January 3, 1990
The Regular Meeting of the Mayor and Common Council and
Community Development Commission of the City of San Bernardino
was called to order by Mayor Holcomb at 1:30 p.m., Wednesday,
January 3, 1990, in the Council Chambers of City Hall, 300 North
"D" Street, San Bernardino, California.
ROLL CALL
Roll call was taken by City Clerk Clark with the following
being present: Mayor Holcomb: Council Members Reilly, Maudsley,
Minor, Miller; Senior Assistant City Attorney Barlow, City Clerk
Clark, City Administrator Julian. Absent: Council Members
Estrada, Flores, Pope-Ludlam.
Also present was Bob Temple, Executive Director of the
Redevelopment Agency.
INVOCATION
The invocation was given by Phil Arvizo, Executive Assistant
to the Council.
PLEDGE OF ALLEGIANCE
The pledge of allegiance was led by Council Member Miller.

At 1:34 p.m., Council Members Flores and Pope-Ludlam
at the Council meeting and took their place at the

PUBLIC COMMENTS
Mayor Holcomb commented on the closure of
January 2, 1990. He stated that there should have
of notification informing the public that City
closed. He recommended that there be a skeleton
to serve the public in the future when City Hall
day other than a regularly observed holiday.

READING OF RESOLUTIONS AND ORDINANCES
City Clerk Clark read the titles of all the resolutions and
ordinances on the Council and Community Development
Commission/Redevelopment Agency agendas.

ADJOURNED REGULAR MEETING
The Regular Meeting of the Communi ty Development
Commission/Redevelopment Agency was called to order by Chairman
Holcomb in the Council Chambers of City Hall, 300 North "D"
Street, San Bernardino, California.

Council Member Flores made a motion, seconded by Council
Member Pope-Ludlam, that said resolution be adopted.
Resolution No. 90-1 was adopted by the following vote:
Ayes: Council Member Reilly, Flores, Maudsley, Minor, Pope-
Ludlam, Miller. Noes: None. Absent: Council Member Estrada.
ORDINANCE OF THE CITY OF SAN BERNARDINO, CALIFORNIA,
ADDING CHAPTER 15.73 TO THE SAN BERNARDINO MUNICIPAL
CODE TO REQUIRE THE LEVY OF AN INFRASTRUCTURE
DEVELOPMENT FEE FOR RIGHT-OF-WAY IMPROVEMENTS AND
PUBLIC IMPROVEMENTS IN THE VERDEMONT AREA. FINAL (3)
Senior Assistant City Attorney Barlow explained why this
ordinance was recommended to be tabled. He stated that there
will be a replacement ordinance available for review at the next
Council meeting to be held January a, 1990. He further stated
that the replacement ordinance will contain changes made in the
description of property to include a portion of Palm Avenue.
Council Member Miller made a motion, seconded by Council
Member Flores and unanimously carried, that said ordinance be
tabled.
RES. 90-2 - RESOLUTION OF THE MAYOR AND COMMON COUNCIL
OF THE CITY OF SAN BERNARDINO, CALIFORNIA, REVISING THE
AMOUNT OF AN INFRASTRUCTURE FEE TO BE LEVIED FOR RIGHT-
OF-WAY IMPROVEMENTS AND PUBLIC IMPROVEMENTS. (4)
Roger Grable with Rutan and Tucker, representing McClellan
Development, requested clarification concerning prepayment of the
infrastructure fees. He stated that his concern was whether or
not he would have an opportunity to: 1) obtain credits for the
improvements made; 2) pay the infrastructure fees in
installments; and 3) apply the credits against the thirty
percent down payment with the balance to be paid on installments
secured by a note.
Mayor Holcomb addressed each of Mr. Grable's concerns with
an affirmative answer.
Mayor Holcomb answered questions regarding whether or not
the negotiated credits for the improvements made could be applied
against the thirty percent down payment requirement.
Mr. Grable stated that all his

A discussion ensued regarding how infrastructure
improvements could be placed in the Verdemont area ahead of time
if credits were applied in lieu of the thirty percent down
payment requirement.
Senior Assistant City Attorney Barlow answered questions
explaining the purpose of the resolution.
The Mayor and Council discussed at what point the
infrastructure fees would be paid to the city.
Mayor Holcomb stated that the purpose of this resolution is
to set forth provisions to raise enough money for major
infrastructure improvements in the Verdemont area.
Mayor Holcomb answered questions. He stated that a
developer who puts in the infrastructure improvements and obtains
a credit for these improvements would be required to pay the
equivalent additional fees, if the amount for the development
rights was more than the credit issued.
Council Member Minor made a motion, seconded by Council
Member Reilly and unanimously carried, that further reading of
the resolution be waived and said resolution be adopted.
A discussion took place concerning payment of infrastructure
fees for improvements already installed in the Verdemont area.
Mayor Holcomb clarified the issue, stating that the payment
for infrastructure fees is only for new development in the
Verdemont area. He explained that if a developer has a piece of
land that does not have infrastructure improvements, the
developer could either put in the improvements or buy development
rights. He further stated that this proposed resolution is for
installation of all major infrastructure on the main streets in
the Verdemont area.
Senior Assistant City Attorney Barlow stated that a

