City of San Bernardino, California
February 12, 1990
The Special Meeting of the Mayor and Common Council and
Community Development Commission of the City of San Bernardino
was called to order by Mayor Holcomb at 9: 05 a. m., Monday,
February 12, 1990, in the Council Chambers of City Hall 300
North "D" Street, San Bernardino, California.
ROLL CALL
Roll call was taken by City Clerk Clark with the following
being present: Mayor Holcomb; Council Members Estrada, Reilly,
Flores, Maudsley, Minor, Pope-Ludlam, Miller; City Attorney
Penman, City Clerk Clark, City Administrator Julian.
INVOCATION
The Mayor requested a moment of silence for Officer Robert
Shultis, who was killed on the line of duty.
PLEDGE OF ALLEGIANCE
The pledge of allegiance was led by Council Member Minor.
READING AND WAIVING OF RESOLUTION
City Clerk Clark read the title the resolution on the
Council agenda.
NORTON REUSE INLAND VALLEY DEVELOPMENT AUTHORITY
MEMBERSHIP
Council Member Maudsley made a motion, seconded by Council
Member Miller and unanimously carried, that the appointment of
three representatives from the City of San Bernardino to the
Board of the Joint Powers Authority be approved, and that Mayor
Holcomb, Council Member Estrada and Council Member Flores be
appointed to represent the City at the meetings of the Joint
Powers Authority; and that Mayor Holcomb be designated as the
primary representative to the Board of the Joint Powers
Authority.
Council Member Minor made a motion, seconded by Council
Member Miller and unanimously carried, that Council Member
Estrada be appointed as the alternate for Mayor Holcomb, the
primary member, and that Council Member Pope-Ludlam be appointed
as alternate for the other two members.
City Attorney Penman answered questions regarding who can
serve as the alternate members to the Board of the Joint Powers
Authority. He stated that any elected official in the City of
San Bernardino can serve on the Board.

Council Member Minor made a motion, seconded by Council
Member Reilly and unanimously carried, that further reading of
the resolution be waived and said resolution be adopted.
RES. 90-47 - RESOLUTION OF THE CITY OF SAN BERNARDINO
AUTHORIZING THE EXECUTION OF AN AMENDED JOINT EXERCISE
OF POWERS AGREEMENT WITH THE COUNTY OF SAN BERNARDINO,
THE CITY OF COLTON AND THE CITY OF LOMA LINDA RELATING
TO THE INLAND VALLEY DEVELOPMENT AGENCY. (1)
City Attorney Penman stated that the state law requires that
a disclosure statement be filled out by the Mayor, Council
Members and City Attorney. These statements have been filled out
and signed by all eight of the elected individuals named. The
law prohibits acquiring property within the Joint Powers
Authority (JPA) area or voting or discussing anything to do with
the JPA.
The City Attorney's Office, working with Engineering, has
located each Council Member's and the Mayor's properties, have
designated a radius of 300+ feet around each of the properties
and have taken them out of the JPA area. He stated that this was
done at the initiative of the City Attorney's Office and is
appropriate under the Fair Political Practice's Commission
regulations. Mr. Penman further stated that the Mayor and seven
Council Members may legally participate in all decisions dealing
with the Joint Powers Authority.
ADJOURNMENT
At 9:15 a.m., Council Member Pope-Ludlam made a motion,
seconded by Council Member Miller and unanimously carried, that
the Mayor and Common Council Meeting of the City of San
Bernardino be adjourned to Wednesday, February 14, 1990, at 1:30
p.m., at the Feldheym Library, 555 West 6th Street, San
Bernardino, California.
