HomeMy WebLinkAbout11-08-1990 Minutes City of San Bernardino, California November 8, 1990 This is the time and place set for a Joint Adjourned Regular Meeting of the Mayor and Common Council and Community Development Commission of the City of San Bernardino at their Regular Meeting held at 8:32 a.m., November 5, 1990, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. The City Clerk has caused to be posted the Order of Adjournment of said meeting held on November 5, 1990, and has on file in the Office of the City Clerk an affidavit of said posting together with a copy of said Order which was posted at 10:30 a.m., Tuesday, November 6, 1990, on the door of the place at which said meeting was held. The Joint Adjourned Regular Meeting of the Mayor and Common Council and Community Development Commission of the City of San Bernardino was called to order by Nayor Holcomb at 9:04 a.m., in the Redevelopment Agency Board Room, Fourth Floor, City Hall, 300 North "D" Street, San Bernardino, California. ROLL CALL Roll call was taken by City Clerk Krasney with the following being present: Mayor Holcomb; Council Nembers Estrada, Reilly, Flores, Maudsley, Minor, Miller; Senior Assistant City Attorney Barlow, City Clerk Krasney, City Administrator Edwins. Absent: Council Member pope-Ludlam. DISCUSSION OF PROGRAM BUDGETS AND POTENTIAL REVENUE SOURCES - CONTINUED FROM NOVEMBER 5, 1990 (1) This is the time and place continued to for consideration of program budgets and potential revenue sources. A discussion ensued regarding the City considering other possible alternatives for sources of revenue rather than cutting programs from the City's budget. COUNCIL MEMBER At 9:10 a.m., Council Meeting. POPE-LUDLAM ARRIVED Council Member pope-Ludlam arrived at the Andy Green, Director of Finance answered questions regarding funds remaining from the one million dollars that was set aside for clean-up projects in the City. Senior Assistant City Attorney Barlow explained that the one million dollars is restricted money to be used for Redevelopment purposes. 1 11/8/90 Convention Visitors' Bureau Jim Sivelle, a resident of San Bernardino, spoke regarding the City's use of funds received from the National Orange Show off track betting operation. He stated that these funds were to be used to fund the Tourist Convention operation. However, the City never used this money for that purpose, and instead placed the money in its General Fund account. A discussion ensued regarding the imposed on the City if the City accepted Orange Show off track betting operation. terms and conditions funds from the National Council Member Minor made a motion, seconded by Council Member Miller, for discussion purposes only, to eliminate the Convention and Visitors' Bureau for an annual savings of $286,000. Pat Caffery, Vice-President, Convention Visitors Bureau, requested that the City present a list containing all the proposed cuts in programs and services to allow the private and public sector to review and make recommendations. He suggested that one source of revenue could be obtained through grants from the Federal government. City Administrator implemented a Federal Housing Authority. Edwins stated that the City has already Government funding program through the Mayor Holcomb stated that sometimes grants require City matching funds which could be counter-productive to the City's needs. It was pointed out that if the City had a financial crisis, the City would take the Transient Occupancy Tax funds from the Convention Visitors Bureau and place them in the General Fund. City questions increased businesses Administrator Edwins and City Clerk Krasney answered regarding the last time business license rates were in the City and the last time the City audited for proper reporting of gross receipts. Mayor Holcomb suggested conducting a survey on various businesses in the City to ascertain the point of sale for sales tax purposes. Sam Henley, representing the Chamber of Commerce, spoke regarding the City placing a cap on its utility tax rate. He stated that the Chamber's concern is that there is an open-end business fee for the City of San Bernardino whereas surrounding cities in the Inland Empire do not have such a tax. 2 11/8/90 Mr. Henley, on behalf of the Chamber of Commerce, offered support in working with the City to challenge the County's authority to charge the cities for booking prisoners in the County jail. Mr. Henley read a statement from the San Bernardino Area Chamber of Commerce in opposition to the City's proposal to eliminate $286,000 from the Convention and Visitors' Bureau budget. City Administrator Edwins gave an overview of the proposed programs and services to be cut from the City's budget. A discussion ensued regarding the City's costs to operate various programs and services in the City. Mayor Holcomb stated that one factor that has impacted the City is the