This is the time and place heretofore set for an
Adjourned Regular Meeting of the Mayor and Common Council
of the City of San Bernardino at the Regular Meeting held
on Monday, June 17, 1985, at 9: 04 a.m., in the Council
Chambers of City Hall, 300 North "D" Street, San Bernar-
dino, California.
The City Clerk has caused to be posted the Order of
Adjournment of said meeting held on Monday, June 17, 1985,
at 9:04 a.m., and has on file in the office of the City
Clerk an affidavit of said posting on Tuesday, June 18,
1985, at 2:30 p.m., in the Council Chambers of City Hall,
300 North "D" Street, San Bernardino, California.

The Adjourned Regular Meeting of the Mayor and Common
Council of the City of San Bernardino was called to order
by Mayor wilcox at 9:10 a.m., on Wednesday, June 19, 1985,
in the Council Chambers of City Hall, 300 North "D"
Street, San Bernardino, California.
INVOCATION
The Invocation was given by Olen Jones, Jr., Immanuel
Baptist Church.
PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Council Member
Estrada.
ROLL CALL
Roll Call was taken by the City Clerk with the fol-
lowing being present: Mayor Wilcox; Council Members
Estrada, Reilly, Marks, Quiel, Frazier, Strickler. City
Attorney Prince, City Clerk Clark, City Administrator
Matzer. Absent: Council Member Hernandez.

RES. 85-232 - RESOLUTION OF THE MAYOR AND
COMMON COUNCIL OF THE CITY OF SAN BERNAR-
DINO APPROVING THE PROPOSED GRADE SEPARA-
TIONS OF THE CALIFORNIA DEPARTMENT OF
TRANSPORTATION (CALTRANS) CONCERNING THE
FREEWAY INTERCHANGE OF 215 AND 30 BY REMOV-
ING "I" STREET AND CHANGING FLORES STREET
TO THE 27TH STREET GRADE SEPARATION.

The City Clerk read the title of the resolution.
Council Member Quiel made a motion, seconded by
Council Member Strickler and unanimously carried, that
further reading of the resolution be waived and said reso-
lution be adopted.
Resolution No. 85-232 was adopted by the following
vote: Ayes: Council Members Estrada, Reilly, Marks,
Quiel, Frazier, Strickler. Noes: None. Absent: Council
Member Hernandez.

APPEAL HEARING - PLANNING COMMISSION'S DECISION -
PARCEL MAP NO. 9166 - HIGHLAND HILLS PROPERTIES -
HIGHLAND AVENUE AND ORCHARD ROAD - CONTINUED FROM
JUNE 17, 1985
This is the time and place continued to for consider-
ation of an appeal filed by William G. Smith, Highland
Hills Properties, on the Planning Commission's decision of
approval for Parcel Map No. 9166, that areas designated as
"C", "N" and "0" be constructed as the first phase of

development on property located at the northwest corner of
Highland Avenue and Orchard Road, having a frontage of
approximately 1,749 feet on the north side of Highland
Avenue and a frontage of 1,048.7 feet on the west side of
Orchard Road. It was also requested that the ten day
period of appeal be waived. (2)
Mayor wilcox opened the hearing.
william G. Smith, Highland Hills Properties, was
present.
A letter from City Attorney Prince was presented.
Council Member Marks made a motion, seconded by
Council Member Quiel and unanimously carried, to close the
hearing and to direct the Planning Director and City At-
torney to prepare an amendment to the specific plan for
Parcel Map No. 9166, to eliminate the requirement that
areas "C", "N" and "0" be constructed as the first phase
of development.

RES. 85-233 - RESOLUTION OF THE CITY OF SAN
BERNARDINO GRANTING A QUITCLAIM DEED TO
COLLEGE PARKWAY DEVELOPMENT ASSOCIATES, A
CALIFORNIA LIMITED PARTNERSHIP FOR PROPERTY
LOCATED SOUTHEASTERLY OF UNIVERSITY PARKWAY
AT THE BARSTOW FREEWAY (ROUTE 215).
The City Clerk read the title of the resolution.
Council Member Quiel made a motion, seconded by
Council Member Marks and unanimously carried, that further
reading of the resolution be waived and said resolution be
adopted.

AGENCY - ADJOURNED REGULAR MEETING
At 9:20 a.m., the Adjourned Regular Meeting of the
Community Development Commission/Redevelopment Agency was
called to order by Chairman wilcox in the Council Chambers
of City Hall, 300 North "D" Street, San Bernardino,
California.
RECESS MEETING - CLOSED SESSION
At 9:20 a.m., the Adjourned Regular Meeting of the
Community Development Commission/Redevelopment Agency
recessed to a Closed Session to discuss pending litigation
on the high groundwater problem.
CLOSED SESSION
At 9:20 a.m., the Closed Session of the Community
Development Commission/Redevelopment Agency was called to
order by Chairman wilcox in the Conference Room, Council
Chambers of City Hall, 300 North "D" Street, San Bernar-
dino, California.