INFRASTRUCTURE DEVELOPMENT FEE PROGRAM FOR RIGHT-OF-
WAY IMPROVEMENTS AND PUBLIC IMPROVEMENTS IN THE
VERDEMONT AREA. FINAL ( 5 )
Council Member Flores made a motion, seconded by Council
Member Reilly and unanimously carried, that further reading of
the ordinance be waived.
Council Member Minor made a motion, seconded by Council
Member Miller, that said ordinance be adopted.
The motion to adopt said ordinance failed by the following
vote: Ayes: Council Members Reilly, Maudsley, Minor, Miller.
Noes: Council Members Flores, Pope-Ludlam. Absent: Council
Member Estrada. (This ordinance was later reconsidered. See
page 5).
RECESS MEETING
At 1:50 p.m., Council Member Minor made a motion, seconded
by Council Member Reilly, that the meeting be recessed until 3:00
p.m.
The motion carried by the following vote: Ayes:
Members Reilly, Flores, Minor, Pope-Ludlam, Miller.
Council Member Maudsley. Absent: Council Member Estrada.

RECONVENE MEETING
At 3:00 p.m., Mayor Holcomb called the Regular Meeting to
order in the Council Chambers of City Hall, 300 North "D" Street,
San Bernardino, California.
ROLL CALL
Roll call was taken by City Clerk Clark with the following
being present: Mayor Holcomb; Council Members Reilly, Flores,
Maudsley, Minor, Pope-Ludlam, Miller; Senior Assistant City
Attorney Barlow, City Clerk Clark, City Administrator Julian.
Absent: Council Member Estrada.
RECONSIDERATION - URGENCY ORDINANCE EXTENDING THE EFFECTIVE
DATE OF AN INFRASTRUCTURE DEVELOPMENT FEE PROGRAM FOR RIGHT-
OF-WAY IMPROVEMENTS AND PUBLIC IMPROVEMENTS IN VERDEMONT.
Council Member Maudsley made a motion, seconded by Council
Member Minor and unanimously carried, that the urgency ordinance
extending the effective date of an infrastructure development fee
program for right-of-way improvements and public improvements in
the Verdemont area, be reconsidered for the purpose of adoption.
(Action taken earlier in the meeting to adopt this ordinance
failed). (See page 4) (5)

Council Member Minor made a motion, seconded by Council
Member Miller, that said ordinance be adopted.
Senior Assistant City Attorney Barlow answered questions
regarding the purpose of this ordinance. He stated that the
ordinance is to provide a process whereby the city can get the
money up front for the installation of infrastructure
improvements in the Verdemont area.
Ordinance MC-695 was adopted by the following vote: Ayes:
Council Members Reilly, Maudsley, Minor, Pope-Ludlam, Miller.
Noes: Council Member Flores. Absent: Council Member Estrada.
NORTON AIR FORCE BASE CLOSURE RESPONSE TO DRAFT
ENVIRONMENTAL IMPACT STATEMENT
In a memorandum dated December 27, 1989, Larry Reed,
Director of Planning and Building Services Department, provided
comments from the Planning, Engineering and Water Departments
concerning the Department of the Air Force Draft Environmental
Impact Statement for the closure of Norton Air Force Base.

In a memorandum dated December 27, 1989, Kaye Schurkens,
Senior Planner, provided comments from the Planning Department,
concerning the clean-up of the various waste sites at Norton Air
Force Base. She stated that the sites contain a variety of waste
products which include hazardous wastes and wastes with low level
radiation, as well as uncompacted landfills and petroleum
distillates.
In a memorandum dated December 14, 1989, Gene R. Klatt,
Assistant City Engineer, requested additional information or
clarification on the additional archeological sites that have
been identified but have not been located on any map of the base.
In a memorandum dated December 28, 1989, Bernard C. Kersey,
Director, Administration & Finance, Water Department, provided
comments to the Draft Environmental Impact Statement for the
closure of Norton Air Force Base. Mr. Kersey commented on
several topics dealing with the installation restoration program,
groundwater, and public utilities.
In a memorandum dated December 29, 1989, Lieutenant Thomas
D. Maier of the Police Department listed two concerns regarding
the Draft Environmental Impact Statement for the closure of
Norton Air Force Base. These concerns addressed the issues of

transportation of hazardous substances from the base site to
disposal locations, and the eventual disposition of base housing
located north of Third Street.
City Administrator Julian requested that an additional
motion be made directing the City Administrator to direct the
Draft Environmental Impact Statement to the Department of the Air
Force.
Council Member Miller made a motion, seconded by Council
Member Reilly and unanimously carried, that the Mayor and Common
Council receive and file the responses to the Draft
Environmental Impact Statement for the closure of Norton Air
Force Base from the Engineering Division and Planning Division;
and that the City Administrator be instructed to direct the
Environmental Impact Statement to the Department of the Air
Force.
City Administrator Julian answered questions regarding a
time frame for a response from the Department of the Air Force
concerning the city's comments to the Environment Impact
Statement for the closure of Norton Air Force Base.
ADJOURNMENT
Council Member Miller made a motion, seconded
Member Reilly and unanimously carried, that the
adjourned to 8:30 a.m., Monday, January 8, 1990, in
Chambers of City Hall, 300 North "D" Street, San
