/Commissioner Anderson, that said resolution be adopted.

27. Luncheon Workshop - EDA Boardroom - 12:00 noon - Discuss & Take
Possible Action Regarding Possible Amendments to the FY 2001-2002 Budget
(Continued from July 9, 2001)
Maggie Pacheco and Glenn Baude submitted an interoffice memorandum into the
record, dated July 18, 2001, regarding proposed Enhancements to Blight
Eradication and Beautification Efforts.
Council Member/Commissioner Suarez made a motion, seconded by Council
Member/Commissioner Anderson, that $25,000 be allocated to Los Padrinos for
Project Curb Appeal; and $50,000 to Los Padrinos for City beautification efforts.
The motion carried by the following vote: Ayes: Council
Members/Commissioners Lien, McGinnis, Suarez, Anderson, McCammack.
Nays: None. Absent: Council Members/Commissioners Estrada, Schnetz.
Council Member/Commissioner Anderson made a motion, seconded by Council
Member/Commissioner McCammack, that $20,000 be allocated to increase the
Convention and Visitors Bureau (CVB) Budget to be used specifically for youth
sports activities.

materials and services related to Code Compliance abatements.

Council Member/Commissioner McGinnis made a motion, seconded by Council
Member/Commissioner Suarez, that $25,000 be allocated for an additional
homework center to be located in the Sixth Ward.

Nays: None. Absent: Council Members/Commissioners Estrada, Schnetz.
Council Member/Commissioner McCammack made a motion, seconded by
Council Member/Commissioner Lien, that $71,100 be allocated to increase
library staff by two full-time positions in order to provide extended evening and
Saturday hours at the Dorothy Inghram and Paul Villasenor Branch Libraries.
The motion carried by the following vote: Ayes: Council
Members/Commissioners Lien, Schnetz, Suarez, Anderson, McCammack. Nays:
Council Member/Commissioner McGinnis. Absent: Council

Council Member/Commissioner Lien made a motion, seconded by Council
Member/Commissioner Anderson, that $14,900 be allocated for tree removal and
replacement of 72 sick trees in the Second Ward.

McCammack. Nays: None. Absent: Council Member/Commissioner Estrada.
Council Member/Commissioner McCammack made a motion, seconded by
Council Member/Commissioner Anderson, that $36,000 be allocated to purchase
software necessary to meet the requirements of the Children's Internet Protection
Act (CIPA), subject to its successful testing and compatibility with existing
I ibrary computer programs, and that the Information Services Director be
involved in the process.
The motion carried by the following vote: Ayes: Council
Members/Commissioners Lien, McGinnis. Schnetz, Suarez, Anderson,
McCammack. Nays: None. Absent: Council Member/Commissioner Estrada.
Council Member/Commissioner Anderson made a motion, seconded by Council
Member/Commissioner Suarez, that $31,500 be allocated for expansion of the
Perris Hill Park Senior Citizen Center.

At 2:25 p.m., Mayor/Chairman Valles called to order the joint regular meeting of the
Community Development Commission/San Bernardino Joint Powers Financing
Authority/San Bernardino Park Acquisition Joint Powers Financing Authority/San
Bernardino Associated Communities Financing Authority and Mayor and Common
Council.

Gary Van Osdel, Executive Director, Economic Development Agency, stated that
the Redevelopment Financing and Cooperation Grant Agreement was not ready to
be brought forward at this time.
No public comments were received.
Council Member/Commissioner Suarez made a motion, seconded by Council
Member/Commissioner Schnetz, that the hearing be closed; and that said
resolutions be adopted.
Resolution Nos. CDC/200l-28 and CDC/2001-29 were adopted by the following
vote: Ayes: Council Members/Commissioners Lien, McGinnis, Schnetz, Suarez,
McCammack. Nays: None. Absent: Council Members/Commissioners Estrada,
Anderson.
Council Member/Commissioner Anderson Arrived
At 2:25 p.m., Council Member/Commissioner Anderson arrived at the Council meeting.
R29. RES. CDC/2001-30 - Resolution of the Community Development
Commission of the City of San Bernardino, California, approving the
Economic Development Agency's Budget for the Fiscal Year 2001-02.
Council Member/Commissioner McCammack indicated that she would be
abstaining from taking action on any line items relating to the Uptown
Redevelopment Area due to the fact that her business is located within that area.
Council Member/Commissioner Suarez made a motion, seconded by Council
Member/Commissioner Anderson, that said resolution be adopted.
Resolution No. CDC1200l-30 was adopted by the following vote: Ayes: Council
Members/Commissioners Lien, McGinnis, Schnetz, Suarez, Anderson. Nays:
None. Abstentions: Council Member/Commissioner McCammack. Absent:
Council Member/Commissioner Estrada.
30. Public Comments
Alberto Lopez, business owner, San Bernardino, CA, extended his thanks to
Council Member Lien and Colin Strange of the Economic Development Agency
for helping him open his restaurant, Papagayos, located at Ninth and Waterman.
The following individuals voiced their concerns regarding the methyl mercaptan
fumes being emitted from the Omnitrans fueling station, and requested that the
City do something about this ongoing situation: Marilyn Alcantar, 1495
Kingman Street, San Bernardino, CA; Gil Navarro, 1440 W. Sixth Street, San
Bernardino, CA, representing the Mexican-American Political Association

(MAPA); Consuelo Lopez, 580 Cabrera, San Bernardino, CA; and Jan
Misquez, 659 N. Hancock, San Bernardino, CA.
Jay Lindberg, 6340 Orange Knoll, San Bernardino, CA, spoke regarding the
inaccurate testing and cleanup of radioactive materials located at the former
Norton Air Force Base.