decline in the per capita income rate in the City. Andy Green, Finance Director, answered questions the City's costs to maintain its health programs employees, workmen's compensation program, and the impact of liability claims filed against the City. regarding for City financial The Nayor and Council discussed reducing a portion of the Convention and Visitor's Bureau funds. Mayor Holcomb suggested that the Council consider tabling this matter as it would be counter productive and the City could lose more money than it would save by eliminating the Bureau's budget. It was suggested that the Convention and Visitors Bureau consider reviewing its budget to see where cuts can be made, and report back to the Mayor and Council with their recommendations. Geoff Mordue, Society for the Preservation and Encouragement of Barbershop Quartet Singing in America Inc., spoke in support of the Chamber of Commerce and Convention and Visitors' Bureau. He stated that the Barbershop Quartet Society is planning a spring convention in March, 1992, to be held at the Maruko Hotel on "E" Street. He stated that without the support of the Bureau, the Barbershop Quartet Society would not have considered holding its convention in the City of San Bernardino. Council Member Maudsley made a substitute motion, seconded by Council Member Pope-Ludlam, and unanimously carried, that the matter relative to the elimination of the Convention and Visitors' Bureau, for an annual savings of $286,000, be tabled. (Motion No.1) 3 11/8/90 U-tilitv Collection Center and Westside DroP-In Center Council Member Minor made a motion, seconded by Member Miller, -to close the Utility Collection Center annual savings of $46,000. (Motion No.3) Council for an City Treasurer Craig which position would be Utility Collection Center. Graves answered eliminated with questions regarding the closure of the Senior Assistant City Attorney Barlow answered questions regarding bumping rights for Civil Service employees. Carl Clemons, a member of the Affirmative Action Commission, San Bernardino Community Against Drugs, and resident of the City of San Bernardino, spoke in opposition to the closure of the Utility Collection Center. He presented several suggestions that could be implemented by the City to avoid closing the Center. His suggestions included raising the rates for processing utility bills, waiving the rental costs for the Wests ide Drop-In Center and allowing the Westside Drop-In Center to assume the responsibilities that are currently performed by an outside contractor. City Treasurer Graves explained why the City does not charge a service fee for processing utility payment stubs. A discussion ensued regarding imposing an additional fee of $.25 per stub processed at the Utility Collection Center. Also discussed was the possibility of closing the Center during non- peak periods. City Treasurer Graves recommended as an alternative to closing the utility collection center, that the Center be merged with the Westside Drop-In Center and eliminate one cashier position. City Administrator Edwins suggested that there may be a potential of losing revenue if the City imposes too high a fee per stub processed at the Utility Collection Center. (Motion No.6) Motion Nos. 4 and 5 are listed as follows: Motion No. 4 Close the Cultural Center along with the Victim Support Program for an annual savings of $107,000; or Close the Cultural Center and retain the Victim Support Program for an annual savings of $60,000. Motion No. 5 Approve Option tl which reduces the cost at the Wests ide Drop-In Center by $67,000; or Close the Wests ide Drop-In Center for an annual savings of $108,000. (Option t2) City Administrator Edwins pointed out that if the substitute motion is passed, the City cannot expect a cost savings by closing the Westside Drop-In Center nor the Cultural Center. Council Member Reilly made a second substitute motion, seconded by Council Member Miller, to instruct the City Treasurer to come back with a method of cutting $46,000 off the operations of the Utility Collection Center by any combination of factors including charging $.25 per bill, merging the Utility Collection Center with the Westside Drop-In Center, or transferring the Center to a library facility. The second substitute motion carried by the following vote: Ayes: Council Members Estrada, Reilly, Flores, Pope-Ludlam, Miller. Nays: Council Members Maudsley, Ninor, Absent: None. RECESS MEETING At 10:32 a.m., Mayor Holcomb declared a five-minute recess. 