Invocation/Pledge of Allegiance The invocation was given by Chaplain David Randolph of San Bernardino Community Hospital, followed by the pledge of allegiance, led by Sahara Keaton and Matthew Alberdine, fifth grade students from Bradley Elementary School. 2. Appointment - L. Ray Frisbie - Bureau of Franchises - Council Member/Commissioner Longville Council Member/Commissioner McGinnis made a motion, seconded by Council Member/Commissioner McCammack, that the appointment of L. Absent: None. 3. Presentations & Proclamations Ayes: Council Members/Commissioners Kelley, Johnson, McCammack. Nays: Council Member/Commissioner Longville publicly thanked Dennis Cole for his valuable service as a member of the Bureau of Franchises and for remaining until she found a qualified replacement. Certificates of Recognition were presented to representatives from the teams participating in this year's Western Regional Little League Tournament: Diamond - West Little League (Alaska); Deer Valley Little League (Arizona); Conejo Valley (Southern California); Visalia National Little League (Northern California); Kihei Little League (Hawaii); West Valley Little League (Idaho); Missoula Southside Little League (Montana); Murray Hill Little League (Oregon); Green Valley Little League (Nevada); Taylorsville Little League (Utah); Redmond North Little League (Oregon); and Gillette Little League (Wyoming). Mike Legge, Western Regional Director of Little League, presented the City with a set of 12 pins from this year's representatives in the tournament and the regional tournament pins. Certificates of Recognition were presented to the team members of Newmark Little League All Star team who won not only the first District 43 championship title for 11 year olds, but also the Section 7 championship title. A resolution of commendation was presented to John and Maria Stamos, owners of Jack and Jill Restaurant for over 40 years, on the occasion of their retirement. A resolution of commendation was presented to Jack Hill, longtime member of the Library Board, on his retirement. Mike Briones, President of the San Bernardino Girls Fastpitch Association presented t-shirts to Lemuel Randolph, Mitch Assumma and Ray Andrade for their assistance with the Mini All -Star Tournament that took place on July 23-28. June Durr, Public Information Officer in the Mayor's Office, read a proclamation designating the month of August as "Purple Ribbon Month" in order to educate and raise awareness of "Kaitlyn's Law" and the dangers of leaving children unattended in or around motor vehicles. 4 08/02/2004 91 5 A Announcements Announcements were made by members of the Common Council, elected officials, and a representative from the Chamber of Commerce regarding various civic, community, and chamber events and activities. Waive Full Reading of Resolutions & Ordinances Council Member/Commissioner McGinnis made a motion, seconded by Council Member/Commissioner McCammack, that full reading of the resolutions and ordinances on the regular and supplemental agendas of the Mayor and Common Council/Community Development Commission, be waived. Personnel Actions Council Member/Commissioner McGinnis made a motion, seconded by Council Member/Commissioner McCammack, that the personnel actions as submitted by the Chief Examiner dated July 27, 2004 in accordance with Civil Service rules and Personnel policies adopted by the Mayor and Common Council of the City of San Bernardino, be approved and ratified. RES. 2004-243 - Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the Mayor to execute an Animal Housing Services Agreement by and between the City of San Bernardino and the City of Colton from July 1, 2004 through June 30, 2007. Council Member/Commissioner McGinnis made a motion, seconded by Council Member/Commissioner McCammack, that said resolution be adopted. RES. 2004-245 - Resolution of the City of San Bernardino approving Agreement for services with Transtech Engineers, Inc. and Willdan for engineering plan checking services. Council Member/Commissioner McGinnis made a motion, seconded by Council Member/Commissioner McCammack, that said resolution be adopted. RES. 2004-246 - Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the execution of a lease renewal option to the County of San Bernardino Sheriffs Search and Rescue, located at 3250 Harrison Avenue. Council Member/Commissioner McGinnis made a motion, seconded by Council Member/Commissioner McCammack, that said resolution be adopted. RES. 2004-247 - Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the execution of a contract with and issuance of a purchase order to Industrial Air Innovations, Inc. for the replacement of two cooling towers at Carousel Mall in the City of San Bernardino. Council Member/Commissioner McGinnis made a motion, seconded by Council Member/Commissioner McCammack, that said resolution be adopted; and that the Community Development Commission of the City of San Bernardino authorize the Redevelopment Agency of the City of San Bernardino to allocate $92,000 in 1999 Central City COP Bond proceeds for the replacement cost of two cooling towers at Carousel Mall in the City of San Bernardino. 