At 11:00 a.m., the Closed Session of the Community
Development Commission/Redevelopment Agency adjourned to
the Adjourned Regular Meeting in the Council Chambers of

RECONVENE MEETING
At 11:00 a.m., the Adjourned Regular Meeting of the
Community Development Commission/Redevelopment Agency
reconvened in the Council Chambers of City Hall, 300 North
"D" Street, San Bernardino, California.
ROLL CALL
Roll Call was taken by the City Clerk with the fol-
lowing being present: Mayor Wilcox, Council Members
Estrada, Reilly, Marks, Quiel, Frazier, Strickler; City
Attorney Prince, City Clerk Clark. Absent: Council Mem-
ber Hernandez, City Administrator Matzer.

SAN BERNARDINO VALLEY MUNICIPAL WATER DISTRICT -
PROPOSAL - HIGH GROUNDWATER PROBLEM - PENDING
LITIGATION - CONTINUED FROM JUNE 17, 1985
In a memorandum dated June 18, 1985, Glenda Saul,
Executive Director, Redevelopment Agency, explained that
the San Bernardino Valley Municipal Water District had
submitted a proposal for settlement of litigation present-
ly pending between the Municipal Water District and the
Redevelopment Agency. The proposal for settlement was
submitted by the Municipal Water District with a request
for placement on the Agenda of June 17, 1985, at which
time the matter was continued to June 19, 1985. Ms. Saul
recommended that, because the matter is in litigation, it
be discussed in a Closed Session. (R-l)
George Aguilar, Director, the San Bernardino Valley
Municipal Water District, introduced the following per-
sons: Randy Van Gelder, Controller; Joe Allen, professor;
Lou Fletcher, General Manager; William Katona, Director;
and Bob Rider, Assistant Chief Engineer.
Randy Van Gelder, Controller for the San Bernardino
Valley Municipal Water District, explained the Water Dis-
trict's concerns regarding the high groundwater problem in
San Bernardino and used a map to show the affected areas.
Mr. Van Gelder also gave a slide presentation.
Professor Joe Allen discussed the difficulties of
liquifaction resulting from an earthquake and the earth-
quake potential for the San Bernardino area.

Lou Fletcher, General Manager, San Bernardino Valley
Municipal Water District, also spoke regarding earthquake
problems in San Bernardino and asked the Council for fund-
ing to install a pumping system to eliminate the high
groundwater problem.
Bill Katona, Director, San Bernardino Valley Munici-
pal Water District, explained the Board's request for
"pass through" Redevelopment Agency tax increment funds
to correct the high groundwater situation.
George Aguilar, Director, San Bernardino Valley Muni-
cipal Water District, answered questions of the Mayor and
Council.
It was explained to Mr. Aguilar that the San Bernar-
dino Valley Municipal District had come before the Council
previously and had requested funds for pumping and those
funds had been granted as requested.

CITY CLERK CLARK LEFT
At 11:55 a.m., City Clerk Clark left the Council
Meeting.

DEPUTY CITY CLERK REESE ARRIVED
At 11:55 a.m., Deputy City Clerk Reese arrived at the
Council Meeting.

Lou Fletcher, General Manager, San Bernardino Valley
Municipal Water District, answered questions and explained
what would be required to get the groundwater down to a
safe level. He also referred to potential increased
dangers with the advent of a wet winter. He suggested
that a solution to the problem would be a magnificent
pumping system.
Council Member Marks made a motion, seconded by
Council Member Strickler and unanimously carried, that the
matter of the high groundwater issue be referred to the
Mayor and staff.
COUNCIL MEMBER STRICKLER LEFT
Council Member Strickler left the Council Meeting.

PUBLIC HEARING - BOARD OF WATER COMMISSIONERS
AIR STRIPPING PROJECT - NEWMARK PLANT FACILITIES
Council Member Marks made a motion, seconded by
Council Member Frazier and unanimously carried, that the
Council set a joint hearing with the Board of Water Com-
missioners regarding the proposed air stripping project at
the Newmark Plant Facilities to remove organic components
from the water to meet State Health Department's stan-
dards, and that the joint hearing be held on July 2, 1985,
at 9:30 a.m., in the Council Chambers, 300 North "D"
Street, San Bernardino, California.
COUNCIL MEMBER QUIEL LEFT
Council Member Quiel left the Council Meeting.
ADJOURNMENT
At 12:10 p.m., Council Member Reilly made a motion,
seconded by Council Member Estrada and unanimously car-
ried, that the Adjourned Regular Meeting be adjourned to
Tuesday, June 25, 1985, at 9:00 a.m., in the Council Cham-
bers of City Hall, 300 North "D" Street, San Bernardino,
California.