5 11/8/90 RECONVENE MEETING At 10:40 a.m., the Joint Adjourned Regular Meeting of the Nayor and Common Council and Community Development Commission reconvened in the Redevelopment Agency Board Room, Fourth Floor, City Hall, 300 North "D" Street, San Bernardino, California. ROLL CALL Roll call was taken with the following being present: Mayor Holcomb; Council Members Estrada, Reilly, Flores, Maudsley, Minor, Miller; Senior City Attorney Barlow, City Clerk Krasney, City Administrator Edwins. Absent: Council Nember Pope-Ludlam. Cultural Center and Westside Drop-In Center A discussion ensued regarding the possibility of the City charging non-residents for use of City park facilities, fire and police response calls. COUNCIL MEMBER POPE-LUDLAM RETURNED Council Member pope-Ludlam returned to the Council Meeting and took her place at the council table. City Administrator Edwins answered questions regarding how the City could charge non-residents for police and fire response calls. Council Member Minor made a motion, seconded by Council Member Reilly, and unanimously carried, to close the Cultural Center, along with the Victim Support Program, for an annual savings of $107,000 with the understanding that the Community Service Office (COP) be kept open. The Mayor and Common Council took no further action concerning the Parks and Recreation budget. 6 11/8/90 Library Budget Council Member Nember pope-Ludlam discussion regarding budget allocation by page 8 Miller made a motion, seconded by Council and unanimously carried, to continue consideration of reducing the Library's $375,000, until later in the meeting. See Evidence Money Council Member Ninor made a motion, seconded by Council Member Flores, and unanimously carried, to reduce the General Fund allocation for evidence money by $24,000. (Motion No.8) Meetings and Conferences Council Nember Minor made a motion, seconded by Council Member Miller, to cut the Meetings and Conferences budget expenses for all departments by a total of $60,000 for FY 1990- 91. (Motion No.9) The motion carried, by the following vote: Members Estrada, Reilly, Flores, Naudsley, Minor, Council Member Pope-Ludlam. Absent: None. Ayes: Council Miller. Nays: Non-Challenoed Incumbents Appearing on Election Ballot City Administrator Edwins stated that by not having the names of non-challenged incumbents appear on the Primary Election ballot, the City could save half the costs of a primary election, approximately $40,000. Council Member Flores made a motion, seconded by Council Member Minor, and unanimously carried, that the City Attorney be instructed to prepare an amendment to the Municipal Code to state that the names of non-challenged incumbents will not appear on the Primary Election ballot. (Motion No. 10) Central City Mall Water Fountain Council Member Member Minor, and fountain at Central (Motion No. 11) Maudsley made a motion, seconded unanimously carried, to close City Mall for an annual savings of by Council the water $9,000. Liqhtino Costs for Adult Team Sports Council Member Minor made a motion, seconded by Council Member Flores, to require participants in adult team sports to pay lighting costs for annual revenue of $25,000. Ayes: Nays: Council Council Liohting Costs for Youth Teams and Leagues A discussion ensued regarding the costs to the City for maintaining and preparing park facilities for youth teams and leagues. It was suggested that adult teams, youth teams and leagues be required to prepare a budget to include the costs for field maintenance and field lighting. Council Member Member Estrada and require youth teams $75,000 be tabled. Engineering Fee Increase Council Member Minor made a motion, seconded by Council Member Estrada, and unanimously carried, to authorize the increase in Engineering fees per the memorandum dated November 8, 1990, from Roger G. Hardgrave, Director of Public Works/City Engineer. (Motion No. 15) Roger Hardgrave, Director of Public Works/City answered questions regarding the anticipated revenue increase in plan check and permit fees. Engineer, from the Library Budoet - Continued from earlier in the meetino (See paoe 7) Council Member Minor made a motion, seconded by Council Member Flores, to reduce the Library Budget allocation by $75,000 or two and one-half percent. A discussion ensued regarding the effects on budget if the City reduced the Library budget $375,000. the Library's allocation by 8 11/8/90 Marion Vassilakos, Assistant City Librarian, answered questions regarding the anticipated savings if Feldheym Library was closed every Sunday. She answered further questions regarding the possibility of charging the public for use of the main auditorium. Council Member Flores made a substitute motion, seconded by Council Member Minor, to reduce the Library Budget allocation by $90,000 the equivalent of three percent. (Motion No.7) The motion failed by the following vote: Members Flores, Maudsley, Ninor. Nays: Council Reilly, Pope-Ludlam, Miller. Absent: None. Ayes: Council Members Estrada, Council Nember Minor's original Budget allocation by $75,000, or unanimously carried. motion to reduce the Library two and one-half percent, Marion Vassilakos, Assistant City Librarian, answered questions regarding services that the City could provide to the