This is the time and place set for an Adjourned Regular
Meeting of the Mayor and Common Council of the City of San
Bernardino at the Regular Meeting held at 10:51 a.m., Monday,
October 1, 1990, in the Council Chambers of City Hall, 300 North
"D" Street, San Bernardino, California.
The City Clerk has caused to be posted the order of
adjournment of said meeting held on October 1, 1990, and has on
file in the office of the City Clerk an affidavit of said posting
together with a copy of said order which was posted at 3:00 p.m.,
Tuesday, October 2, 1990, on the door of the place at which said
meeting was held.
The Adjourned Regular Meeting of the I1ayor and Common
Council was called to order by Mayor Holcomb at 8: 04 a. m. ,
Saturday, October 6, 1990, in the Council Chambers of City Hall,
300 North "D" Street, San Bernardino, California.
ROLL CALL
Roll call was taken by Deputy City Clerk Reese with the
following being present: Mayor Holcomb; Council Members Estrada,
Reilly, Flores, Maudsley, Minor; City Attorney Penman, Deputy
City Clerk Reese, City Administrator Edwins. Absent: Council
Members pope-Ludlam, Miller.
INVOCATION
The invocation was given by Phil Arvizo, Executive Assistant
to the Council.
PLEDGE OF ALLEGIANCE
The pledge of allegiance was led by Council Member Maudsley.
BUDGET CRISIS
Mayor Holcomb explained the financial crisis facing the City
which has been brought about by several different factors. He
stated that the City has been mandated by the State to conduct
several environmental projects which are very costly. The sewage
treatment requirements are much more sophisticated now and the
local plant must be improved. The City water system has to be
updated by certain criteria never before required. Therefore,
there will be increases in residents' water bills.
Mayor Holcomb explained that the City is required by law to
have a balanced budget, which the City had for this current year
until several things happened. The legislature in Sacramento
passed its budget by taking money away from the counties. The

counties, in order to make up the deficit, can now charge cities
for booking prisoners and for a portion of the costs for
collecting local taxes. The charges for booking prisoners could
amount to as much as $2,000,000.
Secondly, the oil crisis has brought about an increase in
the cost of gas and oil, which had not been anticipated during
budget preparation. Mayor Holcomb stated that the City will be
paying at least $200,000 more for fuel for City vehicles.

Mayor Holcomb stated that the nation is now in a recession.
This will negatively impact the City's financial position because
it will result in a loss of sales tax revenue.
Mayor Holcomb explained that another financial burden might
be passed on to the City if the Congress passes a budget bill
providing that cities will have to pay for Medicare and Social
Security costs, in addition to the PERS costs, which will mean an
additional $400,000 to $500,000.
The Mayor explained that the purpose of this meeting was to
find ways to meet these increased budget costs. One of the
possibilities is the adjustment of some business license fees so
that they are more equitable and in line with what other cities
are charging. Some of the business license fees were set in the
1920's and have never been changed.
READING AND WAIVING OF ORDINANCES AND RESOLUTION
Deputy City Clerk Reese read the titles of all the
ordinances and the resolution on the Agenda.
Council Member Minor made a motion, seconded by Council
Member Estrada, and unanimously carried, that further reading of
all the ordinances and the resolution on the agenda be waived.

City Administrator Edwins explained that some controversy
had arisen about the proposed changes in the business license
rates because of an error made in a comparison study on
businesses in surrounding areas authorized by the Chamber of
Commerce. The accounting firm doing the study miscalculated the
San Bernardino rate by $10,000 per business. The error was later

Mrs. Edwins answered questions regarding reporting of gross
receipts by wholesalers and manufacturers.
The City Administrator also answered questions regarding
business license fees for the professional category, such as
engineers and accountants. She stated that in 1984, the City
Attorney stated that these firms only had to report 20% of the
business done outside the City and processed through the local
office. This was based on the fact there is an overhead charge
for maintaining that office. They must report full gross
receipts for the business done within the City.
City Administrator Edwins answered questions regarding the
licensing of contractors. She stated that a contractor pays a
flat rate of $150 per year regardless of the number of jobs done
within the City.
Shauna Edwins, City Administ.rator, answered questions
regarding barbershops and hair salons. She explained that the
shop owner determines whether he/she will have one business
license covering all operators, or require each operator to
obtain his/her own license. The fee for this t.ype of business is
being changed from a flat rate to reporting gross receipts.
Mrs. Edwins explained that the minimum rate for retailers
has been raised from $40.00 to $60.00. She stated that once a
person has been in business for more than one business license
cycle, he/she pays on gross receipts.
Council Member Reilly made a motion, seconded by Council
Member Flores, that said ordinance be adopted.

City Administrator Edwins answered questions regarding the
process of raising fees. Many of the City's fees are set forth
in the Municipal Code, which requires a more complicated method
of amendment than a resolution. She explained that the enabling
ordinance provides that fee changes can take place by
resolution. When fees are raised by resolution, State law
requires that a public hearing be held prior to the adoption of
the resolution. If fees are increased by ordinance, the City is
not required to advertise prior to its passage. The ordinance is
advertised after it has been adopted.
Council Member pope-Ludlam made a motion, seconded by
Council Member Reilly, that said ordinance be adopted.

APPROVAL OF 1989-90 CONTINUING APPROPRIATION AND
ENCUMBRANCE CARRYOVERS - CONTINUED FROM OCTOBER 1, 1990

In a memorandum dated August 20, 1990, Andrew
Director of Finance, presented the recommended lists of
continuing appropriations and encumbrances for the
budget. He explained that these items represent

City Administrator Edwins explained that funds in the
carryover items are funds that have been encumbered, but not yet
paid. They can be spent only for special projects or purposes
and cannot be used for General Fund expenses.
Mayor Holcomb commended City Administrator Edwins and
Finance Director Green for bringing forth this report in such a
clear, precise manner.
Council Member Estrada made a motion, seconded
Member Reilly, and unanimously carried, that the

MEETING - CONSIDERATION OF CURRENT LEGISLATION -
OCTOBER 10, 1990 - FELDHEYM LIBRARY
Mayor Holcomb announced that a SanBag meeting will be held
at 11:00 a.m., on Wednesday, October 10, 1990, at Feldheym
Library, 555 West 6th Street. During a portion of this meeting,
mayors of local cities will be urged to take a position on what
should be done next January to repeal the law that allows
counties to charge cities for booking prisoners and the cost of
collecting city property taxes.
City Attorney Penman answered questions, stating that if
more than three Council Members attended the meeting but were
only members of the audience and took no part in the discussion,
it would not be necessary to adjourn the present meeting to the
date of October 10, 1990.
Mayor Holcomb also explained that the there will be a League
of California Cities meeting on October 22, 1990. The League is
asking cities to unite in requesting that legislators repeal the
law that can take funds from cities to meet the deficits of
county and state governments.
Mayor Holcomb stated that the proposed law tends to be
discriminatory, as cities which have their own police departments
will be required to pay the booking fees, while cities who do not
have police departments, but contract with the Sheriff's
Department, won't have to pay those fees.
Mayor Holcomb also spoke against Proposition 136 that will
appear on the ballot on November 6, 1990, which would prevent
cities from increasing taxes or fees without a 2/3 vote of the
electorate.

by Council Member Estrada, and unanimously carried, that the
meeting be adjourned to 1:00 p.m., Saturday, October 13, 1990, in
the Council Chambers of City Hall, 300 North "D" Street, San
