April 11, 1990
This is the time and place set for an Adjourned Regular
Meeting of the Mayor and Common Council of the City of San
Bernardino at their Adjourned Regular Meeting held at 8:30 a.m.,
Monday, April 9, 1990, in the Council Chambers of City Hall, 300
North "D" Street, San Bernardino, California.
The City Clerk has caused to be posted the order of
adjournment of said meeting held on April 9, 1990, and has on
file in the office of the City Clerk an affidavit of said posting
together with a copy of said order which was posted at 10: 00
a.m., Tuesday, April 10, 1990, on the door of the place at which
said meeting was held.
The Adjourned Regular Meeting of the Mayor and Common
Council of the City of San Bernardino was called to order by
Mayor Holcomb at 1:35 p.m., in the Kellogg Room of Feldheym
Library, 555 West Sixth Street, San Bernardino, California.
ROLL CALL
Roll call was taken by Deputy City Clerk Medina with the
following being present: Mayor Holcomb; Council Members Estrada,
Reilly, Flores, Minor; Deputy City Attorney Empeno, Deputy City
Clerk Medina. Absent: Council Members Maudsley, Pope-Ludlam,
Miller; City Administrator Julian.
PUBLIC COMMENTS
There were no public comments.

Development Code - Subdivision provision
Sandra Paulsen, Senior Planner, Planning and Building
Services, referred to the Administrative Draft Subdivision
provisions of the Development Code, which was distributed to the
Council for review. This document incorporates provisions of
current state laws and Title 18 of the San Bernardino Municipal
Code.
John Montgomery, Principal Planner, Planning and Building
Services, stated that two new sections have been added to this
administrative draft: 1) park dedications; and 2) bike
dedications. The park dedication section is being reviewed by
the Director of Parks & Recreation and the bike dedication
section is being reviewed by the Director of Public Works. Mr.
Montgomery stated that the open space and subdivision
improvements guarantee sections need to be reviewed more
carefully to make sure all provisions are legal and up to date.

Gene Klatt, Assistant City Engineer, answered questions
regarding the Engineer's policies and Procedures Manual. He
stated that there is flexibility within the policy manual. He
also answered questions regarding the person responsible for
establishing the policies in the manual.
A discussion ensued regarding all the information for Title
18 being covered under this administrative draft.

John Montgomery stated that a number of issues are included
under the property development standards. One particular
question raised was whether or not the City should have a
pipeline setback. He stated that he received a book from the
federal government concerning pipeline safety which included an
ordinance from the City of Maplewood, Minnesota. The ordinance
proposed a building setback of 100 feet with some exceptions.
A discussion ensued regarding what is considered a safe
distance for a setback.
Mayor Holcomb recommended that until the federal government
establishes guideline standards for pipelines, the City should
not attempt to establish the distance for a setback.
A discussion ensued regarding the City's liability and
protection for the residents relative to pipeline setbacks.
Deputy City Attorney Empeno pointed out that staff is
seeking direction for new subdivisions that may be located either
on or in the vicinity of a pipeline. He stated that perhaps
further studies can be performed, or some rules and conditions
can be established that would restrict the type or intensity of
development. He further explained the type of developments that
could be developed above a pipe line. Mr. Empeno encouraged the
Council to investigate the matter further.
It was suggested that a conditional use permit be required
for any development within 500 feet of a pipeline.
John Montgomery, Principal Planner, explained that a
conditional use permit process lS no different than a tentative
tract approving process. He further explained the procedure used
by the Planning Department for approving tentative tracts and
conditional use permits.

Mayor Holcomb stated that a conditional use permit would
allow an arbitrary distance to be established on a case by case
basis.
A discussion ensued regarding the number of pipelines in the
City.
Senior Citizens Desian Standards
It was pointed out that the parking standards for senior
projects are too restricted and should be reevaluated.
A discussion ensued regarding the one-and-one-half parking
spaces allocated for each dwelling unit of a senior housing
project stipulated in the Development Code, and the number of
parking spaces allocated for other senior housing projects in the
City approved prior to the Development Code.
John Montgomery, Principal Planner, answered questions
regarding the requirement of a conditional use permit for senior
housing complexes to allow flexibility of the parking standards.
It was the consensus of the Council to require a conditional
use permit for all senior housing projects to allow flexibility
of the parking standards.
Minimum Dwellina Size Standards
John Montgomery, Principal Planner, stated that the minimum
square footage for single family detached dwellings was reduced.
He also pointed out that the minimum bedroom size standards were
reduced from 140 to 120 square feet.

MAYOR HOLCOMB EXCUSED
At 2:30 p.m., Mayor Holcomb left the Council meeting.
A discussion ensued regarding the reduced square footage for
single family dwellings.

John Montgomery, Principal Planner, stated that this meeting
completes discussion of the draft Development Code, and public
hearings would be conducted in one to two months.
ADJOURNMENT
At 2:35 p.m., Mayor Pro Tempore Minor ordered the meeting of
the Mayor and Common Council adjourned to Monday, April 16, 1990,
at 8:30 a.m., in the Council Chambers of City Hall, 300 North "D"
Street.