7 08/02/2004 The motion carried and Resolution No. 2004-247 was adopted by the following vote: Ayes: Council Members/Commissioners Estrada, Longville, McGinnis, Derry, Kelley, Johnson, McCammack. RES. 2004-248 - Resolution of the City of San Bernardino authorizing the Mayor of the City of San Bernardino or her designee to execute Amendment No. 6 to the Agreement with San Bernardino City Unified School District, relating to delivery of breakfasts, snacks, and lunches to Delmann Heights Headstart Center. Council Member/Commissioner Kelley abstained on this matter because he is employed by the San Bernardino City Unified School District and City Attorney Penman abstained because his wife is a member of the San Bernardino City Unified School Board. Council Member/Commissioner McGinnis made a motion, seconded by Council Member/Commissioner McCammack, that said resolution be adopted. RES. 2004-250 - Resolution of the Mayor and Common Council of the City of San Bernardino approving the declaration of surplus property; the purchase and sale agreement for the Bennett Well; and the sale of the Bennett Well property and fixtures to the City of Loma Linda. RES. 2004-251 - Resolution ratifying the submittal of a grant application to the Federal Department of Education in the amount of $496,871 to provide youth mentoring services for a 36 month period beginning September 1, 2004 through August 31, 2007. Council Member/Commissioner McCammack made a motion, seconded by Council Member/Commissioner Derry, that said resolution be adopted. Public hearing - to consider a resolution adjusting or establishing various Parks, Recreation and Community Services fees, Cemetery fees, and Fire Department fees RES. 2004-252 - A Resolution of the City of San Bernardino establishing certain fees for services furnished by the City of San Bernardino, and repealing Resolution No. 2004-58, Resolution No. 97-271, Resolution No. 96-152, and Resolution No. 94-66. Mayor Pro Tem/Acting Chairman Longville opened the hearing. Fred Wilson, City Administrator, provided a brief overview. Pursuant to Resolution No. 2000-279, City Clerk Clark administered an oath to the following individuals that they would provide true and honest testimony: Karen Fricke, Executive Director of the Apartment Association of the Greater Inland Empire, stated that they were opposed to the inspection program and the mandatory fees. She requested that the City impose fines on the poorly run properties rather than use fees to fund the eight new Fire Department positions. Louise Ceccarelli, Apartment Association Membership Development Manager, stated that the proposed inspection program makes the assumption that every landlord and owner of multi -family housing in the City is a slumlord, which is not true. Kenneth Horton, property owner in San Bernardino, asked if the Council would consider imposing a smaller annual inspection fee per unit. Council Member/Commissioner Longville stated that perhaps in the future owners could be given a waiver if they do not receive any violations. 9 08/02/2004 Council Member/Commissioner McCammack made a motion, seconded by Council Member/Commissioner Estrada, that the hearing be closed; and that said resolution be adopted. Public hearing - resolution imposing liens on property located in the City for uncollected business registration fees RES. 2004-253 - Resolution of the City of San Bernardino imposing liens on certain parcels of real property located within the City of San Bernardino for uncollected business registration fees. Mayor Pro Tem/Acting Chairman Longville opened the hearing. No public comments were received. Council Member/Commissioner McCammack asked if it would be prudent to turn the list of property addresses over to Code Compliance for immediate special inspection attention before the liens are released. City Attorney Penman stated that it would not be surprising that if someone is not following the City's Municipal Code in terms of paying their business registration fees, that they also are likely not to be following other City ordinances as well. He indicated that there would be nothing wrong with having Code Officers check for obvious Code violations. Council Member/Commissioner McGinnis made a motion, seconded by Council Member/Commissioner Estrada, that the hearing be closed; that the City Clerk be directed to administratively remove any properties from Exhibit A, which have been paid prior to the hearing; and that said resolution be adopted. Dinner workshop - Capital Improvement Program (CIP) presentation - EDA Boardroom (Continued from July 19, 2004) Proposed projects for the 2004-2005 CIP were reviewed by staff covering the areas of Sewers, Storm Drains, Traffic Controls, and Parks & Recreation. City Administrator Wilson stated that the next step was to make changes and have a revised document ready for the Council to look at by the next Council meeting. 24. Public hearing - approval of Development Code Amendment No. 03-05; Tentative Tract Map No. 16757; and Development Permit III No. 03-52 (Continued from July 19, 2004) An Ordinance of the City of San Bernardino modifying Chapter 19.04 (Residential Districts), Section 19.04.030 (2) (N) of the San Bernardino Municipal Code (Development Code) related to planned residential development/small lot subdivisions requirements. FIRST READING The hearing remained open. Valerie Ross, City Planner, provided background information. No public comments were received. Council Member/Commissioner McCammack made a motion, seconded by Council Member/Commissioner McGinnis, that the hearing be closed; that said ordinance be laid over for final adoption; and that Tentative Tract Map No. 16757 and Development Permit III No. 03-52 be approved based upon the Findings of Fact contained in the Planning Commission staff report, subject to the Conditions of Approval and Standard Requirements (Exhibit 2, Attachment D-2). The motion carried by the following vote: Ayes: Council Members/Commissioners Longville, McGinnis, Derry, Kelley, Johnson, McCammack. Nays: None. Absent: Council Member/Commissioner Estrada. 