County that would save the County some money. Mayor Holcomb stated that upon his request, Ms. Vassilakos will be looking into the feasibility of operating the library on a regional basis rather than every jurisdiction having its own library. He stated that this option could possibly save the County some money. COUNCIL MEMBER POPE-LUDLAM EXCUSED Council Member Pope-Ludlam left the Council Meeting. ANNOUNCEMENT BY CRAIG GRAVES, CITY TREASURER Craig Graves, City Treasurer, announced that he would not be seeking a fourth term as City Treasurer for the City of San Bernardino. A discussion ensued regarding merging the City Treasurer's functions with the Finance Department and reducing the City Treasurer's full-time position to part-time position. COUNCIL MENBER POPE-LUDLAM RETURNED Council Member Pope-Ludlam returned to the Council Meeting and took her place at the council table. RECESS MEETING - CLOSED SESSION (2) At 11:35 a.m., Council Member Pope-Ludlam made a motion, seconded by Council Member Minor, and unanimously carried, that the Mayor and Common Council and Community Development Commission recess to closed session for the following: 9 11/8/90 a. to consider personnel matters pursuant to Government Code Section 54957; b. to meet with designated representatives regarding labor relations matters pursuant to Government Code Section 54957.6; c. to confer with the litigation pursuant to S49S6.9(b),(1), as there litigation; attorney regarding pending Government Code Section is significant exposure to d. to confer with the attorney regarding litigation pursuant to Government Code S49S6.9(c), so that Council/Commission may whether to initiate litigation. pending Section decide e. to confer with the attorney regarding pending litigation which has been initiated formally to which the City is a party pursuant to Government Code Section S49S6.9(a) . (Motion No. R-l) The motion carried by the following vote: Ayes: Members Reilly, Flores, Maudsley, Minor, Pope-Ludlam, Nays: Council Member Estrada. Absent: None. Council Miller. Council Member Minor made a motion, seconded by Council Member Reilly, that the Mayor and Common Council and Community Development Commission authorize the conducting of a salary survey for the positions of Economic Development Agency Administrator, Executive Director of the Community Development Department/Redevelopment Agency and Deputy Director of the Community Development Department/Redevelopment Agency. (Motion No. R-2) The motion carried by the following vote: Ayes: Members Reilly, Flores, Maudsley, Minor, Pope-Ludlam, Nays: Council Member Estrada. Absent: None. Council Miller. Council Member Minor made a motion, seconded by Council Nember Reilly, that the Mayor and Common Council and Community Development Commission authorize the commencement of recruitment proceedings for the Deputy Director of the Community Development Department/Redevelopment Agency. (Motion No. R-3) The motion carried by the following vote: Ayes: Nembers Reilly, Flores, Maudsley, Minor, Pope-Ludlam, Nays: Council Member Estrada. Absent: None. Council Miller. Council Member Minor made a motion, seconded by Council Member Reilly, that the Mayor and Common Council and Community Development Commission select "Development Department" as the new name for the consolidated Community Development Department/Redevelopment Agency. (Motion No. R-4) The motion carried by the following vote: Ayes: Nembers Reilly, Flores, Maudsley, Minor, Pope-Ludlam, Nays: Council Member Estrada. Absent: None. 11 Council Miller. 11/8/90 Council Member Minor made a motion, seconded by Council Member Pope-Ludlam, that the Mayor and Common Council and Community Development Commission adopt the suggested four division organizational structure for the consolidated Community Development Department/Redevelopment Agency. (Motion No. R-S) The motion carried by the following vote: Members Reilly, Maudsley, Minor, Pope-Ludlam, Council Nembers Estrada, Flores. Absent: None. Ayes: Council Miller. Nays: SR. ACCOUNTANT RECRUITMENT & SALARY SURVEY - EMERGENCY ITEM Council Member Reilly made a motion, seconded by Council Member Maudsley, and unanimously carried, that the matter relative to the recruitment of a Senior Accountant and salary survey be heard at this time since the item arose subsequent to the posting of the Council and Community Development agendas. Kenneth Henderson, Executive Director, Community Development Department/Redevelopment Agency, requested authorization for the recruitment and salary survey for the position of Senior Accountant in the Accounting Division, as this position will become vacant November 30, 1990. Council Member Ninor made a motion, seconded by Council Member Maudsley, and unanimously carried, that the Mayor and Common Council and Community Development Commission authorize the recruitment and salary survey for a Senior Accountant position.