25. Public hearing - Development Code Amendment No. 04-01 - a request to allow for up to six tenants on a monument or pylon sign for commercial centers over 20 acres, and a conditional use permit for a second pylon sign at the HUB Center An Ordinance of the City of San Bernardino amending Chapter 19.22 (Sign Regulations) of the San Bernardino Municipal Code (Development Code) related to monument and pylon signs for regional shopping centers. FIRST READING Mayor Pro Tem/Acting Chairman Longville opened the hearing. 12 08/02/2004 Valerie Ross, City Planner, presented an overview of the project. No public comments were received. Council Member/Commissioner Estrada stated that the idea of having similar signs around the perimeter of the City had been discussed and she questioned whether a particular theme could be adopted for the City. Ms. Ross stated that she believed it would be an advantage to leave the decision up to the shopping center developer because each developer and architect had his/her own opinion of what they think is nice, and they try to make the signage complement the design of the buildings. Council Member/Commissioner McCammack stated that she was concerned that the requirements for centers under 20 acres had not been changed also. Ms. Ross stated that they had only addressed freeway center signs at this time, but she added that there are other areas of the Development Code they would like to take a look at in terms of signage. She stated that signage changes occur rather frequently and she believes it may be time to rethink and readdress the entire sign code. Council Member/Commissioner Johnson made a motion, seconded by Council Member/Commissioner McCammack, that the hearing be closed; that said ordinance be laid over for final adoption; and that Conditional Use Permit No. 04-07 be approved based upon the Findings of Fact contained in the Planning Commission Staff Report (Exhibit B), subject to the Conditions of Approval (Exhibit B, Attachment D). The motion carried by the following vote: Estrada, Longville, McGinnis, Derry, None. Absent: None. 26. Public Comments Ayes: Council Members/Commissioners Kelley, Johnson, McCammack. Nays: Dan Walker, resident of San Bernardino, speaking on behalf of all churches, temples, and synagogues, stated that he felt the City needed an office liaison to help local churches help their communities. John Stevens, 4097 Pershing Avenue, San Bernardino, CA, reported that illegal drug activities were occurring in the park on 40' and Mountain View, and he stated that he would like to see it stopped. 13 08/02/2004 S1. An Ordinance of the City of San Bernardino adding Chapter 8.39 to the San Bernardino Municipal Code regarding seizure and forfeiture of nuisance vehicles. FIRST READING Senior Assistant City Attorney Carlyle stated that the addition of Chapter 8.39 to the Municipal Code would provide the City with an additional tool to deter the problem of illegal depositing, discarding, dumping, and/or placing of garbage, rubbish, recyclable discards, and/or green waste on any property in the City of San Bernardino by empowering the City to seize and to sell the vehicles of persons caught in these illegal acts within the City. Mr. Carlyle stated that the Legislative Review Committee (LRC) modified the ordinance slightly by removing the concept of litter and littering at this time; however, he indicated that the City Attorney's Office was still reviewing this concept and would be bringing it back to LRC in the near future for their reconsideration. Council Member/Commissioner Estrada stated that she would like the City to do its best to alert the public of this action. Mr. Carlyle stated that the City could place an announcement in the water bill in addition to putting a notice on the City's website and Channel 3. Council Member/Commissioner McCammack suggested that perhaps empty billboard signs could be used to promote public awareness regarding illegal dumping. She felt that the ordinance should be strengthened to include littering and she stated that she would like to see signs advising that a $1,000 fine will be imposed for anyone caught doing it. Council Member/Commissioner Kelley stated that this ordinance was about illegal dumping in vacant lots and behind buildings, and he hoped people would soon realize that the City is serious and will not tolerate any illegal dumping. Council Member/Commissioner Longville questioned whether it would be prudent to ask the public to jot down license plate numbers of vehicles if they should happen to witness illegal dumping activities and pass the information on to the City Attorney's Office. City Attorney Penman indicated that they would like to get those license numbers because they do sometimes contact those people.
